At exactly 8:30 a.m. on May 23, the Hanoi People's Court entered the fourth trial of the case of Nguyen Duc Kien and his accomplices. Huynh Thi Huyen Nhu's younger sister answered questions about the policy of entrusting deposits at VietinBank.

Responding to this issue, defendant Ly Xuan Hai (former General Director of ACB Bank) said: The minutes of the 2010 meeting of the Board of Directors of ACB Bank assigned me to supervise and monitor the credit activities of ACB Bank. The implementation of the deposit entrustment was carried out by ACB Bank Chief Accountant Nguyen Van Hoa.

After the Board of Directors passed the resolution, Chief Accountant Nguyen Van Hoa directed the staff of ACB Bank to implement the deposit entrustment. When the Board of Directors' resolution took effect, Chief Accountant Nguyen Van Hoa implemented the entrustment policy. I am the General Director of ACB Bank, but I did not check, urge, or listen to daily reports on the deposit entrustment policy. In addition, the Chief Accountant is not obliged to report to me, but to the Board of Directors of ACB Bank.

Regarding this issue, Chief Accountant Nguyen Van Hoa said that after the Board of Directors directed the implementation of the deposit entrustment resolution, I was the one who directly signed the entrustment contracts. In addition, 19 ACB employees who were entrusted also had the right to transact, negotiate and represent the bank to sign. Every day, I have a document to count the quantity, how much profit, what percentage of commission and report to General Director Ly Xuan Hai.

According to the Chief Accountant of ACB Bank, the person who directly contacts the Industrial and Commercial Bank of Vietnam Nha Be Branch (VietinBank Nha Be) is Huynh Thi Bao Ngoc - Deputy Head of Fund Management Department of ACB Bank. Mr. Hoa himself is the person who executes the orders of the Board of Directors, then directs the staff to carry out the deposit entrustment. Mr. Nguyen Van Hoa gives full authority to Huynh Thi Bao Ngoc to contact banks to conduct deposit entrustment transactions, including VietinBank Nha Be.

Regarding the information that the Chief Accountant of ACB Bank answered the interrogation, Ms. Huynh Thi Bao Ngoc said: Huynh Thi Huyen Nhu is my biological sister. I was also the person who directly contacted Ms. Huynh Thi Huyen Nhu to carry out the transaction and the deposit entrustment agreement, after being assigned the task by Mr. Hoa. When I called VietinBank, the bank's switchboard introduced me to meet Ms. Huynh Thi Huyen Nhu. I was the one who met and transacted the deposit interest rate with Ms. Huynh Thi Huyen Nhu, but Ms. Huyen Nhu did not sign the contract but entrusted someone else.

After agreeing on the interest rate with Huynh Thi Huyen Nhu, Huynh Thi Bao Ngoc asked 19 employees entrusted by ACB to contact Viettin Bank to provide account opening information. After having an account at VietinBank, the Accounting Department of ACB Bank will deposit money directly into that account. Before contacting Huynh Thi Huyen Nhu, all 19 individuals entrusted did not have an account at VietinBank.

Before Huynh Thi Bao Ngoc’s testimony, the Trial Panel read the minutes of the investigation agency regarding the taking of statements from ACB Bank employees who were entrusted with the deposit. Accordingly, these employees all affirmed that Huynh Thi Bao Ngoc was the one who directed the employees to contact VietinBank to open an account and carry out the steps of entrusting the deposit.

To clarify this issue, the Trial Panel requested an employee who performed the deposit entrustment to answer the interrogation. According to this representative, Huynh Thi Bao Ngoc was the one who asked the employee to meet Huynh Thi Huyen Nhu to open an account and carry out the steps to entrust the deposit at VietinBank. The entrustee is the person who directly provides the account opening information and must go to VietinBank to sign the deposit documents.
