(Baonghean.vn) - The Director of Minh Khang Trading Co., Ltd., Ms. Nguyen Thi Thu and Mr. Nguyen Dinh Khang were prosecuted and temporarily detained for the crime of "Fraudulent appropriation of property" on September 16, 2021; as of November 30, 2022, the total tax debt of Minh Khang Trading Co., Ltd. is more than 312 billion VND.

According to a source from Nghe An Newspaper, in mid-January 2023, the Provincial People's Procuracy transferred the indictment and case file of "Fraudulent appropriation of property" of the Director and his wife.Minh Khang Trading Co., Ltd.to the Provincial People's Court.

A leader of the Provincial People's Court confirmed this content. When asked about the time to bring the case of "Fraudulent appropriation of property" of the couple of Directors of Minh Khang Trading Company Limited to trial, he replied: "The court has accepted the case, because the file is quite thick, we are currently focusing on researching...".

On August 15, 2021, the Investigation Police Agency of the Provincial Police Department issued Decision No. 110/VPĐTCAT to prosecute a criminal case on the crime of "Fraudulent appropriation of property" at the project to build a complex of hotels, supermarkets trading in pharmaceuticals - medical equipment and housing in Nghi Phu commune (Vinh city) invested by Minh Khang Trading - Co., Ltd.

On September 16, 2021, the Investigation Police Agency of the Provincial Police continued to issue a decision to prosecute the accused for the crime of fraud and appropriation of property against Ms. Nguyen Thi Thu - Director of Minh Khang Trading Co., Ltd. and Mr. Nguyen Dinh Khang - Head of the Minh Khang Urban Area Project Management Board; then, the decision to prosecute the accused and execute the temporary detention order against the above 2 accused; at the same time, searched the workplace of the 2 accused, seized many related documents and evidence.

Ms. Nguyen Thi Thu (born in 1956), from Hai Duong province, Director of Minh Khang Trading Company Limited, is the legal representative; Mr. Nguyen Dinh Khang (born in 1948), from Hai Duong province, Ms. Thu's husband is the Head of the Minh Khang Urban Area Project Management Board. During the project implementation, Ms. Nguyen Thi Thu and Mr. Nguyen Dinh Khang committed fraud and appropriated people's property.

Regarding the project to build a complex of hotels, supermarkets, pharmaceuticals - medical equipment and housing in Nghi Phu commune (Vinh city), the detailed planning was approved in Decision 521/QD-UBND.DT in 2007, with a total area of ​​7.86 hectares; the west of the project borders Xo Viet Nghe Tinh street, the north borders a 72m wide planned road, the south borders a 30m wide planned road, the east borders Truong Van Linh street. Of which, the construction area is 1.77 hectares (construction density is only about 27%).

Up to 2014, the project of Minh Khang Trading Company Limited has undergone 4 planning adjustments. Specifically, the first planning adjustment was on September 1, 2010, in Decision No. 4283/QD.UBND-XD; the second planning adjustment was on April 13, 2013, in Decision No. 1335/QD.UBND-XD; the third planning adjustment was on April 8, 2014, in Decision No. 1376/QD.UBND-XD; the fourth planning adjustment was on September 24, 2014, in Decision No. 4764/QD.UBND-XD.

Coincidentally, in the planning adjustments, the construction area of ​​public works and social welfare works decreased, while the land area for low-rise housing construction increased. An inspection report pointed out that, compared to the first planning adjustment decision (Decision No. 4283/QD.UBND-XD), to the fourth planning adjustment decision (Decision No. 4764/QD.UBND-XD), the public land area decreased by 15,270 m2, adding 56 more plots of land; bringing the total number of plots of land in this project to 295.

However, Minh Khang Trading Company Limited continued to arbitrarily “adjust” the project, and also in the direction of reducing the construction area of ​​public works and social welfare works to increase the land area for housing construction. Thereby, increasing the total number of residential land lots in this project from 295 to 324 lots.

Recently, Nghe An Newspaper has reported on the tax arrears at Minh Khang Trading Co., Ltd. Since 2018, Minh Khang Trading Co., Ltd. has begun to form a debt for land use fees to the State budget. This is the time when the Provincial People's Committee issued a decision approving the average land price of the land area where Minh Khang Trading Co., Ltd. implemented the project of Hotel Complex, Supermarket for pharmaceutical business, medical equipment and housing in Nghi Phu Commune, Vinh City, with an area of ​​land use fees of 16,554.1m2.2.

On May 30, 2018, the Tax Authority notified Minh Khang Trading Co., Ltd. that the total land use fee payable to the State budget was VND 210,803,962,000. However, up to now, Minh Khang Trading Co., Ltd. has not paid taxes in accordance with the law, resulting in the total tax amount as of November 30, 2022 not yet paid to the State budget reaching more than VND 312 billion.
