Which agency controls the assets of officials under the management of the Politburo?
On the morning of May 31, at the 5th Session of the 14th National Assembly, authorized by the Prime Minister, Government Inspector General Le Minh Khai presented the Report on the draft revised Law on Anti-Corruption. This content will be discussed by National Assembly deputies in the Hall in the afternoon of the same day.

According to Mr. Le Minh Khai, expanding the subjects obliged to declare assets and income to all cadres, civil servants and public employees holding positions equivalent to Deputy Head of Department or higher when first recruited or appointed to work at agencies, organizations and units in the public sector is a necessary step to synchronously form a national data system on declarations, thereby helping to effectively control fluctuations in their assets and income when they are required to declare annually.

One of the notable points in the draft law is the regulation on the responsibility of controlling assets and income of people under the management of the Politburo and Secretariat and other people with declaration obligations in Party agencies, organizations and units.
Government Inspector General Le Minh Khai said that many National Assembly deputies suggested not to stipulate the responsibility of Party agencies in controlling the assets and income of subjects under the management of the Politburo and Secretariat. Accordingly, all cases must be carried out in accordance with the provisions of law.
There are also opinions in agreement with the regulation that the Party controls the assets and income of certain subjects as in the draft Law.
The Draft Law has been revised in the direction of not separating the provisions on agencies and units controlling assets and income of groups of subjects under the management of the Politburo and the Secretariat and other people with declaration obligations in Party agencies, organizations and units, but providing general provisions as for cadres and civil servants in agencies, organizations and units in the political system.
Agency in charge of controlling assets and income
Regarding the authority to control assets and income of other agencies and units, according to Mr. Le Minh Khai, through the summary of 10 years of implementing the Law on Anti-Corruption, it can be seen that one of the main reasons leading to the ineffective implementation of regulations on declaration and transparency of assets and income is that there is no specialized apparatus assigned to manage the declaration and use, exploit the information and data available to control the fluctuations of assets and income of those who are obliged to declare. Therefore, the draft Law needs to have solutions to overcome this.
The Government has chosen the option of having a specialized agency to control the assets and income of people with positions and powers. However, to avoid problems with organization and staffing, the Government believes that this specialized function should be assigned to the state inspection agency system.
Accordingly, the law assigns the Government Inspectorate to control the assets and income of those holding positions from Director of Department and equivalent or higher working at all agencies, organizations and units. The inspection agency or the unit in charge of organization and personnel work at central agencies, organizations and units (where there is no inspection agency), provincial inspectorate controls the assets and income of those who are obliged to declare other people working at their agencies, organizations, units and localities.

Presenting the review of the draft law, Chairwoman of the Judiciary Committee Le Thi Nga said that this agency chose a different option. Specifically, for those who are obliged to declare their work at ministries, ministerial-level agencies, government agencies, and local authorities, the implementation will be as the option chosen by the Government.
However, for those who are obliged to declare their work at the Court, the Procuracy, the State Audit, political organizations, socio-political organizations, and social organizations, the central agencies of these agencies and organizations shall control their assets and income.
For those who are required to declare their work at the Office of the President, the Office of the National Assembly, or the Office of the Government, these agencies shall control the matter; for those who are required to declare their work as full-time National Assembly deputies, the Standing Committee of the National Assembly shall control the matter.
According to the Judiciary Committee, this plan enhances concentration, partially overcoming the current situation of too many agencies with authority to control assets and income, but also does not cause major disruptions to the organization and operation of agencies and units doing this work. In addition, this regulation also ensures feasibility when verifying assets, limiting the increase in work pressure on agencies and units controlling assets and income.
