Featured policies effective from November 2017
Prohibiting the sale of alcohol with an alcohol concentration of 15 degrees or higher over the Internet, renewing the conditions for granting retail licenses for tobacco products, and imposing fines of up to VND8 million for dumping waste into irrigation works... are policies that will take effect from November 1, 2017.
Prohibition of selling alcohol with alcohol concentration of 15 degrees or more over the Internet
Decree 105/2017/ND-CP on alcohol trading takes effect from November 1, 2017 (replacing Decree No. 94/2012/ND-CP dated November 12, 2012 of the Government).
According to this Decree, acts violating the provisions of the law on alcohol trading include: Selling alcohol to people under 18 years old, selling alcohol with an alcohol concentration of 15 degrees or higher over the Internet, selling alcohol through vending machines; Trading alcohol without a license or not in accordance with the contents stated in the license as prescribed in this Decree; Using food alcohol that does not meet standards, industrial alcohol or other prohibited ingredients to produce and mix alcohol.
Leasing or lending a liquor business license; displaying, buying, selling, circulating or consuming liquor without stamps or labels in accordance with the law, liquor that does not meet standards, quality or food safety, liquor with unclear origin... are also violations of the law on liquor trading.

Abolish the area requirement in granting retail licenses for tobacco products
Decree 106/2017/ND-CP amends and supplements a number of articles of Decree 67/2013/ND-CP dated June 27, 2013 of the Government detailing a number of articles and measures to implement the Law on Prevention and Control of Tobacco Harms on tobacco trading, new regulations on conditions for granting retail licenses for tobacco products and takes effect from November 1, 2017.
Accordingly, Decree 106/2017/ND-CP has abolished the condition that the area of a tobacco business location must be 3m2 or more in the licensing conditions. At the same time, the condition: Must have means of transport owned or co-owned under a joint venture or capital contribution contract; or have a contract to rent means of transport suitable to the business scale of the enterprise (must have at least 2 vehicles with a load capacity of 500 kg or more).
To be granted a License to retail tobacco products, a business must meet the following conditions: Be established in accordance with the law; Have a fixed business location, clear address, and ensure technical and equipment requirements as prescribed.
In addition, the business must also have an introduction letter from the tobacco product supplier or tobacco product distributor stating the intended business location...
Under this new regulation, businesses do not need a sales contract from a tobacco product supplier or a tobacco product distributor as is currently the case.
Fine up to 8 million VND for dumping waste into irrigation works
This is one of the regulations in Decree 104/2017/ND-CP regulating administrative sanctions for violations in the field of natural disaster prevention and control; exploitation and protection of irrigation works and dykes, which takes effect from November 1, 2017.
Accordingly, dumping garbage and waste into irrigation works will be punished as follows:
- Warning penalty for dumping garbage and waste into irrigation works with volume less than 0.5 m3;
- A fine of 300,000 VND to 500,000 VND for dumping garbage and waste into irrigation works with a volume of 0.5 m3 to less than 1 m3;
- A fine of 1 million to 2 million VND for dumping garbage and waste into irrigation works with a volume of 01 m3 to less than 03 m3;
- A fine of 2 million to 4 million VND for dumping garbage and waste into irrigation works with a volume of 03 m3 to less than 05 m3;
- A fine of 4 million to 8 million VND for dumping garbage and waste into irrigation works with a volume of 05 m3 or more.
Types of social assistance facilities encouraged by the State to be established
On September 12, 2017, the Government issued Decree 103/2017/ND-CP on the establishment, organization, operation, dissolution and management of social assistance facilities.
Accordingly, domestic and foreign organizations and individuals are encouraged to establish social assistance facilities to care for and assist those in need with the following types:
Social protection facilities (CSBTXH) care for the elderly; Social protection facilities (CSBTXH) care for children in special circumstances; CSBTXH care for the disabled; CSBTXH care for and rehabilitate mentally ill people and people with mental disorders; CSBTXH comprehensively provides care for many social protection beneficiaries or those in need of social assistance. Social work centers provide consultation, emergency care or support other necessary conditions for those in need of social assistance; Other social assistance facilities as prescribed.
Allow training masters in pharmaceutical chemistry
This is the highlight of Circular 25/2017/TT-BGDDT on the List of level IV education and training at master's and doctoral levels issued by the Minister of Education and Training on October 10, 2017.
Accordingly, the Pharmaceutical Chemistry industry is added to the list of education and training at level IV of master's degree, belonging to the Pharmacy group in the Health sector.
In addition, Circular 25 also adds the Medical Engineering group to the Health sector in the list of training and education at level IV at both master's and doctoral levels, including the following majors: Medical testing techniques; Medical imaging techniques; Rehabilitation techniques.
Based on the permitted training majors, universities proactively develop training majors to meet social needs.
Circular 25/2017/TT-BGDĐT takes effect from November 25, 2017.
