Which agency receives feedback on the risk of accidents and occupational accidents from July 1, 2025? The issue of concern of Mr. Ho Van Ham (Quynh Tam commune, Nghe An).
Reply:Pursuant to the provisions of Article 9, Decree 128/2025/ND-CP on decentralization of state management tasks on occupational safety and hygiene as follows:
The tasks and powers specified in Article 6 and Article 19 of the Law on Labor Safety and Hygiene 2015 are performed by the People's Committee at the commune level, including:
1. Receive notifications from employees about occupational safety risks at the workplace in the area to take timely measures to prevent acts that cause occupational safety and hygiene violations as prescribed in Point c, Clause 4, Article 6, Law on Occupational Safety and Hygiene 2015;
2. Receive notification from the employer when an incident occurs that causes serious occupational safety and hygiene loss, provide emergency response and take timely measures as prescribed in Point a, Clause 2, Article 19, Law on Occupational Safety and Hygiene 2015;
3. Proactively take immediate response measures when technical incidents occur that cause serious occupational safety and hygiene problems involving many local production and business establishments and promptly report to the Department of Home Affairs as prescribed in Point c, Clause 2, Article of the 2015 Law on Occupational Safety and Hygiene.
So,People's Committee at commune level have the authority to receive reports on accident risks and occupational accident incidents.
The order and procedures for receiving reports on occupational accident risks and incidents are as follows:
Upon receiving notice from employees and employers, the People's Committee at the commune level must promptly arrange personnel and implement appropriate technical measures to prevent and respond urgently to occupational safety risks at workplaces in the area.
Note:In case of exceeding authority, the People's Committee at the commune level shall report to the Department of Home Affairs and request technical support from appropriate specialized agencies and organizations in the area.
