The first-instance trial of former National Assembly delegate Chau Thi Thu Nga is scheduled to open on the morning of October 2 and last for 18 days.

Tomorrow morning, as planned, the Hanoi People's Court will open the first instance trial of Ms. Chau Thi Thu Nga (52 years old, former National Assembly delegate, former Chairman of the Board of Directors of Housing Group) for the crime of Fraudulent appropriation of property.

Appearing in court with Ms. Nga were 9 subordinates, former deputy general directors, chief accountants, and transaction office directors of Housing Group.

According to the indictment, HAIC Import-Export and Housing Development Construction Investment One Member Co., Ltd., led by Mr. Nguyen Van Tuan (Chairman of the Board of Directors and General Director), was assigned and leased land by the State for production and business purposes. This included land lot B5 (an area of ​​nearly 29,000 m2, in Cau Dien town), located in the resettlement construction project in lots CT1 and HH2.

On August 1, 2008, Mr. Tuan and Ms. Nga signed an investment cooperation contract to implement the investment project to build an apartment complex and garden villas on land lot B5, with a total area of ​​over 22,000 m2. The project is expected to include 3 21-storey apartment buildings and 36 garden villas, with a total investment of nearly 280 billion VND. HAIC contributed 40% of the capital, Housing Group 60%.

On November 23, 2010, the Hanoi People's Committee approved the joint venture between the two legal entities. HAIC and Housing Group made a plan to adjust the entire land plot. However, the B5 project has not been approved by competent authorities.

According to the accusation, in order to have money to spend on the general activities of Housing Group, to implement the B5 Cau Dien project and other projects, as well as spending, Ms. Nga committed a series of violations.

House sold without construction permit

According to the accusation, knowing that the B5 Cau Dien project had not been approved for adjusted planning and had not been granted a construction permit, so it was not allowed to mobilize capital from customers, Ms. Nga still directed her subordinates to 'sell apartments on paper'.

Specifically, to legalize the capital mobilization procedures of customers when being inspected by competent authorities, although no Board of Directors meeting was held, Ms. Nga still directed the drafting of the Board of Directors' resolution dated January 2, 2009. Customers signing a loan contract for production and business purposes (or loan agreement) with Housing Group, in addition to receiving an interest rate of 0.6% per month, will have the right to buy an apartment in the B5 Cau Dien Project. The contract at each time is called a Deposit Contract, Capital Contribution Contract, Loan Agreement, Capital Contribution Agreement...

In order to build trust with customers, since 2009, Ms. Nga has directed the posting of information on the company's website with advertising content for the project designed with 6 modern buildings, starting construction in the third quarter of 2010 and completed in the fourth quarter of 2015. The model is placed right at the headquarters for introduction.

When customers arrived at the B5 Cau Dien project site and saw that Housing Group had already started construction, Ms. Nga hired a company to organize the drilling of 59 foundation piles according to an unapproved design.

Authorities allege that from 2009 to 2013, Ms. Nga and her subordinates signed 752 capital mobilization contracts with 726 customers, collecting a total of 377 billion VND. She committed to transferring the right to use 752 apartments from the 2nd to the 33rd floors in the buildings at the B5 Cau Dien Project.

Spending nearly 50 billion to "run projects" and "run for seats"

According to the investigation, of the money collected from the above customers, Ms. Nga directed the payment of nearly 29 billion to 43 customers who withdrew capital, the remaining 348 billion was used for many different purposes.

Specifically, Ms. Nga used 219 billion VND to hire to carry out some items at the Cau Dien B5 Project, paid brokerage commissions to 11 individuals who introduced customers to contribute capital, spent on personal expenses, family expenses, other projects of the Housing Group company, paid salaries to employees... This amount has invoices and accounting documents so it can be clarified.

The remaining 157 billion VND was recorded as Ms. Nga's debt at Housing Group. Of this amount, Ms. Nga declared that she spent 54 billion VND on Mr. Nguyen Xuan Quy (Deputy General Director of Housing Group) who had died and another former Deputy General Director to facilitate the project investment procedures. 30 billion VND was spent on Mr. Tuan for joint investment cooperation.

In particular, Ms. Nga declared that she spent 47 billion to run the project and serve her personal interests. The rest, Ms. Nga declared, was spent for her daughter to study abroad and to pay her salary. Authorities said that because the investigation period had expired, they separated the amount of 157 billion VND for later verification.

The indictment identified Ms. Nga as the mastermind, directing other defendants to commit the crime and the one who used and benefited from all the embezzled money. The other defendants were accomplices but were only salaried employees who followed instructions.
