How is salary calculated for working on April 30 and May 1, 2019?
There is only 1 day left until we enter the 5 major national holidays. However, many businesses still have to arrange for employees to work on holidays. So if employees have to work on April 30 and May 1, 2019, how will their salary be calculated?
Pursuant to Clause 1, Article 115 of the Labor Code, employees are entitled to take leave with full pay on the following holidays and Tet:

- New Year's Day 01 day (January 1st of the solar calendar).
- Lunar New Year 05 days.
- Victory Day 01 day (April 30th).
- International Labor Day 01 day (May 1st).
- National Day 01 day (September 2nd).
- Hung King's Commemoration Day 01 day (10th day of the 3rd lunar month).
And Article 97 of the Labor Code stipulates wages for overtime and night work as follows:
Overtime workers are paid according to the unit price of salary or salary according to the work being done as follows:
- On weekdays, at least 150%.
- On weekly holidays, at least 200%.
- On holidays and paid leave days, at least 300% excluding holiday and paid leave wages for employees receiving daily wages..
Employees working at night shall be paid an additional amount of at least 30% of their wages calculated according to the unit price of wages or wages according to the work of a normal working day.
Employees who work overtime at night, in addition to being paid according to the provisions in Clause 1 and Clause 2 of this Article, shall also be paid an additional 20% of their salary calculated according to the salary unit price or salary according to the work done during the day.
Thus, if an employee has to work on the holidays of April 30 and May 1, the company or enterprise must pay the employee's full salary on that holiday plus at least 300% of the unit price of salary or salary according to the job the employee is doing./.
