Provincial Party Secretary and Chairman 'avoid' people, how to handle responsibility?

According to many lawyers, there should be a mechanism for the government to take responsibility for not receiving people or resolving complaints.

After nearly 1 year of implementing the practice of lawyers and jurists providing free legal advice to citizens who come to complain and denounce at the central citizen reception office, many lawyers said that the biggest difficulty now is that local authorities in many places do not respect the Law on Complaints and the Law on Denunciation, so they "avoid" the people when they come to the People's Committee offices at all levels to complain and denounce. This leads to the situation where people complain beyond their level and drag on. There are cases that drag on for decades, even decades, because the authorities at all levels push the issue aside and do not resolve it completely.

Chairmen of many provinces and cities do not receive people

Mr. Nguyen Van Pha, Vice Chairman of the Central Committee of the Vietnam Fatherland Front, said that there are cases that are 100% legal, but the local authorities do not resolve them or do not do it thoroughly, so people continue to file lawsuits for many years.

“There are projects that spread the carpet, or more accurately, businesses spread the carpet themselves and then leave on their own, there are even businesses that plan their own projects, so why wouldn’t the people agree? And the initial resolution quality is not high, and there are also problems with the statute of limitations. Now when people complain, the government says that compensation has been paid before, so why don’t people complain? Now when people complain, they are out of authority, the court cannot handle it because the statute of limitations has expired. Lawyers who participate in resolving people’s complaints are also being harassed by the government because they think that if they are out of authority, how can they resolve them? We stand on the side of the victims of injustice, but we are always pressured by the government,” said Mr. Nguyen Hong Diep.

According to Lawyer Nguyen Manh Ha, Hanoi Bar Association, there needs to be a mechanism to monitor local authorities because there have been complaints from people for 10 years, with official dispatches from the Government Office, the Central Party Office, and the Government Inspectorate sent to the province requesting resolution and proposing resolution and reporting back, but for 10 years now, there has been no resolution.

“There are cases where we have advised the people about the authority of the Provincial People's Committee to resolve the issue, but the people said that the province has not resolved the issue for 10 years, so they keep going to the Central Government. We have sent an official dispatch to the Chairman of the Provincial People's Committee requesting a resolution to avoid prolonged complaints, but there has been no response. We request the Vietnam Fatherland Front and relevant agencies to advise the Party and State on how to have a mechanism for how local authorities should be held responsible if they do not resolve such issues. Because there are many official dispatches sent back but they are never resolved,” Lawyer Nguyen Manh Ha suggested.

Lawyer Nguyen Van Xuong, Hai Phong City Bar Association, also said that there are many difficulties in handling complaints and denunciations from citizens. Among them are the agencies receiving complaints and denunciations not having full responsibility, and there is no "Commander" to listen to the people's explanations from beginning to end to make the right decision. Therefore, many complaints are answered over and over again, but in fact the answers are incorrect, including in the judicial and administrative fields.

Lawyer Nguyen Cam, Hai Phong City Bar Association, suggested that agencies should consider and expand the work of improving the reception of citizens at the local level by the reception staff, to avoid the situation where people complain beyond the level. There should be specific instructions and a final resolution at each level, avoiding overlap. State agencies need to resolve on time, if refusing, they must clearly state the reason based on the law./.
