The Court of Appeal sentenced the defendants in the case of activities aimed at overthrowing the people's government.
Based on the evidence and documents examined at the appeal hearing and the results of the debate at the hearing, on the basis of a full and comprehensive review of the evidence and opinions of the prosecutor, the defendant, and the defense attorney, the Supreme Court of Appeals panel chaired by Judge Nguyen Xuan Khoi determined that Viet Tan is a reactionary organization that uses many different methods and tricks of operation to overthrow the people's government. The defendants in this case have all learned and known about the organization's platform and goals, so the Court of First Instance's trial of the defendants who participated in implementing the programs, plans, and activities of Viet Tan for the crime of activities aimed at overthrowing the people's government is completely legally justified.
At the appeal hearing, most of the defendants confessed honestly, some defendants clearly showed remorse for the crimes they had committed and were conscious of correcting their mistakes. In particular, defendant Le Van Son did not admit to the crime at the investigation agency and the first instance trial, but at the appeal hearing, he honestly confessed all of his wrongdoings, combined with the testimony of witness Nguyen Van Trieu and defendant Nong Hung Anh, so the Trial Panel determined that the defendant committed a crime according to the provisions of Clause 2, Article 79, of the Penal Code, not the provisions of Point 1, Article 79, of the Penal Code as determined by the first instance trial court.

After deliberation, the Appellate Court decided to reduce the sentence for defendant Son and several other defendants to demonstrate the leniency of the law. Specifically: reducing the sentence for defendant Le Van Son from 13 years to 4 years; defendant Nguyen Van Duyet from 4 years to 3 years and 6 months; defendant Nguyen Xuan Anh from 3 years to 2 years; defendant Ho Van Oanh from 3 years to 2 years and 6 months.
Due to the lack of sincerity and the absence of new mitigating circumstances, the Trial Panel upheld the decision of the First Instance Judgment, sentencing the defendants Ho Duc Hoa to 13 years in prison; Nguyen Dinh Cuong to 4 years in prison; Tran Minh Nhat to 4 years in prison; and Thai Van Dung to 4 years in prison.
