New Government document on further improving the quality of institutional and legal building work
The Prime Minister has just signed Document No. 301/TTg-PL dated April 6, 2022 requesting ministries, branches and localities to further improve the quality of institutional and legal development and improvement. Ministers and Provincial People's Committee Chairmen must directly lead and be responsible for this work.
Institutional building and improvement has always been identified by the Party and State as a key task, one of the three strategic breakthroughs, creating a legal basis and a safe and favorable environment for the country's socio-economic development. Right from the first meeting to deploy the Government's work after being reorganized at the 2nd Session of the 14th National Assembly, the Government identified institutional building as one of the key tasks that need to be focused on and directed. Since then, the Government has held 06 meetings and issued 06 specialized Resolutions on law-making. Notably, on September 16, 2021, the Prime Minister chaired the Government's National Conference on institutional building and improvement.

To further improve the quality of institutional and legal development, the Prime Minister requests Ministers and Heads of ministerial-level agencies to directly lead and be responsible for institutional and legal development of their ministries and ministerial-level agencies; directly direct the development of projects and draft legal documents in their assigned fields to submit to competent agencies or issue under their authority; and be personally responsible to the Government and the Prime Minister for the progress and quality of projects and draft legal documents.
At the same time, regularly direct the review, assessment and summary of the organization of law enforcement, in order to detect difficulties, obstacles, causing difficulties, hindering investment and business activities of enterprises as well as people's lives, newly arising issues that need to be adjusted to promptly amend, supplement or propose competent authorities to amend to suit the practical situation.
Monthly statistics of projects and drafts that are behind schedule, do not fully follow procedures and processes, and are of poor quality
The Prime Minister noted that in the process of developing projects and draft legal documents, it is necessary to strictly comply with the regulations and procedures of the Law on Promulgation of Legal Documents, especially: strengthening discipline and administrative discipline, ensuring the correct implementation of the progress and programs set out, especially the draft laws, ordinances and resolutions in the programs of the National Assembly and the National Assembly Standing Committee; closely following reality, taking reality as a measure, listening to multi-dimensional opinions, organizing seminars, discussions, consulting opinions, especially the opinions of experts, scientists, practitioners, and affected subjects; closely coordinating with agencies of the Party, the National Assembly and other relevant agencies; Strengthening social criticism of the Fatherland Front and its member organizations, strengthening communication work to promptly inform policies, aiming to improve the quality of documents as well as social consensus in building and promulgating policies and laws.
Ministers and heads of ministerial-level agencies continue to lead and direct the strict implementation of tasks and solutions set out in the Government's specialized Resolutions on law-making in recent times, Directive No. 43/CT-TTg dated December 11, 2020 of the Prime Minister on improving the quality of work on building and perfecting the legal system and enhancing the effectiveness of law enforcement and the Prime Minister's Conclusion at the Government's Conference on institution-building and perfecting work on September 16, 2021.
The Minister of Justice is responsible for monitoring and urging the work of building institutions and laws in ministries and ministerial-level agencies; presiding over and coordinating with the Government Office to submit monthly reports to the Government at regular meetings on the progress and quality of preparation of projects and draft legal documents, especially projects under the Law and Ordinance Development Program of the National Assembly and the National Assembly Standing Committee; compiling statistics on projects and drafts that are behind schedule, do not fully comply with processes and procedures, are of poor quality, and proposing solutions. Ministers and heads of ministerial-level agencies who allow the above situation to occur must review their responsibilities before the Government.
Regularly review and evaluate local law enforcement practices.
The Prime Minister requested the Chairmen of the People's Committees of provinces and centrally-run cities to directly lead and be responsible for local law-making work; regularly direct the review and assessment of local law enforcement practices, and promptly recommend competent state agencies to issue legal documents to handle issues that are no longer appropriate or new issues arising in practice.
The Chairmen of the People's Committees of provinces and centrally run cities directly direct the development and promulgation of legal documents under their authority as well as organize research and provide comments on projects and draft legal documents of central agencies in accordance with the provisions of the Law on Promulgation of Legal Documents./.
