The Ministry of Justice said it has received feedback on the fact that thousands of vehicles have been refused inspection by the Department of Registration in the past, and will hold a meeting to study this matter.

According to Mr. Dong Ngoc Ba, Director of the Department of Inspection of Legal Documents - Ministry of Justice, in the next few days, the unit will organize a meeting to review and study whether the Vietnam Register's refusal to inspect vehicles after receiving a notice of violation but not yet paying the fine from the police is in accordance with the spirit of Circular 70/2015-Ministry of Transport or not.

Previously, Mr. Tran Ky Hinh - Director of Vietnam Register said that from January 2017 to September 15, there were over 16,000 vehicles violating traffic laws reported by authorities on the system.

Accordingly, more than 5,000 vehicles have had documents and notices from the authorities that have handled violations and removed them from the system, meeting the conditions for registration. In 2016, there were about 2,800 cases of vehicles violating the law that were fined.

“The entire system of inspection stations will refuse to inspect vehicles when receiving notice of a vehicle violating the Traffic Law from the authorities. Only when the system removes the vehicle’s information will the units proceed with the vehicle inspection procedure,” said Mr. Hinh.

Regarding this matter, Colonel Tran Son, former Deputy Head of the Department of Law Guidance and Traffic Accident Investigation and Resolution (Traffic Police Department, Ministry of Public Security), said that the refusal of the Vietnam Register to inspect vehicles that are late in paying fines is unreasonable and even illegal.

“In principle, fines and vehicle inspection are two different issues. Violations that lead to fines are the subjective consciousness of the driver, not the fault of the vehicle. We have clear regulations on vehicle registration. If the owner sells the vehicle to someone else, he must notify the authorities to identify the correct owner. If they do not notify, they must take responsibility. This is the job of the police, not the vehicle inspection agency,” said Mr. Son.

In Clause 6, Article 4 of Circular 70/2015 of the Ministry of Transport stipulates on technical safety inspection and environmental protection of road motor vehicles: Inspection and issuance of inspection certificates for motor vehicles that have expired; Inspection when there is a written request not to inspect from a competent state management agency or the vehicle has violations that have been warned in the Inspection Management Program.

The recommendations and warnings of the authorities here are understood to mean vehicles that do not meet traffic safety and environmental protection standards.

“Currently, cameras and speedometers used for issuing fines can only detect vehicles running red lights, encroaching on lanes, and exceeding the speed limit, but cannot detect whether the vehicle meets safety or environmental standards. Therefore, I think that refusing to register for inspection based on issuing fines is not appropriate,” said Colonel Tran Son.
