Vinh City People's Committee responded to the petition of Mr. Nguyen Van Luan (Nghi Kim - Vinh City)

(Baonghean) - Vinh City People's Committee received Official Dispatch No. 571 PC/BD/BNA dated November 11, 2014 from Nghe An Newspaper regarding the transfer of the petition of Mr. Nguyen Van Luan, residing in Hamlet 11, Nghi Kim Commune, Vinh City, with the following content:

1. Complaint against Nghi Kim Commune People's Committee for not paying monthly war invalid allowance to him.

2. Accusing Mr. Cao Huy Ty - Chairman of Nghi Kim Commune People's Committee of abusing his position and power while performing official duties.

Regarding the content of the citizen's petition, the City People's Committee has the following opinion:

1. Regarding content 1: The City People's Committee has also received a complaint from Mr. Nguyen Van Luan - permanent resident of Hamlet 11, Nghi Kim Commune. On August 5, 2014, the City People's Committee held a meeting with citizens to clarify the content of the complaint and collect relevant documents and evidence. Through the meeting, the content of Mr. Nguyen Van Luan's complaint was determined, includingwith the content "Complaint about the fact that Nghi Kim Commune People's Committee did not pay the war invalid allowance to Mr. Nguyen Van Luan from January 2010 to June 2012 but deducted the amount of 20 million VND that Mr. Luan had written a loan paper from Nghi Kim Commune People's Committee since the end of 2009. Mr. Luan said that he had only written a loan paper from Nghi Kim Commune People's Committee to Mr. Dang Tho Tuong (at that time, the Chairman of Nghi Kim Commune People's Committee) and had not directly completed the procedures to receive the money at the accountant and treasurer, but Nghi Kim Commune People's Committee still deducted his war invalid allowance, which is against the regulations: Since 2012, he has written a petition to the Chairman of Nghi Kim Commune People's Committee but until now it has not been considered or resolved".

On August 25, 2014, the City People's Committee issued Official Dispatch No. 4027/UBND-TTr assigning the Chairman of Nghi Kim Commune People's Committee to inspect, resolve and respond to Mr. Nguyen Van Luan in accordance with the provisions of law. According to Report No. 222/BC.UBND dated September 9, 2014 of Nghi Kim Commune People's Committee: On September 8, 2014, Nghi Kim Commune People's Committee held a meeting with Mr. Luan. During the meeting, Mr. Luan left without permission, showing disrespect and uncooperativeness in resolving the issue. Nghi Kim Commune People's Committee issued Official Dispatch No. 86/UBND dated September 8, 2014 to respond to Mr. Nguyen Van Luan regarding this issue, as follows:

During the period 2004 - 2006, Mr. Nguyen Van Luan, who was working in the hamlet, violated the use of cash funds of hamlet 11; therefore, on January 22, 2009, the Inspection Committee of Nghi Kim Commune Party Committee reported and proposed disciplinary action against Mr. Nguyen Van Luan and directed the Commune People's Committee to recover the lost financial funds. On February 6, 2009, Nghi Kim Commune Party Committee issued a disciplinary decision against Mr. Nguyen Van Luan.

To remedy the consequences, Mr. Nguyen Van Luan voluntarily asked to pay the lost amount by deducting it from his monthly war invalid allowance. On July 8, 2009, Mr. Nguyen Van Luan voluntarily wrote a request and a loan application to the Party Committee and People's Committee of Nghi Kim commune, presenting and requesting to resolve the matter of his own loss of the collective's money. Due to difficult circumstances and not having enough money to pay the collective, he asked to borrow 20 million VND from Nghi Kim commune People's Committee and asked to pay by gradually deducting it from his war invalid allowance. On that basis, Nghi Kim commune People's Committee approved and created conditions for Mr. Luan to transfer the loan to the commune finance department (The documents showing this are still kept at the commune People's Committee). Therefore, the content of Mr. Nguyen Van Luan's complaint is not true to reality.

Regarding content 2: Accusing Mr. Cao Huy Ty - Chairman of Nghi Kim Commune People's Committee for abusing his position while performing official duties. At the meeting, Mr. Nguyen Van Luan could not provide evidence to prove the content of the accusation he had raised; on the other hand, through the actual work, Mr. Nguyen Van Luan reported a number of incidents that occurred in Nghi Kim Commune. However, the incidents that Mr. Nguyen Van Luan reported were all resolved by the City People's Committee in accordance with the provisions of law.
