ICC asks Libya to hand over Gaddafi's son to trial

(Baonghean.vn) - On Wednesday, December 10, the International Criminal Court (ICC) presented to the United Nations Security Council the case of Libya refusing to hand over Seif Al-Islam Gaddafi, son of Libyan dictator Muammar Gaddafi, to trial.

In their ruling, the ICC judges said that “the Court finds it appropriate to conclude that Libya has failed to comply with the Court’s requests for cooperation and to refer the case to the Security Council.” In referring the case to the United Nations, the ICC judges hoped that the Security Council would “consider appropriate measures that would induce Libya to cooperate with the ICC.”

Currently, Libya and the ICC are competing with each other for the right to try Seif Al-Islam Gaddafi. After the fall of Muammar Gaddafi's dictatorship, Seif Al-Islam Gaddafi was accused of carrying out many bloody suppressions of the rebels in 2011. However, the trial of Seif Al-Islam Gaddafi has not been possible because Seif has been in the hands of rebels in the southwest of Tripoli, since Libya fell into turmoil in November 2011.

Seif Al-Islam Gaddafi, 42, is wanted by the ICC for crimes against humanity. The ICC has repeatedly requested Libya to hand over Seif Al-Islam Gaddafi, but Libya has refused to do so. The ICC believes that Libya cannot give a fair judgment in trying this person.

On Wednesday, the ICC said it “noted that throughout the proceedings Libya demonstrated various aspects of its commitment to the ICC. Libya has made efforts to maintain a constructive dialogue.” The ICC also stated that the ICC’s referral to the Security Council “is not intended to punish or criticize Libya, but to seek the Security Council’s assistance in removing obstacles to cooperation.”
