Defendant Le Dinh Thuan - former Chairman of Dong Tam Commune People's Committee was determined to have committed the crime multiple times. The Procuracy proposed a sentence of 48-60 months in prison.
On August 9, entering the second day of the trial of the land violation case in Dong Tam commune, My Duc district, Hanoi, the presiding judge decided to stop the questioning and move on to the debate. At the beginning of the debate, the Procuracy announced the indictment.
The prosecutor's indictment said that, through public questioning at the trial, most of the defendants admitted their guilt, some defendants only admitted part of their mistakes, but the People's Procuracy had sufficient grounds to conclude the defendants' actions.

Accordingly: From 2002 to 2013, due to lax State management of land in Dong Tam commune, the defendants, former commune leaders, for personal gain, granted and allocated land (in excess of authority), legalizing encroached land for a number of households in violation of regulations.
The prosecutor said that the defendants' fault was intentional, causing serious consequences, so it is necessary to deal with them seriously.
The four defendants Nguyen Van Son - former Chairman of Dong Tam Commune People's Committee, Le Dinh Thuan - former Chairman of Dong Tam Commune People's Committee, Nguyen Xuan Truong - former cadastral officer of Dong Tam Commune and Nguyen Tien Trien - former Secretary of Dong Tam Commune Party Committee committed crimes many times.
Among them, Nguyen Xuan Truong is a land officer who was determined to know that his actions were illegal but still carried them out, showing disregard for discipline and the law.
The People's Procuracy determined that Truong played a key role in the case, so a severe sentence was necessary.
In addition, other defendants have committed acts of profiteering, knowing their wrongdoings but still violating, so it is necessary to punish them severely to have enough deterrence for them.

The four defendants are former district-level officials, including the Department of Natural Resources and Environment, who did not properly perform their assigned duties and responsibilities, leading to violations in land management that upset the people. These defendants signed land certificates for households illegally, so a strict prison sentence is necessary.
The prosecution also said that the defendants had no aggravating circumstances. Based on the mitigating circumstances, the People's Procuracy proposed the following sentences for the defendants: 1. Nguyen Van Son – former Chairman of Dong Tam Commune People's Committee: 30-36 months in prison 2. Le Dinh Thuan - former Chairman of Dong Tam Commune People's Committee: 48-60 months in prison 3. Nguyen Xuan Truong - former cadastral officer of Dong Tam commune: 7-8 years in prison 4. Nguyen Tien Trien - former Party Secretary of Dong Tam commune: from 36 to 42 months in prison 5. Nguyen Van Bot – former Chairman of Dong Tam Commune People's Committee: 18-24 months suspended sentence 6. Nguyen Van Duc - former Chairman of Dong Tam Commune People's Council: 24-30 months in prison 7. Bui Van Dung - former Head of the Finance Committee of Dong Tam commune: 24-30 months in prison 8. Regarding the civil aspect, the People's Procuracy requested the People's Court to maintain the status quo of the land that people have used for a long time and stably. The land that was given to people but violated the planning must be resolutely recovered. The defendant Truong must pay back 2.5 million VND due to the illegal land sale.
