In 2006, Mr. Ngo Tri Ho, from the same hamlet, came to ask to buy it back to set up a farm, but his family did not agree, so Mr. Ho took another piece of land to exchange. Because he was gullible, Mr. Cuc only made a verbal agreement, without any documents. A year later, Mr. Hoang Van Dam, also residing in hamlet 7, came to claim the field, at this time Mr. Cuc just knew that this was the field that Mr. Ho borrowed from Mr. Dam and had to return it. Meanwhile, Mr. Ho still refused to return his 250 m2 of rice fields. Similarly, Mr. Nguyen Huu Ba's family, residing in hamlet 7, lent Mr. Ho 250 m2 of land for the purpose of raising fish since 2006 with the promise to return it by 2012. However, at the end of 2012, when Mr. Ba came to ask, Mr. Ho just mumbled and refused to return the land. Mr. Ba was upset: "I kept asking for it but it was not returned. Mr. Ho showed me another plot of land belonging to his brother and said he would return that plot of land to my family, but there was no red book, and I could not do the conversion procedure, so I did not agree..."

Regarding the complaints of the households, the area that Mr. Ho borrowed from the households and refused to return was also legalized by the People's Committees at all levels in Do Luong district to issue a Land Use Right Certificate to Mr. Ho. In fact, it is known that after borrowing land from the households, Mr. Ho established a project to build a farm, and applied for land lease to build a farm on August 20, 2006 in Bau Sen area, Trang Son commune, with a leased area of ​​6,386m2. On September 30, 2006, Trang Son commune People's Committee issued document No. 42/TTr-UB requesting the District People's Committee to reclaim 6,386m2 of land at plot 187, map sheet No. 07 in Bau Sen area, Trang Son commune. In the report signed by the Chairman of the Commune People's Committee at that time, it stated: "Considering the application for land lease and investment project of Mr. Ngo Tri Ho's household, Hamlet 7, Trang Son Commune, Do Luong District, regarding the application for land lease to build a livestock and aquaculture farm. Now, Trang Son Commune People's Committee respectfully requests the District People's Committee, the Department of Natural Resources and Environment of Do Luong District to issue a decision to reclaim land and lease land as follows: Total area proposed for land recovery and lease: 6,386m2. Taken from plot No. 187, map sheet No. 07. Using from type 2 rice land, currently managed and used by Trang Son Commune People's Committee. This is a difficult-to-transfer land area on the edge of the village, so there is no need for site clearance...". Based on the proposal of the People's Committee of Trang Son commune, on March 12, 2007, the People's Committee of Do Luong district reclaimed 6,386m2 of plot 187 mentioned above in Decision No. 40/QD-UBND.TN for the purpose of leasing land to Mr. Ngo Tri Ho to build a livestock and aquaculture farm.

Mr. Tran Tuan Binh, Chief Inspector of Do Luong district, said: After Mr. Ho collected the land, the commune made a report "this is land on the edge of the village that is difficult to transfer, the commune is managing it", the Department of Natural Resources and Environment did not check the reality but advised the Chairman of the District People's Committee to grant it to Mr. Ho, so the incident of duplicate cover issuance occurred... The fact that the People's Committee of Trang Son commune made a report requesting the People's Committee of Do Luong district to reclaim and lease land at plot number 187, map sheet 07 is completely contrary to reality. In Conclusion No. 84/KL-UBND.TTr of the People's Committee of Do Luong district dated February 13, 2014, it stated that "The preparation of the dossier requesting the District People's Committee to reclaim land was dishonest with the superior state management agency (confirming that the proposed area to be reclaimed belonged to the land on the outskirts of the village, difficult to assign to production households, and the land managed by the Commune People's Committee was contrary to reality)... The District Department of Natural Resources and Environment is the advisory agency primarily responsible for the above violations, because it advised the District People's Committee to decide to reclaim land that was not in accordance with the current status of land management and use at the time of reclamation. It did not appraise the dossier, did not check the current status of land use of the reclaimed land area...".

Thus, the content of the reflection of the households in Trang Son commune is true. The People's Committee of Do Luong district needs to quickly intervene to handle the incident, ensuring the rights of households whose land is in Mr. Ho's farm construction project; Handling the responsibility of individuals and groups that caused the violations. Do not let the incident drag on, causing prolonged complaints.
