Inspection work to serve party congresses at all levels: Not handling anonymous or fake complaints
(Baonghean.vn) - Anonymous, fake name, unknown address complaints and complaints with names that have been considered and concluded by competent authorities (as prescribed by the Party Charter and the Law on Denunciation) will not be resolved, but now the complaint is re-declared without any new documents or evidence that would change the nature of the case; complaints with names but the content is not specific.
The Central Inspection Commission has issued Instruction No. 07-HD/UBKTTW on inspection and supervision work serving party congresses at all levels towards the 13th National Congress of the Party.

According to this guideline, Party committees, advisory and support agencies of Party committees and Inspection Committees at all levels shall strengthen supervision, proactively grasp the situation of subordinate Party organizations, especially those with signs of internal disunity, signs of violations, new and complicated issues, and pressing issues that cadres, Party members and the people are concerned about. At the same time, grasp the situation of Party members, focusing on Party committee members, cadres under the management of Party committees at the same level, first of all, key cadres, Party members planned for human resources to participate in the next Party committee and expected to be delegates to the Party congress at higher levels to create the premise and basis for inspection work to serve Party congresses at all levels.
Resolutely screen and do not allow into the new Party Committee those who are not politically steadfast; have reduced qualities, capacity, and prestige; lack exemplary behavior, lack solidarity, are parochial, factional, opportunistic, do not defend what is right, do not dare to fight what is wrong; show signs of degradation in political ideology, ethics, lifestyle, "self-evolution", "self-transformation"; seek positions, seek power, corruption, negativity, "group interests"; violate the principle of democratic centralism, current regulations and rules of the Party and State, political standards and things that Party members are not allowed to do; are bureaucratic, authoritarian, lack close ties with the people; themselves or their spouses and children violate Party regulations, State policies and laws, affecting the prestige of the agency, unit, and the cadres themselves; and have low performance results.
Coordinate with relevant agencies to promptly, fully and carefully receive, classify and process information sources, reports and reflections on party organizations and party members; if signs of violations are detected, promptly consider and decide to conduct an inspection when there are signs of violations. If party members who are cadres under the management of the Politburo or Secretariat are detected to have signs of violations, promptly report to the Central Inspection Commission.
Focus on inspecting party organizations that show signs of internal disunity, violations of the principle of democratic centralism, working regulations, violations of resolutions, directives, regulations of the Party, policies and laws of the State; signs of corruption, waste, "group interests", especially in the fields of financial management, investment projects, capital construction, equitization, enterprise valuation, divestment of state capital, land, mineral resources, public asset procurement, organization and personnel work...; signs of violations in handling denunciations and complaints or allowing backlog of denunciations and complaints affecting the legitimate rights and interests of party members and citizens.
Focus on inspecting cadres and party members who show signs of degradation in political ideology, ethics, lifestyle, "self-evolution", "self-transformation"; violating party member standards, party committee member standards, on declaration and transparency of assets and income; corruption, waste; individualism, factionalism, opportunism, pragmatism; violating resolutions, directives, regulations of the Party, policies and laws of the State; violating regulations on exemplary responsibility and things that cadres and party members are not allowed to do.
For cases under its jurisdiction but with complicated content, involving many people, many sectors, and many levels, the Inspection Committee must proactively and promptly report to the Standing Committee of the Party Committee at its level to establish an inspection team to review and conclude; at the same time, report to the Inspection Committee at a higher level.
After inspection, it is necessary to consider, decide or propose the competent party organization to consider and decide on disciplinary action against violating party organizations and party members (if any). The consideration and handling must be completed 25 working days before the opening date of the congress for the grassroots level and 30 working days for the upper-grassroots level.
Actively classify and review to clearly identify denunciations that do not need to be resolved; denunciations and reflections sent to agencies and organizations that do not have the authority to resolve. At the same time, based on the content of the denunciation, the accused and regulations on decentralization of cadre management and appointment, introduction of candidates to specifically and fully identify denunciations that are within the authority to resolve.
- In case of denunciations against party organizations or party members that are under the authority but have not been considered or resolved, or are being resolved but cannot be completed before the opening of the congress due to insufficient time as prescribed, promptly report to request direction from the Standing Committee of the Party Committee at one's level; at the same time, report to the Inspection Committee at a higher level.
- In case of denunciations related to congresses received within 25 working days for the grassroots level and 30 working days for the higher level or higher from the date of receipt of the denunciation to the opening date of the congress, they will not be resolved, but must be fully summarized, reported to the Standing Committee of the Party Committee at the same level, the Inspection Committee at the higher level and the file transferred to the Inspection Committee and the Standing Committee of the new Party Committee for consideration and resolution.
- In case the denunciation is not within the scope of resolution of the Party Committee, Party organization, or Inspection Committee, based on the subject of the denunciation and the content of the denunciation, the Inspection Committee shall report to the Party Committee for direction or transfer to agencies and organizations for resolution according to their authority.
- In case the denunciation is not within the functions, responsibilities and authority of the Inspection Committee, advise the Party Committee to direct relevant Party organizations and agencies to preside over or direct the settlement according to Decision No. 210-QD/TW dated November 8, 2013 of the Politburo promulgating the Regulations on handling denunciations against Party members who are cadres under the management of the Politburo and the Secretariat and regulations of Party Committees at all levels on handling denunciations against Party members who are cadres under the management of the Party Committee; assist the Party Committee in supervising and urging the settlement to be completed before the opening of the congress according to regulations.
- In case the denunciation has many contents, related to the responsibility of many agencies and organizations, the Inspection Committee shall preside over the settlement. When settling, the Inspection Committee shall coordinate and request relevant agencies and organizations to send cadres to join the denunciation settlement team. If necessary, the Inspection Committee and relevant Party organizations shall report to the Standing Committee of the Party Committee at the same level to assign a presiding agency, with the coordination of relevant agencies or the Standing Committee of the Party Committee shall decide to establish a denunciation settlement team according to the regulations on denunciation settlement within the Party.
- In case the denunciation has a name but there is no basis or conditions for settlement according to regulations, the Party Committee, Party organization, and Inspection Committee at all levels must notify the denouncer of the reason for stopping the continued denunciation.
Do not resolve anonymous, fake, or unknown-address denunciations and denunciations with names that have been considered and concluded by competent authorities (as prescribed by the Party Charter and the Law on Denunciations), but are now denounced again but without additional documents or new evidence that change the nature of the case; denunciations with names but the content is not specific, without basis for examination and verification; denunciations with names, but the content of the denunciation does not contain or reflect the content of the denunciation against party members or party organizations; denunciations that are not directly signed by the denouncer; denunciations signed by two or more people; denunciations by people without civil act capacity.
Concentrate forces and closely coordinate between the Inspection Committee and relevant agencies and organizations to resolve denunciations; first of all, denunciations of party organizations and party members directly related to the organization of party congresses, related to the personnel of the new Party Committee and delegates to the Party Congresses at all levels. Through resolving denunciations, it is necessary to clearly conclude right and wrong; promptly and strictly handle party organizations and party members who violate the law and must end before the opening day of the congress according to regulations.
The Party Committee and the Inspection Committee of the Party Committee convene a congress to focus on reviewing party disciplinary complaints related to the personnel of the new Party Committee and delegates to the Party Congress at all levels if the complaints are sent to the Party Committee and the Inspection Committee 25 working days before the opening date of the congress for the grassroots level and 30 working days for the higher levels; if the party disciplinary complaints are sent after the above deadline, they will be transferred to the Party Committee and the Inspection Committee of the new Party Committee for consideration and resolution.
