Thu Minh and her husband's creditor: 'We are not the only ones who have been defaulted on their debt'

August 10, 2016 08:37

Mr. Nguyen Huu Ngoc (Bien Hoa, Dong Nai) - representative of Gia Han Company Limited said that in 2012, the company signed a contract to supply tables and chairs to Global Home SRO Company (headquartered in the Czech Republic) represented by General Director Otto De Jager (Czech nationality, husband of singer Thu Minh).

At first, the export orders went smoothly, but over the past year, the buyer started not paying the debt and not paying the debts to Gia Han even though the goods were exported quite regularly.

“When the goods were continuously exported but the money was not transferred to our account, we asked the importer but they only replied that they would pay later and until now, both the old and new orders have not been paid,” he said.

This person also cited evidence that Global Home signed an order with the company worth a total of 281,900 USD. This order has been checked and stamped but is still in the warehouse because the partner has not received the goods. The recent order worth 493,720 USD was produced and delivered by the company according to the agreement in April, May, June and July 2015 but to date has not received the payment.

Gia Han Company hung a debt collection banner in front of the villa of singer Thu Minh and her husband in District 2 (HCMC).

According to Gia Han, all exported products have been inspected by Global Home technicians for design, quality, paint color, structure, etc. Products that meet standards have been stamped with QC - a stamp of recognition and the stamp of singer Thu Minh's husband's company. In addition, the company's products are all supervised by Vietnamese customs and have full documents confirming that the order was successfully shipped. Therefore, Gia Han believes that Global Home's email saying that some products delivered were not in accordance with specifications is a "trick" to shirk responsibility.

Believing that the above behavior was unreasonable, Gia Han Company repeatedly met with Mr. Otto De Jager to request a debt payment order, but Global Home continued to make promises and delay payment. In October 2015, General Director Otto De Jager sent an email to Gia Han Company, demanding a fine of 250,000 USD before agreeing to meet and agree on payment for the order. "This request is unreasonable because the goods we exported did not violate any terms of the contract," said Mr. Ngoc.

Due to the prolonged incident, in May 10, 2016, Gia Han Company filed a complaint with the Department of Investigation Police on Economic Management Order and Position (PC46) of Dong Nai Police. When this agency accepted the case, they repeatedly called representatives of both sides to work, but Global Home did not have Mr. Otto De Jager present, but instead, singer Thu Minh. Due to frustration, Gia Han's representative said that he "spoke up" by hanging a debt collection banner in front of Thu Minh's villa (District 2, Ho Chi Minh City).

“We have full evidence of this company’s fraud, and are preparing documents and hiring lawyers to sue them in court to demand justice. Not only us, but many other businesses are also suffering from this situation. Recently, Thu Minh said that if we played dirty, she should provide evidence. It is not by chance that we are demanding debt, but we have endured and negotiated for a year and four months but have had no results,” said Mr. Ngoc.
