According to the instructions, regulations on accepting Vietnamese students in the type of educational institutions with foreign investment (FDI) that are allowed to be established and regulations on accepting Vietnamese students require:
General education institutions (primary schools, secondary schools, general schools, multi-level general schools) implementing foreign educational programs, granting foreign diplomas, for foreign students and a part of Vietnamese students in need are allowed to accept Vietnamese students, but the number of Vietnamese students in primary and secondary schools must not exceed 10% of the total number of students in the school, and in high schools must not exceed 20% of the total number of students in the school.
In particular, Vietnamese students under 5 years old are not accepted into foreign programs.
For diplomas and certificates, foreign-invested educational institutions are allowed to grant diplomas and certificates belonging to the Vietnamese national education system and must register in advance with the Ministry of Education and Training and the Ministry of Labor, War Invalids and Social Affairs.
In addition, investment projects to establish preschool education facilities must have a minimum investment rate of 30 million VND/child, similar to general education facilities of 50 million VND/child, short-term training facilities of 20 million VND/student, vocational training centers of 60 million VND/student, vocational secondary schools and colleges of 100 million VND/student, colleges and universities of 150 million VND/student.
According to the leaders of the Ministry of Education and Training, thoroughly grasp and implement Decree 73/2012/ND-CP dated September 26, 2012 of the Government (referred to as Decree 73) to create consistency in the understanding and implementation of state management agencies, investors and educational institutions with foreign investment capital.
In the immediate future, focus on requiring educational institutions with foreign investment capital to implement the transitional provisions (Article 74 of Decree 73). Specifically, the Ministry of Education and Training has sent a document to the People's Committees of provinces and cities requesting them to urgently review and summarize the situation of educational institutions with foreign investment capital in the area; classify educational institutions in the area according to the level of meeting the conditions and criteria specified in Decree 73; request and guide educational institutions with foreign investment capital to implement the transitional provisions, promptly report to the Ministry of Education and Training on any problems for research and resolution.
The Ministry of Education and Training shall consider and provide guidance on issues of principle regarding the attraction and management of foreign investment capital for education; the level of openness to international integration for each type of institution, field and level of education; the coordination mechanism between state management agencies in the process of reviewing and resolving dossiers of investors and educational institutions with foreign investment capital; and consider and handle problems arising in the implementation of Decree No. 73 and related guiding documents.
The Ministry will strengthen coordination and sharing of reporting information between the state management agency on investment and the state management agency on education, regularly organize interdisciplinary inspection teams, and periodically hold meetings to exchange information, reflect and handle problems for investors, and promptly detect and handle violations (if any).
