Ministry of Finance proposes solutions to handle assets at Tuoi Tho kindergarten in Thanh Chuong
(Baonghean.vn) - After many months of "interruption", the Ministry of Finance has sent a document to the Government Office on the plan to handle assets at the Center for Vocational Education - Continuing Education of Thanh Chuong District. This is the location of the Tuoi Tho kindergarten that was once stirred up by the "kneeling teacher" incident that occurred in June 2018.
Previously, the Tuoi Tho kindergarten - a project of Minh Sang Construction and Education Investment Joint Stock Company built on the land of the above center is currently having all activities suspended. The reason is that the investor built classrooms and organized enrollment and education of children on land that has not been allocated by the State and has not completed legal procedures. Regarding the above violations, the Disciplinary Council of Thanh Chuong district has also clarified the responsibilities and reprimanded the individuals involved.
According to the official dispatch of the Ministry of Finance, the real estate at Block 3, Thanh Chuong town of the Thanh Chuong District Technical and Vocational Guidance Center is subject to rearrangement and handling of real estate according to the provisions of Decision No. 09/2007/QD-TTG of the Prime Minister, now Decree No. 167/2017/ND-CP dated December 31, 2017 of the Government regulating the rearrangement and handling of public assets.

“Therefore, the Nghe An Provincial Department of Finance is requested to report to the Nghe An Provincial People's Committee to manage, use and handle the house and land at Block 3, Thanh Chuong Town in accordance with the provisions of law. At the same time, review the management and use of this house and land in the past. In case of any violations, handle or report to the competent authority for handling in accordance with the provisions of law,” the dispatch stated.
Also according to the above document, the Center's real estate is public property assigned to public service units for management and use. The management, use and disposal of this real estate is carried out in accordance with the provisions of law on management and use of state property.
In case of handling by auctioning assets on land and transferring land use rights according to the plan in Decision No. 1972/QD-UBND of Nghe An Provincial People's Committee on approving the plan for handling and arranging houses and land, the buyer must pay for the purchase of assets on land and the value of land use rights to the unit with the assets for sale according to the provisions of Article 11, Decree 167. The management and use of the proceeds from the sale of assets on land and the transfer of land use rights shall comply with the provisions of Article 18 of Decree 167.
Currently, the Ministry of Finance has also sent a document to the Government Office to seek opinions on handling the above issue. In particular, the general spirit is to strictly handle it in accordance with the provisions of the law. In the case of selling assets on land, transferring land use rights, the Ministry of Finance proposes to implement it in the form of auction, ensuring publicity, transparency, and avoiding loss of State assets.
