Questioning Minister of Construction Nguyen Thanh Nghi, delegate Ta Thi Yen (Dien Bien delegation) raised the recent situation in some housing projects where residents hung banners, even gathered in large numbers, demanding that investors return to buyers the pink books, red books, and certificates of house and land use rights.

According to delegate Ta Thi Yen, this situation is due to the fact that investors have not fully fulfilled their financial obligations to the State, or the processes and procedures for construction investment according to the law, including regulations on fire prevention and fighting. With the responsibility of state management according to the Housing Law, the delegate asked the Minister how to resolve this issue, what measures and sanctions are there for investors to fulfill their commitment to return the certificates of right to use houses and residential land to the owners of houses and residential land?

Responding to this issue, Minister of Construction Nguyen Thanh Nghi said that the current regulations on management and use of apartment buildings are relatively consistent, but the phenomenon as reflected by the delegates is still due to the lack of legal regulations. According to Minister Nguyen Thanh Nghi, there are 5 contents that often cause disputes and complaints related to the management of apartment buildings. These include the delay in organizing apartment building conferences, establishing management boards, unclear financial revenue and expenditure regulations for apartment buildings, the handover and management of apartment building maintenance funds, the distinction between common and separate management parts, the lack of a unified management unit for apartment buildings, and finally the issuance of certificates of land use rights and house ownership.

The Ministry of Construction has inspected and handled investors who violated the regulations, requiring investors to correct them; contributing to resolving disputes and complaints. In the coming time, the Ministry of Construction will review and complete current regulations on management and use of apartment buildings. Regarding violations, Mr. Nghi said he will request competent authorities to handle them.

Responding to questions, Minister Nguyen Thanh Nghi said that regarding handling administrative violations of construction order, the current regulations are relatively complete and have very clear sanctions.

With the responsibility of state management, the Ministry of Construction is responsible for guiding and urging the implementation of legal documents to ensure compliance with regulations. At the same time, the Ministry of Construction is responsible for reviewing and supplementing legal documents.

In the coming time, taking into account the opinions of delegates, the Ministry of Construction will conduct additional research closely, ensuring strict management to limit violations of construction order.

Many housing projects are degraded but cannot be repaired.

Delegate Phan Duc Hieu (Thai Binh Delegation) said that currently, Hanoi has many housing projects and urban areas with degraded infrastructure that cannot be upgraded because they have not been handed over to the government; the urban management board and investors cannot upgrade either. This has affected people's lives and the urban landscape.

"Is this issue under the management of the Ministry of Construction? When will it be resolved?", Mr. Hieu questioned.

Minister Nguyen Thanh Nghi admitted that many projects have not yet handed over technical infrastructure to local authorities for management. The reason is that the previous law only stipulated the principles, leading to confusion in implementation. Infrastructure works of early investment projects deteriorated after a period of use.

In addition, the government's resources (human and material) are limited, forcing investors to manage and maintain the renovation works.

Regarding solutions, Minister Nguyen Thanh Nghi said that he will continue to review regulations, clarifying that investors should propose plans to hand over urban infrastructure right from the time of preparing investment approval documents; assigning responsibilities for urban infrastructure management; and proposing corresponding administrative sanctions in case of non-compliance.

Raising questions in the hall, delegate Phan Thai Binh (Quang Nam delegation) asked that in the report dated October 28, the Ministry of Construction pointed out that the restriction on adjusting urban planning, both locally and in general, is arbitrary, not in compliance with the law and construction requirements. The delegate asked the Minister to state the cause and responsibility for this.

Responding to this issue, Minister Nguyen Thanh Nghi said that urban planning adjustment includes two levels: overall and local adjustment. This adjustment, according to regulations, is an objective and inevitable requirement to adjust orientations that are no longer suitable for reality.

But according to him, in the past, the work of adjusting urban planning has been inadequate, such as being arbitrary and not complying with the law due to the lack of timely planning review and assessment. According to regulations, the responsible agencies review the general and zoning plans after 5 years from the time of approval to overcome inadequacies that are no longer feasible. However, during the review process, the assessment content was not complete and thorough, so it had to be adjusted many times. The collection of public opinions is still a formality. Some places adjusted the planning to attract investment. Inspection and examination work is still limited.

"The primary responsibility lies with the agencies that develop and appraise the planning and the agencies assigned to review and evaluate the planning. The Ministry of Construction is responsible for the lack of supervision, inspection, and supervision to guide and handle violations; and the failure to promptly review and supplement regulations on planning adjustments to ensure strict compliance with regulations," said Minister Nguyen Thanh Nghi.

In the coming time, the Ministry of Construction will propose amendments to the Law on Urban and Rural Planning and complete the planning process and the local planning submission process.
