Regarding compensation for land acquisition for the Yen Thanh town export garment factory project

Over 70 households in Hamlet 4, Yen Thanh town whose agricultural land is subject to the project's recovery have received compensation. However, up to now, there are still 2 households: Ms. Dang Thi Lan and Nguyen Thi Hieu who have not accepted the compensation price...
According to Ms. Dang Thi Lan's reflection: "During the process of land compensation and recovery, my family had an area of 710m2. Mr. Phan Van Hung - the village chief asked to sign to separate the rice field into 2 files (one file with an area of 347m2, one file with an area of 363m2), because it belonged to 2 projects. After signing the files, the family was paid 73,400,000 VND, a partial payment (garment factory project). But then some other families were invited to receive money later (belonging to the rescue road project) without my family being informed. Ms. Nguyen Thi Hieu also did not agree with the compensation price of 67,500,000 VND/500m2 according to the calculation of Yen Thanh District People's Committee.
The area for implementing the export garment factory project in Yen Thanh town is in the process of site clearance.
Regarding the opinions of the two households that have not accepted the compensation, the People's Committee of Yen Thanh district stated that, for Ms. Lan's household, the land plot that her family is cultivating is currently in dispute over the subject of land reclamation between the hamlet and Ms. Lan. In order to have a basis to resolve the dispute over the subject, the Chairman of the District People's Committee assigned the Chairman of the Town People's Committee to organize a meeting of hamlet cadres from 1989 to present and representatives of the Association of the Elderly together with Ms. Lan to confirm the subject of land reclamation. On that basis, ask for the appraisal opinion of the Party cell of hamlet 4. From the appraisal opinion of the Party cell, proceed to widely collect opinions of all the people of hamlet 4 through public and democratic discussion. Then vote or vote by secret ballot to confirm the subject of land reclamation, report to the Chairman of the District People's Committee.
Regarding Ms. Nguyen Thi Hieu's opinion, through verification and inspection, it is shown that the price of agricultural land from 2010 to present in Yen Thanh town issued by the Provincial People's Committee annually is 45,000 VND/m2. In the past 3 years, the land clearance dossiers have been approved by all households in the district. In the town from 2010 to 2012, many projects were implemented (some projects were implemented before, some projects were implemented after the garment factory project) and all were accepted by households. Therefore, based on the provisions at Point a, Clause 1, Article 56, Land Law 2003; Clause 1, Article 8, Decision No. 04/2010 dated January 19, 2010 of Nghe An Provincial People's Committee promulgating regulations on compensation, support and resettlement when the State acquires land in Nghe An province, the District People's Committee's failure to report to the Provincial People's Committee to consider adjusting land prices for plots of land acquired to implement the project of building an export garment factory in Yen Thanh town is in accordance with the law.
Mr. Nguyen Duc Thien - Head of the Department of Natural Resources and Environment of Yen Thanh district said: The district People's Committee has applied the land compensation price according to the price prescribed in Decision No. 77/2011/QD-UBND dated December 29, 2011 of the Provincial People's Committee at 45,000 VND/m2 and the money for career conversion and job creation support is twice the land price according to the regulations in Article 26, Decision No. 04/2010/QD-UBND dated January 19, 2010 of the Provincial People's Committee at 90,000 VND/m2, which is in accordance with the regulations.
This incident shows that there are still some shortcomings in the compensation implementation method of Yen Thanh District People's Committee, including the need to review the Department of Natural Resources and Environment for advising the District People's Committee to issue a decision to establish a Compensation and Site Clearance Council for the project to build an export garment factory in Yen Thanh Town, which lacks representatives of households and individuals whose land is recovered. Similarly, the Compensation and Site Clearance Council does not publicly post the compensation and support plan at the Town People's Committee headquarters and at the residential areas of people whose land is recovered. Regarding the dispute over reclaimed land between Ms. Dang Thi Lan's household and the hamlet, Yen Thanh District needs to promptly resolve it to avoid prolonged complaints.
