Cua Lo Town People's Committee responds to citizen petitions
(Baonghean) - Nghe An Newspaper has Official Dispatch No. 167/PC.BD/BNA dated April 15, 2014 regarding the transfer of the petition of Mr. Nguyen Duc Hoai, Block 6, Nghi Tan Ward, Cua Lo Town with 2 contents:
- Complaint that in 1986, Nghi Tan Commune People's Committee, Nghi Loc District, approved and granted him a plot of land with an area of 250 m2, now in Block 6, Nghi Tan Ward, Cua Lo Town. Right next to this granted plot of land, he reclaimed another plot of land but was only granted the land by the government for the reclaimed plot of land, while the land plot was granted to him by Nghi Tan Commune People's Committee in 1986 by the Town People's Committee... The People's Committee of Cua Lo Town granted it to Mr. Tran Duc Thiet in 2008.
- Accusing a number of officials and party members of Nghi Tan Ward People's Committee of colluding with each other to carry out procedures to grant a land use right certificate to Mr. Tran Duc Thiet for a plot of land with an area of 359.5 m2 to sell for profit (The plot of land, according to Mr. Hoai, belongs to his right to use).
On May 13, 2014, Nghe An Newspaper received Official Dispatch No. 532/UBND-TT from the People's Committee of Cua Lo Town in response as follows:
1. The content of Mr. Nguyen Duc Hoai's complaint was resolved by the People's Committee of Cua Lo Town in Decision on Complaint Resolution No. 50/QD-UBND dated February 28, 2012, which includes the following content:
- Mr. Nguyen Duc Hoai's complaint about the right to use the land, the land plot that in 2008 Nghi Tan Ward People's Committee made a file to grant a land use right certificate to Mr. Tran Duc Thiet originated from the land plot that Nghi Tan Commune People's Committee granted to him in 1986 is a false complaint.
Regarding the dossier of land use right certificate granted to Mr. Tran Duc Thiet at land plot No. 275, map sheet No. 07, area 359.5 m2, according to the land grant documents of the old Cua Lo Town, Mr. Thiet is a household with land grant documents according to Clause 1, Article 50, Land Law 2003; Article 3 of Decision No. 146/2007/QD-UBND dated December 19, 2007 of Nghe An Provincial People's Committee, the land grant area of 250 m2 is not clearly stated as residential land or garden land, so only 200 m2 of residential land and 50 m2 of garden land is granted. Because the current status of the land plot has not been put into use and there is no boundary fence, it is impossible to determine whether the increased area of 109.5 m2 is due to land reclamation. Therefore, the Ward Land Use Rights Registration Council must prepare a dossier to issue a Land Use Rights Certificate in accordance with regulations, requesting the State to recover the area of 105 m2 for management in accordance with the law.
2. Regarding the contents of Mr. Nguyen Duc Hoai's accusation; based on Article 32, Chapter 7, Charter of the Communist Party of Vietnam, on February 11, 2014, the People's Committee of Cua Lo Town issued Official Dispatch No. 72/UBND-TTr transferring the above contents of Mr. Hoai's accusation to the Inspection Committee of Cua Lo Town Party Committee for settlement according to its authority.
