Handling existing problems and difficulties in granting certificates of land use rights and ownership of houses and construction works of organizations investing in construction for sale

On August 2, 2012, at the Provincial People's Committee Office, Comrade Ho Duc Phoc - Chairman of the Provincial People's Committee chaired a meeting to handle existing problems and difficulties in granting Certificates of land use rights and ownership of houses and construction works of organizations investing in construction for sale. Attending the meeting were Comrade Dinh Viet Hong - Vice Chairman of the Provincial People's Committee; leaders of the Provincial People's Committee Office, representatives of the departments and branches: Natural Resources and Environment, Construction, Planning and Investment, Finance, Tax Department and representatives of Vinh City People's Committee.
After listening to the report of the Department of Natural Resources and Environment and the opinions of the meeting participants, comrade Ho Duc Phoc - Chairman of the Provincial People's Committee concluded as follows:
1.For urban construction projects, housing projects have been approved for planning and investment by the Provincial People's Committee., request investors to speed up the construction progress of project items according to the approved planning and schedule - Assign the Department of Planning and Investment to inspect and urge investors to implement the project on schedule; Department of Construction to inspect and supervise investors in construction according to the approved planning, ensuring the quality of the project and construction progress. Department of Natural Resources and Environment, Vinh City People's Committee to inspect land use, environment, fire and explosion and related obligations.
2. To remove difficulties for businesses and increase confidence for home buyers,Agree to issue a certificate to each plot of land that has been adjusted on the cadastral map for the investor.
For urban areas and towns in new urban areas planned to develop into cities and towns, when granting certificates, it must be clearly stated on the certificates (in the notes section) issued to investors that it is not allowed to transfer land use rights to households and individuals in the form of selling land without building houses.
3. In the case where a land use right certificate was previously issued for each planning area of a land use purpose (common cover), if the investor wishes to re-issue the certificate for each land plot (individual cover), the investor agrees to revoke the issued certificate and re-issue it as stated in Section 2 of this Notice...
4.Assigned to Department of Natural Resources and EnvironmentTake the lead and coordinate with relevant agencies to disseminate and warn commercial banks and people about mortgages, capital contributions, and land use rights transfers of construction investment organizations before construction is completed to avoid risks and fraud (1 plot of land sold to many people). Nghe An Newspaper, Nghe An Radio and Television Station, Nghe An Electronic Information Portal report and widely disseminate to relevant organizations and individuals to comply with legal regulations and avoid risks and bad consequences (People who pay to buy project land must have a Land Plot Certificate so that when the investor finishes building the house, it can be changed to the name of the household owner).
5.To the Department of Construction:
- Guide, urge, inspect and supervise project investors to organize acceptance of works upon completion of construction (including old works that have not been accepted before and new works), carry out procedures to obtain certificates of conformity on construction quality in accordance with legal regulations, ensuring conditions for certification of property ownership for investors and home buyers and construction works.
- Direct and urge project investors to hand over completed public infrastructure works to local authorities for management according to regulations.
6.Department of Natural Resources and Environment guides Vinh City People's CommitteeIssue land use rights and home ownership certificates to buyers in accordance with regulations.
7.Vinh City People's CommitteeSpeed up the issuance of land use rights and home ownership certificates to buyers of apartments, plots, and villas when the project has been completed in accordance with regulations.
