3 brothers, uncle and nephew sentenced to prison after revenge with bamboo sticks

(Baonghean.vn)- After a drinking session, Thanh invited his brother and nephew to find his rival to take revenge. As a result, his rival was beaten and suffered a 37% disability, and all three uncles and nephews were sentenced to prison.

On July 28, the People's Court of Quy Hop district opened the first instance trial of the criminal case against the defendants Mac Van Thanh (born in 1993), Mac Van Long (born in 1983), both residing in Nam Son commune, and Luong Van Quyet (born in 1997, residing in Bac Son commune) for the crime of "Intentionally causing injury".

According to the indictment, at around 7:00 p.m. on August 25, 2016, after drinking at Long's house, Thanh invited Long (his brother) and Quyet (his nephew) to go find Vi Van Hoang (born in 1990), a neighbor, to "settle the score" because "Hoang beat me up the other day, so I had to go beat him back."

When leaving, each person held a bamboo stick, Long held a knife tied to his back and a chain. All three went to Khiet village where Hoang was selling buffalo meat.

Here, Thanh raised his stick to hit Hoang. Hoang raised his hand to block, then took a knife from his butcher's counter and chased after Thanh to slash him.

At this time, Long rushed in and used a stick to hit Hoang on the head, back, and chest, but Hoang slashed him on the head. Although he slipped and fell to the ground, Long continued to use the chain he was carrying to hit Hoang. At the same time, Quyet also rushed in and used a stick to hit Hoang.

Seeing his brother being slashed by Hoang, Thanh used a stick to hit Hoang several times on the shoulder, head and back, causing Hoang to fall to the street. After that, all three of them ran back to Long's house.

Hoang was taken to the emergency room by everyone. According to the conclusion of the National Institute of Forensic Medicine, Vi Van Hoang's disability rate is 37%.

Thanh and Quyet then went to the Nam Son Commune Police Station (Quy Hop) to surrender, while Long was taken to the district general hospital for treatment of his injuries. However, Mac Van Long refused to be examined and did not request that Vi Van Hoang handle the beating he received, so the police did not consider or handle it.

According to the indictment of the People's Procuracy, in this case, Mac Van Thanh was the initiator and played the main role, Mac Van Long actively participated, and Luong Van Quyet had a secondary role.

Based on the circumstances and evidence presented in Court, the Panel sentenced Mac Van Thanh to 36 months in prison; Mac Van Long to 30 months in prison and Luong Van Quyet to 27 months suspended sentence, with the measure of being prohibited from leaving their place of residence.

Regarding civil compensation liability, the defendants must compensate the victim 110 million VND.
