Nghe An Provincial People's Procuracy: 55 years of construction and development

(Baonghean) - 55 years ago, on July 26, 1960, President Ho Chi Minh signed the Decree promulgating the Law on the Organization of the People's Procuracy (VKSND), marking the birth of the VKSND - a new system of agencies in our State apparatus. On that basis, the People's Procuracy of Nghe An province was established under Decision No. 01 dated January 1, 1961 of the Chief Justice of the Supreme People's Procuracy. Over 55 years of construction and development, generations of cadres and prosecutors of the Nghe An Procuracy have overcome all difficulties and challenges, successfully completing the political tasks assigned by the Party and the State.

From the early days of its establishment with many shortages to the evacuation situation during the war, both building the industry and contributing to the resistance war against the US; from the days of joining the province with a lot of work to rearrange the organization and operational structure to the days of separating the province with many challenges of the renovation cause and the requirements of the current judicial reform. After 15 years of merging (1976 - 1991), Nghe Tinh province was divided into 2 provinces: Nghe An and Ha Tinh. Also during this time, Nghe An Provincial People's Procuracy has implemented renovation, taken many positive measures, effectively contributing to the fight against crime and law violations; strengthening the socialist legal system in the area.

In terms of the inspection of compliance with the law in the administrative, economic and social fields (general inspection), implementing unified direction in the sector, the two-level Procuracy of Nghe An province has conducted hundreds of inspections in key economic sectors. Through the inspection work, many major violations of a widespread nature have been discovered, and many sectors have issued many protests and recommendations to the People's Committees at all levels and sectors, requesting criminal measures, civil prosecution or administrative handling of violators; especially issuing many reports to the Party Committees to strengthen the direction of State management in many fields. The two-level Procuracy has issued hundreds of protests and recommendations to the People's Committees at all levels and sectors, and many reports to the Party Committees to strengthen leadership; 500 violators have been discovered, 43 cases and 147 defendants have been prosecuted, and hundreds of people have been requested to be administratively handled; request to recover tens of billions of dong for the State.

Regarding criminal work, the People's Procuracy at both levels has thoroughly grasped the criminal policies of the Party and the State; the provisions of the Penal Code, the Criminal Procedure Code; coordinated with the Public Security Agency and the Court to handle tens of thousands of criminal cases. Focused on solving typical and serious cases related to public order and security, fighting to prevent and reduce crimes with increasing trends such as rape, child rape, drug-related crimes, resisting law enforcement officers, and property infringement. Carrying out the task of investigating and supervising from the beginning, through the activities of supervising to ensure comprehensive and objective investigation, handling the right people and the right crimes. The People's Procuracy of Nghe An province has directed both levels to properly, fully and well perform the functions and tasks of the sector as prescribed in the Law on the Organization of the People's Procuracy; ensuring that temporary detention and temporary imprisonment are in accordance with the law, preventing cases of injustice in this field; At the same time, he participated in over 80% of the first-instance civil cases that the Court tried, thereby having a positive impact on the Court's case preparation; regularly and comprehensively inspected the places of detention of the police agency...

The year 2001 marked an important adjustment in the implementation of the functions and tasks of the sector. The 1992 Constitution (amended) and the 2002 Law on the Organization of the People's Procuracy stipulate that the People's Procuracy performs the function of practicing the right to prosecute and supervise judicial activities, and no longer performs the function of supervising compliance with the law in the administrative, economic and social fields. Together with the whole sector, the People's Procuracy of Nghe An province thoroughly grasped and strictly implemented the provisions of the law on changing the scope of functions, tasks and areas of work of the People's Procuracy of Nghe An province in recent years, and has made significant progress, especially in the practice of the right to prosecute and supervise judicial activities. In the criminal field, the People's Procuracy at two levels has made many "breakthrough" innovations to effectively implement the requirement of strengthening the responsibility of prosecution in investigation activities, linking prosecution with investigation activities; focusing on measures to prevent wrongful convictions or omissions of criminals and criminals.

The units closely coordinate with functional agencies to effectively carry out the work of inspecting reports. The leaders of the Provincial People's Procuracy direct the units of the Criminal Procedure Code and the Investigation Police Department to raise awareness, responsibility, and initiative in studying records; be cautious and resolute in approving or not approving procedural orders and decisions; ensure that procedural decisions of the People's Procuracy are well-founded and in accordance with the law. Coordinate with the agencies conducting the proceedings to speed up the settlement of cases, especially complicated and prolonged cases, corruption cases, and cases that the Party Committee has put under its direction. Strengthen the identification of key cases and shortened cases to focus on solving them, promptly respond to the situation and local political tasks. Coordinate well with the Court to organize hundreds of experience-sharing sessions, and try thousands of mobile cases to propagate, disseminate, and educate people about law compliance. Therefore, although nearly 2,800 criminal cases are handled annually, there has not been a single case of injustice.

The two-level Procuracy has also proactively and closely monitored the work of temporary detention and temporary imprisonment; the work of enforcing civil and criminal judgments, thereby promptly making recommendations and protests against violations, requiring relevant agencies to rectify and overcome them, ensuring strict compliance with the law in these activities. The two-level Procuracy has paid attention to improving the quality of the work of supervising the settlement of civil, administrative, commercial and labor cases, and has issued hundreds of protests that have been approved by the appellate court. The work of handling complaints and denunciations under its authority and supervising the settlement of complaints and denunciations about judicial activities has been well implemented.

The Law on Organization of the People's Procuracy was passed by the National Assembly on November 24, 2014 (effective from June 1, 2015). The Provincial People's Procuracy promptly organized to disseminate and seriously implement the directives and resolutions of the Party and the National Assembly. Leaders, cadres and prosecutors at both levels continued to strive to complete and exceed 4/4 basic targets and political tasks stated in Resolution 37/QH13 and Resolution 63/QH13 of the National Assembly on judicial work; in which the Nghe An Procuracy has achieved many outstanding achievements such as: the work of participating in institution building and judicial administrative reform has achieved many positive results; the role and responsibility of prosecution have many clear changes; the work of supervising judicial activities has been strengthened; the work of building the Party and the industry has many innovations. These are important results that create the premise for the unit to have strong development in the next stage.

Along with effectively performing its functions and tasks; Nghe An Procuracy always takes care of building a team of cadres to ensure the requirements of "Politically strong, professionally skilled, well-versed in the law; impartial and courageous, disciplined and responsible", worthy of Uncle Ho's teachings "Procuracy cadres must be: Fair, Upright, Objective, Cautious and Modest".

Up to now, the Provincial People's Procuracy has 21 district-level People's Procuracy units and 13 professional departments. The total number of employees of the whole sector is 336 people and 61 cases under contract 68; of which 100% of the staff working in the prosecution have a Bachelor of Law degree, 16 have a Master of Law degree; 45 comrades have a high level of political theory. The two-level Procuracy has a relatively complete system of facilities with solid, spacious headquarters, modern architecture, and quite complete and comprehensive equipment for work and living. The regime and life of the staff are increasingly progressive and improved.

In addition, the People's Procuracy of Nghe An province is also a unit that has achieved many outstanding results in information and propaganda activities; participation in law-making; application of IT index; and a number of international cooperation activities. Currently, the sector has its own electronic news page on the Provincial People's Committee's Information Portal, with hundreds of news and articles each year and attracting tens of millions of visitors; has completed and operated well the online conference transmission system at the Provincial People's Procuracy to 21 connecting points of 21 district-level units to bring information technology deeper into the management and direction of the leaders of the People's Procuracy at two levels. At the same time, according to the decentralized tasks, the People's Procuracy of Nghe An has signed many Memorandums of Understanding with the People's Procuracy of Xieng Khouang province (Lao PDR) on cooperation in fighting and preventing crimes on the border of the two provinces and successfully organized the "Vietnam - Laos Solidarity and Friendship Year 2012" in Nghe An.

With the efforts and achievements in 55 years of construction and development, Nghe An Provincial People's Procuracy has been awarded many noble titles by the Party, the State and the Procuracy sector: in 2002, the President awarded the Third Class Independence Medal; from 2003 to 2014, for 12 consecutive years, the Provincial People's Procuracy was recognized as an "Excellent Labor Collective", including 4 times being awarded the Emulation Flag of the Procuracy sector, 3 times being awarded the Emulation Flag of the Government and it was an honor and pride that in 2015, the unit was awarded the Second Class Independence Medal by the President. In addition to the above titles, many collectives and individuals were awarded other noble titles by the Prime Minister, the Chief Justice of the Supreme People's Procuracy, the Provincial People's Committee...
