Going to Hien Son commune, meeting households who bought land previously sold by the commune, everyone complained about the difficulties. Mr. Le Van Hoi, residing in Hoa Tho hamlet, said: “In 1997, my father, Le Van Coc, applied to buy land for my wife and I to live separately, with a confirmation paper from the hamlet, and paid money with the reason of buying a total garden land of 1,500,000 VND, and there is still an invoice with the signature of the accountant at that time. However, until now, the family has not been granted a red book. Therefore, although the house is still being built, it cannot be mortgaged to borrow money from the bank. Mr. Hoi added: “My house is currently under construction, lacking money to complete but does not have a red book to mortgage to the bank to borrow money, not to mention needing money to buy buffaloes and cows to raise and develop production, so it is very difficult”. Mr. Tran Dang Tuong in Hoa Long hamlet, said: On July 15, 1999, he went to the commune to pay for the land. Mr. Nguyen Chuong Huynh, who was then the chairman of the commune People's Committee, personally wrote a receipt, signed, and received the money. He was sure that the money for the land purchase had been paid. into the budget, he left and since then, his family has continued to use the above land plot. However, he has repeatedly gone to the commune to request procedures for granting a land use right certificate but has not been granted...
It is known that in Hien Son commune, the situation like Mr. Hoi and Mr. Tuong is not uncommon. Because in the period of 1994 - 1999, the leaders of Hien Son commune sold nearly 300 plots of land without authority. The households that bought the land all paid money, with receipts that were either stamped or not. For nearly 20 years now, hundreds of households have used and built houses on the plots of land sold by the People's Committee of Hien Son commune but have not been granted land use right certificates and of course, they cannot transfer or mortgage them to borrow from banks for economic development. After the issuance of land use right certificates for hundreds of households could not be carried out, the people wrote complaints and denunciations. After that, the Inspectorate of the People's Committee of Do Luong district and the Provincial Inspectorate got involved. In the Notice of the Provincial People's Committee No. 143 TB/UB.KT, dated May 24, 2001, regarding the settlement of the petition of citizens of Hien Son commune, it was stated that "...In 5 years (1994 - 1999), 275 land plots were sold without authority. The land fee collected without paying to the treasury according to the regime was: 554,146,000 VND. This responsibility belongs to the collective leadership of Hien Son commune, but the main responsibility belongs to the chairman of the commune People's Committee, the commune land officer, and the commune budget accountant".
After the announcement of the conclusion, the relevant officials received appropriate disciplinary action, but the people were still the ones who suffered the most. Mr. Nguyen Dinh Cong, a current cadastral officer of Hien Son commune, said: Many households, although having paid money to the commune officials, had not yet been paid into the budget or had not received a stamp on the receipt, so they could not complete the procedures for granting land use right certificates. Furthermore, in 2000, a fire occurred in the locality, causing all previously kept records and books to disappear. Many households could not keep the original documents, so it was difficult to complete the procedures for granting land use right certificates.
Mr. Tran Dang Tuan - Vice Chairman of Hien Son Commune People's Committee, added: In the face of the consequences, not only are the people facing difficulties, but the government is also facing difficulties. Currently, the commune has announced to review and organize the declaration of previous cases of illegal land purchase, the result is that currently 228 households have declared and registered land use rights at the commune People's Committee. The commune has sent this list to the district People's Committee and the Department of Natural Resources and Environment to request handling instructions.
The unauthorized sale of land in Hien Son is a lesson for localities in land management. The current problem is that the People's Committee of Do Luong district needs to intervene soon, find a reasonable solution for each specific case, and avoid prolonged complaints.
