Proposal to increase 5% of domestic wastewater fees for car washes, restaurants and hotels

That is the notable content proposed by the Ministry of Finance in the draft decree on environmental protection fees for wastewater to replace Decree 154 of 2016, which was just released for comments on April 17.

According to the current regulations stated in Decree 154, the environmental protection fee for domestic wastewater is 10% of the selling price of 1m3 of clean water excluding value added tax. In case it is necessary to apply a higher fee, the People's Council of the province or centrally-run city shall decide on a specific fee suitable to the actual situation in the locality.

However, according to the Ministry of Finance, some localities including Da Nang, Dong Nai, An Giang believe that the regulation that car washes, motorbike washes, car and motorbike repair shops, restaurants and hotels must pay environmental protection fees for domestic wastewater like individuals and households is unfair. Because the wastewater from these establishments has a higher level of environmental pollution.

Wastewater fees for car washes, restaurants and hotels are being proposed to increase by 5%.

Regarding this issue, the Ministry of Finance stated that based on current regulations, in case the wastewater from car washes, motorbike washes, car and motorbike repair facilities, restaurants and hotels is more polluted, the locality can decide on a higher fee.

However, to unify implementation, the Ministry of Finance plans two options:

Option 1: Maintain the current fee rate, which is 10% of the selling price of 1m3 of clean water. In case of a higher fee rate, the People's Council of the province or centrally-run city shall decide on a fee rate appropriate to the actual situation of the locality.

Option 2: The environmental protection fee for domestic wastewater is 10% of the selling price of 1m3 of clean water excluding value added tax.

The fee applied to car washes, motorbike washes, car and motorbike repair facilities, restaurants and hotels is 15% of the selling price of 1 m3 of clean water excluding value added tax.

Nghe An will issue clean water consumption prices in rural areas.

In case it is necessary to apply a higher collection rate, the Provincial People's Council shall decide on a specific rate suitable to the actual situation in the locality.

Also according to the Ministry of Finance, the total amount of environmental protection fees for wastewater collected in 2016 was 1,287 billion VND, and in 2017 was 2,102 billion VND, contributing to increasing funding for environmental pollution reduction work in the locality.
