The fake director of the "ghost" company

The defendant's job was only to sign economic contracts under the direction of Mr. Tuan. Whenever he told me to sign, I would sign. I had no idea about the money, the receipts and payments, the imports and exports.” Standing in the dock, defendant Hoang Van Nang firmly defended his actions.
After a week of deliberation, on the afternoon of April 8, the People's Court of Nghe An province continued to bring the case of "fraudulent appropriation of property" against Vi Thanh Tuan (58 years old, residing in Lang Son city, Lang Son province) and Hoang Van Nang (born in 1981, residing in Mong Cai city, Quang Ninh province) to trial.

The case file clearly states that, with the intention of appropriating another company's assets, on May 28, 2011, Vi Thanh Tuan established Thien Ha Import-Export Joint Stock Company (headquartered at 479 Hung Vuong, Lang Son City, Lang Son Province) specializing in trading agricultural products and food. Tuan is the chairman of the board of directors and director of the company. Tuan hired Hoang Van Nang as deputy director.
During the period from May 2011 to September 2012, Thien Ha Import-Export Joint Stock Company registered to change its charter capital from 3 billion VND to 5.5 billion VND 3 times. However, in reality, the shares contributed by shareholders were only shown on paper (virtual money). After the third change in charter capital, Tuan assigned the position of company director to Nang.
At the time Hoang Van Nang was the director, Thien Ha Import-Export Joint Stock Company had no assets, no working capital, no goods, but Tuan still directed Nang to sign a contract to sell 1,000 tons of cassava starch to Vietnam-Laos Economic Cooperation Joint Stock Company and to buy 1,000 tons of cassava starch from Binh Dinh Vegetable Oil Company.
After receiving money and goods from the two partners, Tuan instructed Nang and Ly Van Mao (sales staff of the company) to withdraw 20 billion 782 million VND (money appropriated from the two companies) and transfer it to Dinh Thi Thao (53 years old, Tuan's wife). After the incident was discovered, Dinh Thi Thao fled the area.
According to the investigation, the company Thien Ha established is actually a "ghost" company with no investment capital and no goods. During the capital recovery process, Thien Ha paid Binh Dinh Vegetable Oil Company 3 billion VND and paid Vietnam - Laos Economic Cooperation Joint Stock Company 442 million VND. Thus, the total amount of money Tuan and Nang appropriated was 16 billion 94 million VND.
As for Hoang Van Nang, the defendant has always denied his criminal acts. Accordingly, Nang was from Ha Nam province and followed his family to Da Tel district (Lam Dong) to work in the new economic zone. At the age of 20, Nang followed his friends to Mong Cai border gate (Quang Ninh), working as a security guard and learning Chinese to fulfill his long-cherished dream of working abroad.
In 2010, during a trip, Tuan and Nang met. Realizing that Nang could speak Chinese, Tuan approached her to get to know her. In early 2011, Tuan personally went to Nang's workplace to invite Nang to become the company's deputy director with a salary of 3 million VND/month. "The defendant's job was just to improve his Chinese, dress properly, and sit at his desk every day to wait for Tuan's orders. Whenever Mr. Tuan asked him to sign documents or files, he would sign. Only when he was arrested by the authorities did he realize he had committed a crime. Mr. Tuan took advantage of him and branded him to commit fraud. The company where the defendant was the director was a "ghost" company."
Standing in the dock, Vi Thanh Tuan did not admit his fraud and appropriation, but accepted to pay alone the amount of money that, according to defendant Tuan, he still "owed" to the two companies above.
After reviewing the details of the case, the panel of judges finally sentenced the defendants Vi Thanh Tuan to 15 years in prison for “fraudulent appropriation of property” and Hoang Van Nang to 7 years in prison. At the same time, Tuan was forced to compensate the amount of 16 billion 94 million VND that he had appropriated from the two companies.
