Abolish Directive No. 20/CT-TTg of the Prime Minister on rectifying inspection and examination of enterprises

Deputy Prime Minister Nguyen Hoa Binh has just signed Decision No. 1182/QD-TTg dated October 14, 2024 of the Prime Minister abolishing Directive No. 20/CT-TTg dated May 7, 2017 of the Prime Minister on rectifying inspection and examination activities for enterprises.

Accordingly, the entire Directive No. 20/CT-TTg dated May 17, 2017 of the Prime Minister on rectifying inspection and examination activities for enterprises is abolished.

The Prime Minister assigns the Government Inspectorate, within the scope of its functions and tasks, to be responsible for guiding agencies performing inspection functions to conduct inspections and examinations of enterprises in accordance with the provisions of the Law on Inspection, Decree No. 43/2023/ND-CP dated June 30, 2023 of the Government detailing a number of articles and measures to organize the implementation of the Law on Inspection; Decree No. 03/2024/ND-CP dated January 11, 2024 of the Government on agencies performing specialized inspection functions and the activities of agencies assigned to perform specialized inspection functions.

The Government Inspectorate guides agencies performing inspection functions to develop and implement annual inspection plans in accordance with legal regulations; promptly handle overlaps and duplications in inspection activities.

This Decision comes into force from the date of signing (October 14, 2024).

* In Directive No. 20/CT-TTg dated May 17, 2017, the Prime Minister requested Ministers, Heads of ministerial-level agencies, Chairmen of People's Committees of provinces and centrally-run cities to seriously grasp and closely direct inspection work within the scope of assigned state management in accordance with the provisions of the Law on Inspection, Decree No. 86/2011/ND-CP dated September 22, 2011 detailing and guiding the implementation of a number of articles of the Law on Inspection, Circular No. 01/2014/TT-TTCP dated April 23, 2014 of the Government Inspectorate regulating the development and approval of inspection program orientations, inspection plans and especially Resolution No. 35/NQ-CP dated May 16, 2016 of the Government on supporting and developing enterprises until 2020.
On November 14, 2022, the National Assembly issued the Inspection Law No. 11/2022/QH15, effective from July 1, 2023. Inspection Law No. 56/2010/QH12 ceases to be effective from the effective date of this Law.
The Government also issued Decree No. 43/2023/ND-CP dated June 30, 2023 of the Government detailing a number of articles and measures to organize the implementation of the Law on Inspection; Decree No. 03/2024/ND-CP dated January 11, 2024 of the Government on agencies performing specialized inspection functions and activities of agencies assigned to perform specialized inspection functions.
