On the morning of December 23, the Provincial People's Court opened a first-instance criminal trial to try the case of Murder due to exceeding the limits of legitimate self-defense. The person prosecuted before the law is Le Van Thang (born in 1991), residing in Hanh Lam commune, Thanh Chuong. Thang's victim is the older brother of Le Dinh Dung (born in 1986).

In May 2015, Le Dinh Thang was sentenced to 2 years in prison by the Thanh Chuong District People's Court for "Illegal possession of narcotics". In October 2016, Thang returned to his hometown after his sentence was reduced to 4 months early.

On the afternoon of October 25, 2016, Thang and Le Dinh Dung went to a neighbor's house to party and drink. After that, Thang went to pick up his friends. Seeing that his younger brother was gone for too long, Dung called Thang, but Thang did not answer. After finding Thang, Dung asked his younger brother to come home to talk to his parents.

In front of his parents, Thang insisted that he did not use drugs, but Dung did not believe him, leading to an argument between the two brothers. Dung did not let Thang use his phone anymore, so Thang broke it. Seeing his brother break the phone, Dung took a pipe and hit Thang.

The two brothers chased each other to the well. Thang grabbed a knife and told Dung to stop hitting him, "If you hit me again, I will cut you." However, Dung continued to hit Thang on the head and body with the pipe. Thang stabbed him with the knife and was pulled out by his mother and cousin.

Mr. Dung died after being stabbed in the chest, causing a punctured lung. After committing the crime, Le Dinh Thang surrendered to the People's Committee of Hanh Lam commune and confessed his crime. In this case, the victim was also partly at fault, so considering the nature of the crime, the Provincial People's Procuracy prosecuted Le Dinh Thang before the law for the crime of "Murder beyond the limits of legitimate defense".

Considering the case comprehensively, the People's Court sentenced Le Dinh Thang to 9 months in prison.
