(Baonghean) - The Chairman of Nghe An Provincial People's Committee continued to receive a petition from Mr. Vo Huu Sau (authorized by Ms. Vo Thi Thuoc) disagreeing with Decision No. 179/QD-UBND dated January 25, 2013 of the Chairman of Do Luong District People's Committee and Decision No. 1949/QD-UBND.KT dated May 17, 2013 of the Chairman of Nghe An Provincial People's Committee on resolving the land use rights dispute between Ms. Vo Thi Thuoc and Mr. Dinh Van Hanh for the land area of 122.13m2 in Hamlet 4, Nhan Son Commune. After consideration, on August 19, 2014, the Chairman of the Provincial People's Committee issued Official Dispatch No. 1044/UBND.KT to respond and guide Mr. Vo Huu Sau as follows:

The case of Ms. Vo Thi Thuoc's dispute over the right to use an area of 125.13 m2 of land with Mr. Dinh Van Hanh in Hamlet 4, Nhan Son Commune was resolved by the Chairman of the People's Committee of Do Luong District, Decision No. 179/QD-UBND dated January 25, 2013 (first time), but Ms. Vo Thi Thuoc did not agree; the Chairman of the People's Committee of Nghe An Province issued Decision No. 1949/QD-UBND.KT dated May 17, 2013 (second time). Pursuant to Article 264 of the Law on Administrative Procedures (2010) on amending and supplementing a number of articles of the Land Law (2003), the Provincial People's Committee has repeatedly issued documents instructing him to file a complaint with the Minister of Natural Resources and Environment or file a lawsuit at the Administrative Court for resolution in accordance with the provisions of law, but he continues to send petitions requesting the Chairman of the Provincial People's Committee to resolve the dispute. On January 25, 2014, the Provincial People's Committee issued Document No. 557/UBND-KT assigning the Provincial Inspector to establish an interdisciplinary working group to inspect and review a number of cases of citizens' complaints, denunciations, and land disputes, including the case of Mr. Vo Huu Sau requesting to resolve a land use rights dispute (authorized by Ms. Vo Thi Thuoc). Based on the results of the inspection and review by the Provincial Inspectorate, the Provincial People's Committee issued Notice No. 359/TB-UBND.KT dated July 15, 2014 announcing the termination, non-acceptance, and non-reconsideration of the content of the citizen's complaint and denunciation of the dispute under its authority. In which, Mr. Vo Huu Sau (authorized by Ms. Vo Thi Thuoc) was instructed to file a complaint with the Minister of Natural Resources and Environment or file a lawsuit at the Administrative Court for settlement in accordance with the provisions of law.
The Chairman of the Provincial People's Committee once again instructed him that if he did not agree with the Dispute Resolution Decision No. 1949/QD-UBND.KT dated May 17, 2013 of the Chairman of the Nghe An Provincial People's Committee, he should send a complaint to the Minister of Natural Resources and Environment or file a lawsuit at the Administrative Court for settlement in accordance with the provisions of law.
