From January 1, 2018, evading social insurance payments for employees can result in imprisonment.
The revised Law on Social Insurance (SI) consists of 9 chapters and 125 articles and will take effect from January 1, 2018. This law clearly stipulates that if an employer evades paying SI, they will be severely fined and may even be imprisoned.

Accordingly, employers who cheat or use tricks to not pay social insurance, health insurance, and accident insurance for employees or do not pay in full for 6 months or more, in addition to being administratively fined, will also be fined from 50 to 200 million VND, sentenced to non-custodial reform for up to 1 year, or imprisoned from 3 months to 1 year.
The new law also stipulates a fine of VND200-500 million or imprisonment from 6 months to 3 years if the crime falls into one of the following cases: Committing the crime 2 times or more; evading insurance payments of VND300 million to VND1 billion; evading insurance payments for 50 to less than 200 people; not paying the insurance amount collected or deducted from employees; if the legal entity commits the crime, it will be fined from VND500 million to less than VND1 billion.
Fines from 500 million VND to 1 billion VND or imprisonment from 2 to 7 years if committing crimes in the following cases: Evading insurance payment of 1 billion VND or more; evading insurance payment for 200 people or more; not paying the insurance amount collected or deducted from employees...
