Mr. Van said: "In 2004, the State had a project to build a tourist road along Lam River, from Nam Dan to Cua Hoi through Hung Xuan Commune... The total land area of ​​my family is 60 m2, The state took away 15.75m2, my family's remaining land is 44.22 m2. The Compensation and Site Clearance Board of the People's Committee of Hung Nguyen District and the project owner of the Lam River Road Construction Project, Nghe An Department of Transport, Nghe An Provincial Inspectorate, and Nghe An Newspaper all rejected my family's complaint requesting land. These agencies violated the law and caused damage to my family."

In the letter, Mr. Van also provided Nghe An Newspaper with a handwritten photocopy of the "land donation paper" that Mr. Nguyen Van Hong (Mr. Van's father) gave him in 2003. Mr. Van requested: The Chairman of the People's Committee of Hung Nguyen district to coordinate with the Department of Transport to inventory the current status of the land and affected assets of his family to proceed with site clearance to complete the construction of a residential road to serve the travel of the people as concluded by the Chairman of the Provincial People's Committee in Official Dispatch No. 7624/UBND-KT, dated October 28, 2013.

Through investigation, information collection and based on the content of Mr. Nguyen Thanh Van's petition, Nghe An Newspaper affirms that Mr. Van's complaint is unfounded, because:

- Firstly, the State has not yet recovered the land where Mr. Van's family is living, so it is correct that compensation and resettlement have not been carried out.

- Second, the land area where Mr. Van's family is currently living is not under his family's right to use, because Mr. Van only has a handwritten paper "donating residential land" dated 2003 from Mr. Nguyen Van Hong (Mr. Van's father) without authentication from the competent authority. Mr. Van has not yet completed the procedures for the State to grant the right to use the land area that, according to Mr. Van, his father gave him. Therefore, based on the legal basis, this land area is still included in the State's Land Use Right Certificate granted to Mr. Nguyen Van Hong's family. Meanwhile, the State's Land Use Right Certificate granted to Mr. Hong in 1996 shows 276 m2(According to 2010 measurement data, the actual area of ​​this land plot is 776.6 m2)2), therefore, if the State proceeds to reclaim Mr. Hong's family's land with an area of ​​15.75m2, the remaining area is still very large: 760.95 m2, so Mr. Hong is not eligible for resettlement land.

On October 28, 2013, in Official Dispatch No. 7624/UBND-KT, the Chairman of the People's Committee of Nghe An province assigned the Chairman of the People's Committee of Hung Nguyen district to coordinate with the Department of Transport (the investor of the Lam River Road Project) to unify the compensation capital for site clearance for the Lam River Road Project, and directed the functional departments of Hung Nguyen district to work with Mr. Hong and Mr. Van's families, inventory the current status of affected land and assets, and agree on the compensation value for site clearance to complete the construction of the community road to serve the people's travel. In the above situation, the relevant parties need to coordinate soon to promptly construct the community road, creating convenient conditions for people's travel and stabilizing the situation. However, Mr. Hong and Mr. Van's families need to coordinate well with the authorities so that the compensation for site clearance is carried out in accordance with the law.
