The National Assembly Standing Committee discussed the draft revised Land Law.
The draft Land Law (amended) includes 14 chapters and 190 articles, an increase of 6 chapters and 44 articles compared to the current Land Law.
On September 17, the National Assembly Standing Committee continued its 11th session, giving opinions on the draft Land Law (amended). National Assembly Chairman Nguyen Sinh Hung attended the meeting.
The draft Land Law (amended) consists of 14 chapters and 190 articles, an increase of 6 chapters and 44 articles compared to the current Land Law. The draft Law stipulates that land use planning and plans must be made at 3 levels: national, provincial and district levels to overcome the lack of connectivity and synchronization in planning between provinces and regions, while saving costs and shortening the time for land use planning, especially at the commune level.

However, according to Mr. Phung Quoc Hien, Chairman of the Finance and Budget Committee: Commune-level land use planning is a detailed planning to serve land management. Therefore, if planning is only at 3 levels as stipulated in the draft Law, it will easily lead to a situation of "suspended" planning, causing waste of land resources and hindering development.
The majority of members of the National Assembly Standing Committee agreed with the regulation that the term of agricultural land allocation to households and individuals is 50 years, regardless of whether the land is for annual crops or perennial crops. Extending the land use term to 50 years will overcome the inequality between the land use terms of farmers and enterprises, making farmers more attached to their fields, feel secure in investing in production, and improving land use efficiency.
Agreeing with the transfer of land use rights to households, Vice Chairman of the National Assembly Uong Chu Luu said that there should be no land use limit but only land should be leased back to those who need to use the land. “I agree with this point because the current reality in agricultural production is still small-scale, scattered production because the land use limit is very limited. We have not allowed the policy of land accumulation to have large-scale production. And in fact, we have applied large-scale fields in many localities. Of course, the mechanism is different, but it is also in the direction of large-scale production, applying science and technology, so it is clear that the efficiency is great. Here, there are people who have the conditions to produce on such a large scale but the area is too limited. So I agree with the policy of land accumulation and expanding the land use limit. Of course, here we must ensure the rights of farmers”.
Regarding land prices, Ms. Nguyen Thi Nuong, Head of the Delegation Work Committee, said: Currently, we regulate many types of prices: state prices, market prices, investor prices... However, land recovery for economic development is not specifically regulated in the Constitution. Ms. Nuong said that this issue creates major conflicts, so there needs to be stricter regulations on the grounds for land recovery to develop economic projects.
Concluding the session, Vice Chairwoman of the National Assembly Nguyen Thi Kim Ngan requested the drafting agency to proactively grasp the policy of amending the 1992 Constitution to design the provisions of the draft Law in accordance with the (amended) Constitution and still maintain the progress and time of passing the draft Law, meeting the requirements and aspirations of voters nationwide.
