Agribank "bosses" in trouble with the law in a case of nearly 2,800 billion

The prosecution agency is preparing to bring the case of the loss of nearly 2,800 billion VND at the Nam Ha Noi Branch to trial. This case involves a series of "bosses" of the Bank for Agriculture and Rural Development.

Lifepro Vietnam Joint Venture Company was established in 2011, formerly Enzo Viet Joint Stock Company, established in 2007, by a group of foreign shareholders.

The subjects committed fraud and appropriated assets of Agribank Nam Ha Noi Branch by applying for legal entity conversion, creating loan documents to buy machinery, equipment, raw materials and transferring 6 fashion brands...

The total amount of money that the subjects defrauded and appropriated was more than 2,523 billion VND. In addition, the subjects also caused a loss of more than 231 billion VND during the project implementation process.

To cause this serious incident, the prosecution authorities identified a number of individuals who were bank officials as having committed crimes.

Topping this list is defendant Pham Thi Bich Luong (born 1969, from Nam Dinh) - former Director of the South Hanoi Branch of the Bank for Agriculture and Rural Development.

The prosecution agency determined that defendant Pham Thi Bich Luong was the person who directed and directly participated in the entire process of illegal lending leading to capital losses of Agribank Nam Ha Noi Branch.

The person who effectively supported the defendant Luong in violating lending regulations was identified as Chu Thi Kim Hien (born in 1958, residing in Hanoi) - former Deputy Director of the South Hanoi Branch of the Bank for Agriculture and Rural Development.

In her capacity as an assistant to Director Pham Thi Bich Luong in charge of credit at the South Hanoi Branch of the Bank for Agriculture and Rural Development, Hien participated in preparing documents to increase the right to make unfounded lending decisions, participated in proposing that Agribank Vietnam increase the right to make decisions, and directly participated in disbursing and appraising Lifepro Vietnam Joint Venture Company. Hien did not closely check the use of capital after lending, so she did not detect that the Bank was defrauded.

The two defendants, Pham Thi Bich Luong and Chu Thi Kim Hien, must jointly bear responsibility for the amount of more than 2,400 billion VND. The two defendants were prosecuted for the crime of Violating regulations on lending by credit institutions and the crime of Abusing positions and powers while performing official duties.

The biggest “boss” of Agribank Vietnam to be caught up in the law is defendant Pham Thanh Tan (born in 1955, from Thai Binh) - former General Director of the Vietnam Bank for Agriculture and Rural Development. Defendant Pham Thanh Tan was prosecuted for two crimes: Abusing position and power while performing official duties and Lack of responsibility causing serious consequences.

During the operation, the defendant signed an unplanned loan of 75 million USD from Agribank Headquarters' money to the Nam Ha Noi Branch. As a result, this amount was appropriated through the violation of lending regulations by Pham Thi Bich Luong and her accomplices.

In addition, the defendant Tan was also irresponsible in signing the request to increase the judgment power for the Nam Ha Noi Branch to lend to Lifepro Vietnam Company in association with importing raw materials for the Textile - Dyeing - Garment Project of Enzo Viet Company. The consequence of his irresponsible behavior was that the amount of 320 billion VND was increased, of which the damage value was more than 306 billion VND.

Defendant Tan was also irresponsible in performing his duties as General Director when he signed and submitted to the Board of Directors for issuance of resolutions and failed to inspect and supervise subordinates in implementing the Board of Directors' resolutions, so he must be jointly responsible for the amount of money disbursed to Lifepro Joint Venture Company that was wrongly disbursed and misappropriated during his tenure as General Director, which was nearly VND 1,900 billion. The total amount of damage related to the actions of defendant Pham Thanh Tan was more than VND 2,100 billion.

Hoang Anh Tuan (born in 1962, from Nam Dinh) - former member of the Board of Directors of the Vietnam Bank for Agriculture and Rural Development was prosecuted for the crime of Lack of responsibility causing serious consequences. As a member of the Board of Directors of the Vietnam Bank for Agriculture and Rural Development authorized by the Chairman of the Board of Directors to exercise certain powers, Hoang Anh Tuan signed a decision to increase the power of judgment for the Director of the Nam Ha Noi Branch to lend Lifepro Vietnam Joint Stock Company 400 billion VND to import raw materials for the Textile - Dyeing - Garment project of Enzo Viet Joint Stock Company. Therefore, Hoang Anh Tuan must bear joint responsibility for the consequences of the damage caused by the increased loan of 320 billion VND.

Also related to a project of Lifepro Vietnam Joint Venture Company, Hoang Anh Tuan was the person authorized by the Chairman of the Board of Directors to sign the resolution to increase the judgment power for the South Hanoi Branch according to the resolutions of the Board of Directors at the request of the Director of the South Hanoi Branch, the Enterprise Credit Board and General Director Pham Thanh Tan to increase the judgment power for the Director of the South Hanoi Branch to borrow up to 150 million USD for Lifepro Vietnam Joint Venture Company, creating loopholes for the defendants who are investors to appropriate the amount of money that is a bank loan with an exceptionally large amount, with no possibility of recovering more than 2,100 billion VND.

Defendant Kieu Trong Tuyen - former Deputy General Director in charge of the Vietnam Bank for Agriculture and Rural Development signed the approval to increase the judgment power of the Nam Ha Noi Branch to lend additional working capital to Enzo Viet Joint Stock Company, which has now been lost. Defendant Tuyen must bear joint responsibility for the loss during this period of more than 231 billion VND. In addition, since defendant Pham Thanh Tan was transferred to another job, Kieu Trong Tuyen was the deputy director but was assigned to take over Pham Thanh Tan's duties. From this time until the case was discovered, the Nam Ha Noi Branch disbursed more than 323 billion VND. Because Tuyen did not closely direct according to the assigned responsibilities, this amount of money was misappropriated. In total, defendant Tuyen must bear joint responsibility for more than 564 billion VND.

In addition to the 5 "bosses" of Agribank, a series of officials of this bank were prosecuted for violating regulations on lending in the activities of credit institutions and lack of responsibility causing serious consequences./.
