Why are mortgaged cars refused to be inspected?

According to the instructions of the Vietnam Register, cars mortgaged to banks must have full documents according to a separate form.

Representatives of some vehicle inspection centers in Hanoi said that they often receive questions from car owners who are mortgaged to banks about the fact that even though they have full copies of the vehicle registration and the certificate confirming that the vehicle is mortgaged to the bank, they are still refused to accept the vehicle inspection.

Mr. Nguyen Minh Hai - Director of Inspection Center 29 - 03S said that there are currently separate regulations for inspection procedures for vehicles mortgaged to banks and credit institutions. Accordingly, the inspection unit is only allowed to accept vehicles mortgaged to banks with a copy of the registration certificate certified by a competent authority, and a mortgage receipt from the bank with full content according to the general form.

However, in reality, many banks only provide car owners with a copy of the registration stamped by the bank itself, while the content of the mortgage receipt is different in each place, lacking content according to the guidance documents of the Vietnam Register and the State Bank of Vietnam.

Mr. Ngo Hong He - Head of the Department of Motor Vehicle Inspection of the Vietnam Register said that the inspection centers that refuse vehicles with missing documents as above are in compliance with the instructions. In case of vehicles mortgaged to a bank, when carrying out inspection procedures, they must present a copy of the vehicle registration issued by the certifying agency and a mortgage receipt (issued by the bank or credit institution).

The receipt must contain at least the following information: Name (mortgage receipt), receipt number; Name and address of the credit institution receiving the mortgage; Name of the mortgagor, ID card number (or ID card, for individuals) or investment certificate, establishment decision number (for legal entities); Vehicle registration certificate number, vehicle type, chassis number, engine number, license plate number; Validity period of the receipt; Receipt re-issue number (if re-issued). The mortgage receipt must have sufficient signatures, full name of the authorized officer and seal of the credit institution receiving the mortgage.

“In case of refusal to inspect the vehicle for the above reason, the vehicle owner shall contact the bank or credit institution accepting the mortgage to request reissuance of the above documents in accordance with the correct form. Document No. 700 dated July 31, 2018 of the State Bank of Vietnam clearly states that the credit institution accepting the mortgage is responsible for providing the above documents to the vehicle owner,” said the leader of the Motor Vehicle Inspection Department.

According to the provisions of Decree 23/2015 of the Government on issuing copies from original books, certifying copies from originals, and authentication, the Department of Justice (under the People's Committee at district level) and the People's Committee at commune level have the authority to certify copies that are true to the original.
