Prosecution of two defendants for deliberately falsifying documents to mortgage self-driving cars
The Procuracy has issued an indictment to prosecute Do Tra My and Nguyen Minh Tuan for the crime of "Abuse of trust to appropriate property" under the provisions of Article 175, Clause 4 - Penal Code.
The People's Procuracy of Hanoi City has issued an indictment to prosecute two defendants Do Tra My (born in 1995, residing in village 6, Tien Xuan, Thach That district, Hanoi), Nguyen Minh Tuan (born in 1984, residing in group 35, Ngoc Thuy ward, Long Bien district, Hanoi) for the crime of "Abuse of trust to appropriate property" as prescribed in Article 175, Clause 4 - Penal Code.
According to the indictment, in August 2020, Do Tra My became acquainted with Nguyen Van Toan (born in 1990, residing in Dai Thanh, Quoc Oai, Hanoi) because My rented a self-driving car from Toan many times. These times, Toan did not ask My to sign a car rental contract, but My still returned the car and paid the rental fee on time, so Toan trusted her very much.
On November 12, 2020, My called Mr. Toan to rent a self-driving car, white Hyundai Accent brand, license plate 30F - 613.53 from Mr. Toan for work and personal travel at a price of 1.1 million VND/day, paying the car rental fee once every 10 days, if My extended the car rental, she would pay an additional car depreciation fee of 200,000 VND/day.
Mr. Toan agreed, delivered the car to My and did not ask My to deposit money or sign a car rental contract. On November 26, 2020, My paid Mr. Toan 4 million VND for the car rental and asked to owe the remaining amount.
On November 28, 2020, My contacted Mr. Toan, requesting to continue renting the above Hyundai Accent car on a monthly basis for 1.3 million VND/day, My would pay once every 10 days.
Mr. Toan agreed and asked My to sign a car rental contract, but My said that someone from the company where she worked would come to meet Mr. Toan to make the contract and pay the car rental fee.
On December 6, 2020, after Mr. Toan repeatedly urged her to pay the car rental fee, My asked her friend Nguyen Minh Tuan to call Mr. Toan, claiming to be My's manager and delaying a few days to meet Mr. Toan to make a car rental contract and pay the car rental fee.
Next, My saw in the car's trunk a car registration certificate with Toan's name and the car's inspection number, so My had the idea of pawning the car to get money for personal expenses.
My planned to pawn the car for 100 million VND, however, the pawn shop owner required My to provide full documents proving the origin of the car before accepting the pawn. My asked Tuan to verify and Tuan agreed.
Although Tuan knew that the car was not My's property, he helped My write a car sale paper, recorded a video clip confirming that Tuan was the owner of the car, and agreed to let My pawn the car for money as My requested in order to help My complete the car mortgage procedures. The Procuracy determined that Tuan's actions were an accomplice in helping My appropriate Mr. Toan's car.
After the case was discovered, Do Tra My paid Mr. Toan 155 million VND as requested by Mr. Toan, so Mr. Toan did not request civil compensation and filed a petition to reduce My's sentence.
