Discussing the disbursement plan of 1,275 billion VND for compensation and site clearance for National Highway 1A

Although the Provincial People's Committee has established a Steering Committee to pay the compensation of VND 1,275 billion for land clearance of National Highway 1A. However, up to now, the payment is still facing many difficulties.

On the morning of August 7, the Provincial People's Committee held a meeting to discuss solutions to remove existing problems, difficulties and obstacles in handling complaints, approving compensation plans, speeding up the payment progress and disbursing additional funds to handle complaints for the project to upgrade and expand National Highway 1A. The meeting was chaired by Comrade Le Hong Vinh - Member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Provincial People's Committee, and Head of the Steering Committee for payment of compensation for land acquisition and clearance of National Highway 1A.

Resolutely implement

On December 27, 2023, the Government issued Decision No. 1702/QD-TTg, supplementing VND 1,275 billion in the estimate and plan for investment of central budget capital in 2023 from the source of increased central budget revenue in 2022 for Nghe An province to resolve compensation for site clearance (including delayed payment) of the National Highway 1A expansion projects through Nghe An province under the central budget tasks arising after these projects have been finalized.

To pay this amount of 1,275 billion VND, on March 15, 2024, the Provincial People's Committee decided to establish a Steering Committee to pay compensation for site clearance of National Highway 1A, and at the same time, urge and direct localities to disburse the allocated capital according to regulations, ensuring that no complaints arise.

In Hoang Mai town, as of July 31, 2024, the Compensation, Support and Resettlement Council of Hoang Mai town has established a compensation and delayed payment plan for 118/148 households eligible for compensation. The People's Committee of Hoang Mai town has also issued 10 decisions approving the compensation and delayed payment plan for the National Highway 1A Upgrade and Expansion Project for 103 households, families and individuals in the area with a total compensation and support amount of 42,820 billion VND. Currently, the People's Committee of Hoang Mai town has submitted a document to the Provincial People's Committee to arrange capital to organize payment for 77 households and individuals (55 households in Quynh Thien ward, 11 households in Quynh Xuan ward and 11 households in Mai Hung ward) with a total amount of 37,022 billion VND.

In Quynh Luu district, the project to upgrade and expand National Highway 1A through Quynh Luu district has a total length of 12.25 km; passing through 6 communes and 1 town. Of which, the section passing through Quynh Hong, Quynh Lam, Quynh Giang communes and Cau Giat town uses the State budget. The section passing through Quynh Van, Quynh Thach, Quynh Hau communes uses BOT capital. Through review, there are 1,683 land plots along the entire route affected by the project, of which: 916 land plots are in the section using BOT budget; 767 land plots are in the section using State budget.

In Dien Chau district, for the Thanh Hoa city - Dien Chau section, according to the inspection and review results, 1,116 households were affected with a total amount of about 365.7 billion VND, of which: Dien Ngoc commune has 170 households with a total amount of about 50 billion VND; Dien Ky commune has 342 households with a total amount of about 89.7 billion VND; Dien Hong commune has 369 households with a total amount of about 140.5 billion VND and Dien Yen commune has 235 households with a total amount of about 85.5 billion VND.

Up to now, based on the verification and review reports of the communes, the Land Acquisition and Clearance Council has drafted a plan and prepared to make it public according to regulations for a total of 193/1,116 households with a total approved amount of about 65.5 billion VND.

Particularly in the Dien Chau - Quan Hanh section, 276 households were affected in Dien An commune (267 households), Dien Trung (8 households) and Dien Thinh (1 household), with a total cost of more than 100 billion VND.

In Vinh City, the current problems related to compensation and support payments for people when clearing land for National Highway 1A are mainly in Nghi Lien Commune, in which 67 households have filed complaints requesting benefits. However, after reviewing, Vinh City People's Committee concluded that the content of the people's petitions did not meet the conditions for compensation.

Many recommendations

In the process of implementing compensation for land acquisition and clearance of National Highway 1A, many localities have encountered difficulties and obstacles. For example, in Hoang Mai Town, this is a locality with many petitions related to the expansion and upgrading of National Highway 1A, especially within the 13.5m range of the PMU1 Project implemented from 1995-1996. In particular, in Quynh Xuan Ward, out of 118 households with petitions (126 plots), only 11 households have excerpts of the affected area, the remaining 103 households and individuals have recovered areas within the 13.5m range but the excerpts do not show or measure the affected area. Therefore, determining the affected area to have a basis for compiling compensation records is very difficult.

Or in Quynh Luu district, Cau Giat town area, the property compensation records of the PMU1 Project from 1995 to 1998 showed that the property was within 13.5m. However, the land records over the periods have deducted the land within 13.5m and the review conclusions of the teams show that the above cases are not eligible for compensation. This raises concerns that people will file complaints if compensation is not considered.

Or in Dien Chau district, during the process of reviewing and reconfirming the origin of land use and the area of ​​affected households, there were many cases where the land had been transferred many times (the transferred land area did not include the land area within the PMU1 Project boundary).;In many cases, the landowners are not present in the locality to coordinate,... Therefore, the communes are facing difficulties in the process of verifying the origin of the land, establishing and publicizing compensation plans...

At the meeting, representatives of the Departments of Natural Resources and Environment; Transport; Finance... also gave their opinions to answer questions and recommendations from localities.

Regarding the difficulties of Hoang Mai town, Mr. Pham Van Toan - Deputy Director of the Department of Natural Resources and Environment said that this content has been answered and guided many times by the General Department of Land Management - Ministry of Natural Resources and Environment, the Provincial People's Committee, the Department of Natural Resources and Environment. Therefore, the Department of Natural Resources and Environment requested the People's Committee of Hoang Mai town to focus on resolving petitions, recommendations, and complaints for each specific case by decisions, inspection conclusions, and audit conclusions to serve as a basis for developing compensation plans for households in accordance with the direction of the Provincial People's Committee in Notice No. 366/TB-UBND dated May 31, 2023 of the Provincial People's Committee, not continuing to recommend the Provincial People's Committee and departments, branches and sectors to have plans to handle excerpts and measurements for site clearance within a 13.5m radius through Quynh Xuan ward.

In the case of Quynh Luu district and Vinh city, the Department of Natural Resources and Environment proposes to study legal regulations and instructions of the Provincial People's Committee to inspect, verify, issue decisions to resolve complaints, inspection conclusions; develop and approve compensation plans for eligible cases according to the provisions of law.

Mr. Hoang Phu Hien - Director of the Department of Transport, Deputy Head of the Steering Committee for Compensation Payment for National Highway 1A said that the disbursement of this capital source in the remaining 4 months is very urgent. Therefore, localities need to actively resolve, focus on processing petitions and implementing payments when conditions are met, otherwise it will be very difficult to implement and there is a risk of being revoked.

At the meeting, comrade Le Hong Vinh highly appreciated the efforts and shared the difficulties of the locality in the process of implementing compensation for land clearance of National Highway 1A. However, the direction and urging of the leaders of the district, town and city towards the communes and wards where the project passes through is not much. Meanwhile, there is not much time left, currently the guiding documents are complete (283 related documents), the funds have been transferred to the localities, so it is recommended that the localities base on the system of guiding documents of the Provincial People's Committee, departments and branches to implement. In addition, continue to review the paid records to make additional payments if the compensation conditions are met.

The Standing Vice Chairman of the Provincial People's Committee also requested localities to develop detailed payment plans; promptly remove difficulties and obstacles. Focus on completing payment for households that have had decisions approving site compensation plans before September 30, 2024; complete approval of site compensation plans for remaining households before October 30, 2024; complete payment before November 30, 2024.

In addition, localities also need to mobilize the entire political system to participate in strengthening propaganda and mobilizing people not to participate in mass complaints that affect security and order in the area.
