Hung Dong Commune People's Committee handles citizens' complaints
On August 3, 2012, the People's Committee of Hung Dong Commune (Vinh City) received Official Dispatch No. 371/PC.BD.BNA dated August 1, 2012 from Nghe An Newspaper, requesting the People's Committee of the Commune to resolve the petition of Mr. An Tuan, son of Mr. An Xuan Truc, residing at No. 101, Dang Thai Mai, Hung Dong Commune, Vinh City, complaining about the unfounded complaint of Mr. Nguyen Van Mui, his neighbor since 2001, and until now his family has had difficulty in declaring and completing procedures for granting a land use right certificate for the land lot assigned since 1991.
(Baonghean) -On August 3, 2012, the People's Committee of Hung Dong Commune (Vinh City) received Official Dispatch No. 371/PC.BD.BNA dated August 1, 2012 from Nghe An Newspaper, requesting the People's Committee of the Commune to resolve the petition of Mr. An Tuan, son of Mr. An Xuan Truc, residing at No. 101, Dang Thai Mai, Hung Dong Commune, Vinh City, complaining about the unfounded complaint of Mr. Nguyen Van Mui, his neighbor since 2001, and until now his family has had difficulty in declaring and completing procedures for granting a land use right certificate for the land lot assigned since 1991.
On August 9, 2012, the People's Reception Office of Hung Dong Commune People's Committee sent a representative of the People's Reception Council to meet and have a direct dialogue with Mr. An Tuan. Through direct dialogue and verification of relevant documents, on August 29, 2012, the People's Committee of Hung Dong Commune issued Official Dispatch No. 267/UBND-TD to Nghe An Newspaper as follows:
Mr. An Xuan Truc's land plot was granted by the People's Committee of Dong Vinh commune (now Hung Dong commune) in 1991. The commune's land grant file includes a land grant application, a notice from the People's Committee of the commune, a map of the granted location, and a receipt. However, Mr. Truc's file only has a notice and a receipt, without a map or a land grant application, so there is not enough basis to determine whether Mr. Truc was granted land or not and at what location.
In 2011, the Department of Natural Resources and Environment of Nghe An province contracted with a surveying unit and established technical records for each household. The family was responsible for marking the boundary so that the surveying team could measure and establish records, but for unknown reasons, Mr. Truc's household did not have records handed over to the Commune People's Committee. Currently, Mr. Truc and Mr. Tuan have submitted petitions to many places, and have been fully answered by representatives of the Commune People's Reception Council and concluded:
- Mr. Tuan's family is not a policy family.
- Mr. Tuan's petition that the People's Committee of Hung Dong commune had measured and drawn the technical documents of his land plot but did not hand it over to him and that the People's Committee of the commune had organized the forced eviction of his house, but because they knew that his family had 2 children who were on leave from the army, they did not dare to carry out their intention was baseless. Mr. Tuan fabricated these two contents and slandered the local government.
- After being directly and fully explained and answered, Mr. Truc's family needs to be granted a land use right certificate, then they should file a complaint to the agencies where Mr. Truc and Mr. Tuan sent their applications, and at the same time file a request for the competent authority to measure and draw the technical records of the land plot, provide complete records of the 1991 Dong Vinh commune granting land to his family and file a dossier to the People's Committee of Hung Dong commune for settlement according to the provisions of law.
