Handling traffic safety violations: Strong enough sanctions needed
(Baonghean) -Recently, traffic safety violations have been increasing. One of the reasons for this situation is that the detection and handling of violators has not been thorough. The coordination between the authorities and the agencies and units with violators is only based on circulars and directives.
No officials, civil servants... violated?!
On June 29, 2007, the Government issued Resolution No. 32 on solutions to curb the increase and gradually reduce traffic accidents. However, up to now, the traffic safety situation has had complicated developments, traffic accidents have increased compared to previous years. In the first 8 months of 2011, nationwide, there were 8,984 traffic accidents, killing 7,550 people and injuring 6,908 people. In Nghe An, from December 1, 2010 to October 25, 2011, there were 199 accidents, killing 236 people and injuring 129 people (compared to the same period in 2010, there was an increase of 25 accidents, 12 deaths and 33 injuries).
The reason for the increase in traffic accidents in recent times is partly due to the fact that local authorities in some localities, agencies and units have not paid due attention, are still indifferent or stand aside; many people are officials, civil servants and employees who violate traffic safety laws and order without being handled by the units managing those civil servants or are not strictly handled. According to our research, most agencies and units located in our province have not yet proposed disciplinary measures when officials and employees violate traffic safety laws and order. In their regulations, few agencies and units mention the form of handling when officials and civil servants violate traffic safety laws and order.
Among those who run red lights, there are many cases of officials, civil servants and workers.
Meanwhile, on October 12, 2010, the Ministry of Public Security issued Circular 38, stating: "A person who commits an administrative violation of order and traffic safety on roads, railways, and inland waterways shall be notified in writing to the police of the commune, ward, or town where that person resides, works, or studies for monitoring, review, and education" and "upon receiving a notice of violation, the police of the commune, ward, or town shall be responsible for recording the violation in a logbook and forwarding the violation notice to the head of the residential group or village head where the violator resides, or to the agency or school if the violator is a cadre, civil servant, public employee, or student for review and education; the recipient of the notice shall be responsible for reporting back to the agency that issued the notice of violation". Previously, Circular No. 22 dated October 12, 2007 of the Ministry of Public Security also emphasized: "Every 3 months, 6 months, 1 year, the agency issuing the notice is responsible for summarizing the results of education, review, and handling of people with administrative violations of traffic order and safety and sending them to the Traffic Safety Committee of the province or centrally-run city to report to the National Traffic Safety Committee".
In the first 9 months of 2011, in the province, there were more than 110,540 cases of traffic safety violations recorded by the police and traffic inspectors, certainly among these were many cases of officials, civil servants and public employees violating the law. However, when we asked for statistics on cases of officials, civil servants and public employees violating the law, the Traffic Police Department of Nghe An Province Police did not have statistics on these cases. Lieutenant Colonel Bach Hung Dung - Deputy Head of the Traffic Police Department - Nghe An Province Police said: These statistics could not be compiled because when recording the records, violators often did not declare their place of work. According to the reflection of some cases of violations, when recording the records of penalties, the authorities often only recorded the residential address of the violators and rarely asked about the agencies or units where the violators worked.
In Vinh City, from December 1, 2010 to October 20, 2011, there were 14,058 cases of administrative violations of traffic order and safety that were recorded, but no cases of civil servants were found to have violated, but only 171 cases of students were found to have violated and were sent to the schools and the Department of Education for handling. The schools all sent notices to Vinh City Police for these cases, the handling results of the schools were usually warning the whole school, lowering the conduct level, recording the student's report card, and reporting to the family and locality.
Need a strong measure
To solve the problem of traffic safety violations and gradually create awareness of traffic culture for everyone, it is difficult to expect self-awareness, but more than anything, we need drastic measures with strong deterrence from functional sectors and local authorities.
On October 4, 2011, Chairman of Nghe An Provincial People's Committee - Ho Duc Phoc signed Decision No. 4070 on the establishment of the Office of Nghe An Provincial Traffic Safety Committee with the task of advising the Provincial Traffic Safety Committee to direct and implement legal regulations on traffic safety and order; develop programs, plans and measures to coordinate with departments, branches and authorities at all levels in implementing solutions to ensure traffic safety and order...
At the meeting on October 12, 2011 on the implementation of urgent tasks and solutions to curb traffic accidents in our province, many strong solutions were proposed. That is, it is necessary to determine the responsibilities of sectors, localities, units and heads of those sectors, localities and units. Also at the meeting, comrade Ho Duc Phoc, Chairman of Nghe An Provincial People's Committee - Head of the Provincial Traffic Safety Committee criticized the Chairmen of the People's Committees of districts who did not attend the meeting and 11 localities for the increase in traffic accidents, requiring these localities to organize meetings to review and evaluate the causes and propose tasks and solutions to overcome them. The Chairman of the Provincial People's Committee requested that from now on, People's Committees at all levels, state agencies, and mass organizations must consider compliance with traffic safety laws and order as an important criterion for emulation, commendation and discipline for units and individuals, especially for heads of localities and management scopes. This is a sign of the province's determination in directing and operating the work of ensuring traffic safety and order at present.
