Party Charter (adopted by the 7th National Congress of the Party)

The Communist Party of Vietnam, founded and trained by comrade Ho Chi Minh, led the people to successfully carry out the August Revolution, establish the Democratic Republic of Vietnam, successfully conduct resistance wars against invaders, abolish the feudal colonial regime, complete the cause of national liberation, unify the country, firmly protect the independence of the Fatherland, and bring the whole country to the stage of socialist revolution.

CHARTER OF THE COMMUNIST PARTY OF VIETNAM

(Approved by the 7th National Congress on June 27, 1991)

The Communist Party of Vietnam, founded and trained by comrade Ho Chi Minh, led the people to successfully carry out the August Revolution, establish the Democratic Republic of Vietnam, successfully conduct resistance wars against invaders, abolish the feudal colonial regime, complete the cause of national liberation, unify the country, firmly protect the independence of the Fatherland, and bring the whole country to the stage of socialist revolution.

The Party is the vanguard of the Vietnamese working class, faithfully representing the interests of the working class, working people and the entire nation.

The Party's goal is to build a democratic, prosperous Vietnam along the socialist path and ultimately realize the communist ideal.

The Party takes Marxism-Leninism and Ho Chi Minh Thought as its ideological foundation and guideline for action, absorbs the intellectual quintessence of the nation and of humanity, grasps the objective laws and practices of the country to set out a correct political platform and revolutionary line that is consistent with the requirements and aspirations of the people.

The Party closely combines true patriotism with working-class internationalism, supporting the struggle for peace, national independence, democracy and social progress of the people of the world.

The Party is closely attached to the people, respects the people's right to mastery and is subject to their supervision, unites and leads the people in carrying out the revolutionary cause. The Party leads the political system and is at the same time a part of that system. The Party respects the role of the State, the Vietnam Fatherland Front and people's organizations, and operates within the framework of the Constitution and the law.

The Party is a unified bloc of will and action, taking democratic centralism as the basic organizational principle, implementing collective leadership and individual responsibility, self-criticism and criticism, practicing full democracy and strict discipline in Party activities; maintaining solidarity and unity within the Party on the basis of the Political Platform and Party Statutes.

The Communist Party of Vietnam must be built strong politically, ideologically and organizationally, constantly renewing and self-rectifying to successfully fulfill the task of leading the Vietnamese revolution and actively contributing to the revolutionary cause of the people of the world.

Chapter I

Party member

Article 1:

Vietnamese citizens aged eighteen and over can be considered for admission to the Party if: they acknowledge and voluntarily strive to implement the Party's Political Platform and Statutes, work in a grassroots Party organization, obey Party discipline, and are ready to accept assigned tasks; are exemplary in work, combat, and study, have a healthy, non-exploitative lifestyle; have the knowledge and capacity to perform Party member duties; are closely attached to the masses, are trusted by the masses, and have proven themselves to be outstanding in practice.

Article 2:

Party member's duties:

1. Absolutely loyal to the Party's revolutionary ideals, strictly comply with the Party's domestic and foreign policies and guidelines, the State's laws and assigned tasks.

2. Respect the people's right to mastery; care for the people's material and spiritual life; actively participate in mass work and social work at the workplace and residence; propagate and mobilize families and people to implement guidelines, policies and laws.

3. Continuously study and practice to improve political level, knowledge, working capacity, revolutionary ethics; fight against all negative manifestations.

4. Participate in building and protecting the Party's guidelines, policies and organization; obey discipline, maintain solidarity and unity within the Party; regularly self-criticize and criticize, be honest with the Party; propagate and develop the Party's influence, recruit new Party members, participate in Party activities and pay Party dues according to regulations.

Article 3:

Party member rights:

1. Be informed and discuss issues regarding the Party's guidelines, policies and work; vote on the Party's work.

2. Be eligible to run for, nominate and vote for leadership bodies at all levels according to the instructions of the Central Executive Committee.

3. To criticize and question the activities of the Party organization and Party members at all levels within the organization; to report, express opinions or make complaints to the Party's leadership bodies and request responses.

4. To express opinions when the Party organization comments, decides on work or takes disciplinary action against you.

Probationary Party members have the above rights, except the right to vote, run for election and elect the Party's leadership bodies.

Article 4:

Procedures for admitting people into the Party:

a) People applying to join the Party must:

- Have a voluntary application to join the Party;

- Report personal history to the Party cell;

- Introduced by two party members;

In places where the Ho Chi Minh Communist Youth Union is organized, applicants for Party membership must be youth union members and be introduced by the grassroots Youth Union executive committee and a Party member.

b) The referrer must:

- At least two years of Party membership and working with the applicant for at least one year.

- Report to the Party cell about the background, qualities, and abilities of the person applying to join the Party and be responsible for his/her guarantee. If there is anything unclear, report it to the Party cell and superiors for consideration.

c) Responsibilities of Party cells and Party committees:

- Before the Party cell considers and decides to admit a new member, the Party cell must re-examine the conditions of the applicant and get public opinions about that person. If the applicant has a political history problem, it will be resolved according to the regulations of the Central Executive Committee.

- The Party cell organizes a conference to consider and decide to admit each person, with the consent of at least two-thirds of the official Party members in the cell.

- The resolution of the Party cell on admitting Party members must be approved by the grassroots Party Committee (if any), and approved by the immediate superior Party Committee of the grassroots Party organization or the authorized grassroots Party Committee for each person.

d) In places where there is no grassroots party organization, no party members, or there are party members who do not meet the requirements for introduction, the higher-level Party Committee will directly send party members to do propaganda, investigation, and introduction work to consider admitting people into the Party.

Article 5:

A person admitted to the Party must undergo a probationary period of twelve months, calculated from the date the Party cell announces the admission. During the probationary period, the Party cell continues to educate, train and assign official Party members to help that Party member progress.

When the probationary period ends, the Party cell will consider and recognize each person as an official Party member and vote as when considering admission; if the person is found to be unqualified as a Party member, the Party cell will decide to remove the name from the list of probationary Party members and report to the Party Committee that approved the admission for re-examination.

The resolution of the Party cell on the recognition of official Party members must be approved by the competent Party Committee according to Point c, Article 4.

Party age of a party member is calculated from the date the party cell recognizes him/her as an official party member.

Article 6:

The issuance and management of party membership cards, management of party membership records and procedures for transferring party activities are prescribed by the Central Executive Committee.

Article 7:

Old and weak party members who request to be exempted from party work and activities will be considered and decided by the party cell.

Article 8:

Party members who do not participate in Party cell activities or do not pay Party dues for three months in a year without a valid reason, or whose will to strive has declined, who do not perform Party member duties, and have been educated by the Party cell and given a time limit for improvement but have not made progress, the Party cell shall consider and decide to remove their names from the Party member list.

Party members who request to leave the Party will be considered and decided by the Party cell.

In the above cases, the Party cell reports to the competent Party Committee to approve the admission of Party members for re-examination.

Chapter II

Organizational principles and organizational structure of the Party

Article 9:

The Communist Party of Vietnam is organized according to the principle of democratic centralism. The basic content of that principle is:

1. The Party's leadership bodies at all levels are established by election.

2. Party leadership bodies at all levels implement the principle of collective leadership and individual responsibility.

3. Party executive committees at all levels report and are responsible for their activities to the congresses at the same level, to the Party executive committees at higher and lower levels; periodically inform the subordinate Party organizations about their activities, and strictly implement the self-criticism and criticism regime.

4. The Party's resolutions must be strictly implemented. The minority must obey the majority, the lower levels must obey the higher levels, the individual must obey the organization, and organizations within the entire Party must obey the National Congress of Delegates, the National Conference of Delegates, and the Central Executive Committee.

5. Resolutions of the Party's leading bodies must be voted on with the approval of more than half of the members of that body. Before voting, Party members are allowed to express all their opinions. Party members with minority opinions have the right to reserve and report to the higher-level Party Committee up to the National Congress, but must strictly comply with the resolution and must not disseminate opinions contrary to the Party's resolution. The competent Party Committee shall study and consider such opinions. If practice proves them correct, it shall accept them. Party organizations must not discriminate against Party members with minority opinions.

6. Lower-level party organizations have the right to decide on issues within their authority, but must not be contrary to the Party's guidelines and policies, the State's laws, and resolutions of higher levels.

Article 10:

The Party's organizational system is basically organized according to the State's administrative system; the Party organization in the Vietnam People's Army is according to the provisions of Article 29; sectors with specific characteristics are organized vertically into sectoral Party committees according to the decision of the Central Executive Committee.

Grassroots party organizations are established according to administrative, economic or work units, under the leadership of district, county, town or provincial city Party Committees.

If necessary, the Central Executive Committee may decide to establish a Party Committee (including a number of grassroots Party organizations with specific characteristics) directly under the Central Executive Committee. In provinces and cities, if approved by the Central Committee, similar Party Committees may also be established directly under the provincial and municipal Party Committees. The Party Committee that decides to establish a Party Committee shall stipulate the organization, tasks, powers, and relationship of this Party Committee with the local Party Committee where the unit is located, according to the guidance of the Central Executive Committee.

The establishment or dissolution of a party committee is decided directly by the superior party committee.

Article 11:

The highest leadership body of the Party at each level is the congress of delegates; at the grassroots level, it is the congress of delegates or congress of party members.

Party committees convene congresses on time, notify the Party committee in advance of the time and content of the congress, and raise issues for discussion at the congress so that subordinates can contribute their opinions in advance.

When the Party Executive Committee deems it necessary, or when more than half of the subordinate Party Committees request it and the immediate superior Party Committee agrees, an extraordinary congress shall be convened.

The Party Committee convening the congress decides on the number of delegates and allocates them to the subordinate Party Committees based on the number of Party members, the number of subordinate Party Committees, and the important position of each Party Committee, according to the instructions of the Central Executive Committee.

Delegates to the congress include members of the executive committee at the level that convened the congress and delegates elected by the congress of delegates or the congress of party members at lower levels.

The appointment of delegates is only carried out for party organizations operating under special conditions where it is not possible to hold a congress for election, according to regulations of the Central Executive Committee.

Delegates attending the congress must be examined by the congress for their qualifications and voted to be approved. The Party Committee convening the congress cannot reject the qualifications of delegates elected by the lower-level Party Congress, except in cases where the delegates have been suspended from Party activities, prosecuted before the law, or detained. If the election is not conducted in accordance with the principles and procedures, a re-election must be held.

A congress or conference of delegates, congress or conference of party members at a grassroots party organization is only valid when at least two-thirds of the summoned delegates or party members attend, representing at least two-thirds of the subordinate party organizations.

Congresses and conferences elect a presidium or chairman to run the work of the congress or conference.

Article 12:

Between two congresses, the leading body is the Party Executive Committee (abbreviated as the Party Committee) elected by the congress at the same level.

The number of members of the Central Executive Committee is decided by the National Congress of Delegates; the number of members of the Party Executive Committee at any level is decided by the Congress of Delegates or the Congress of Party Members of that Party Committee at that level, according to the guidance of the Central Executive Committee.

Party executive committees at all levels need to be partially renewed and ensure continuity through each congress. Those elected to the executive committee must meet the standards of quality and capacity, especially having a strong political stance and a spirit of innovation, having been trained in practice, having the knowledge and capacity to participate in collective leadership and complete assigned tasks, having the ability to gather cadres to carry out tasks, and being trusted by party members and the masses.

The congress presidium organizes and guides the election. Delegates have the right to comment and question the candidates and nominees. The election list must be discussed and approved by the congress. The election is by secret ballot. The elected person must receive a vote of confidence equal to more than half of the delegates or party members summoned.

Article 13:

The term of office of the Party Executive Committee at all levels is the time between two congresses at each level.

The executive committee and the secretary of the lower-level executive committee must be directly approved by the higher-level Party Committee.

In case of real necessity, the immediate superior Party Committee may mobilize or appoint additional members of the lower-level Executive Committee, but not more than one-third of the number of members elected by the congress. Before mobilizing or appointing additional members, the superior Party Committee shall consult the lower-level Party Committee. The conference of delegates may elect additional members of the Executive Committee to fill the vacancy and to elect additional members, but the number of additional members elected shall not exceed 10% of the number of Executive Committee members elected by the Party Congress.

For newly established party committees, if a congress cannot be held immediately, the immediate superior executive committee shall appoint a provisional executive committee; within one year at the latest, a congress must be held to officially elect the committee.

Article 14:

Executive committees at all levels establish support agencies (committees, sub-committees) and regulate the organization, tasks, powers, and working regulations of these agencies according to the guidance of the Central Executive Committee. When necessary, Party committees can establish support agencies and dissolve them when their work is completed.

Article 15:

Between two congresses of delegates, the Party Executive Committees at all levels (except for grassroots Party Committees) convene delegates' conferences.

The composition of the conference of delegates includes members of the executive committee at the level that convened the conference and delegates appointed by the executive committee at the lower level.

The conference of delegates has the task of discussing the report of the executive committee; deciding on policies and measures to promote the implementation of the congress resolution or supplementing the congress resolution to suit the new situation on the basis of the Political Platform, the Party's guidelines, and resolutions of higher levels; electing additional or increasing members of the executive committee according to the provisions of Article 13.

The resolution of the conference of delegates must be convened by the Party Committee and implemented by lower-level Party organizations and Party members.

Additional or increased executive committee members must be approved by the immediate superior committee.

Chapter III

Central Party leadership body

Article 16:

The National Congress of Delegates is convened by the Central Executive Committee every five years. In special circumstances, it may convene earlier or later, and the reasons must be clearly announced to the entire Party; the delay in convening must not exceed one year.

Article 17:

The National Congress of Delegates has the task of reviewing and approving the report of the Central Executive Committee; deciding on the Party's domestic and foreign policies and basic tasks; deciding on or supplementing and amending the Political Platform and the Party's Charter; and electing the Central Executive Committee.

Article 18:

The Central Executive Committee has the task of leading the Party's work between two National Congresses, organizing the implementation of the resolutions of the Congresses and the National Conference of Delegates; deciding on important issues regarding internal and external affairs, mass work and Party building; relations with communist and workers' parties, progressive political parties and organizations in the world; deciding and implementing cadre policies and cadre management; establishing committees, party delegations, and executive committees and directing their activities; regulating the principles of collecting party dues and managing the Party's finances.

The Central Executive Committee holds regular meetings every six months; when necessary, holds extraordinary meetings; every six months reports on the general situation and work done to subordinates; when necessary, raises issues for subordinates to contribute opinions.

Article 19:

The Central Executive Committee elects the Politburo and the General Secretary from among the Politburo members; establishes the Secretariat consisting of a number of Politburo members assigned by the Politburo and a number of Central Secretaries elected by the Central Executive Committee; and elects the Central Inspection Committee. The number of Politburo members, Central Secretaries and Central Inspection Committee members is decided by the Central Executive Committee.

The Politburo leads the Party's activities between two sessions of the Central Committee on the basis of resolutions of the National Congress of Delegates, resolutions of the National Conference of Delegates and resolutions of the Central Committee; reports its work to regular meetings of the Central Committee or at the request of the Central Committee.

The Secretariat leads the daily work of the Party, directs and inspects the activities of Party organizations and Party members in implementing the Party's resolutions and directives; directs Party building, personnel work and mass work; organizes and directs the preparation of issues to be presented to the Politburo for discussion and decision.

Chapter IV

Local Party leadership

Article 20:

The congresses of the Party Committees of provinces, cities, centrally-run special zones, districts, towns, and provincial cities are convened by the Party Committees of the same level every five years; in special circumstances, with the consent of the immediate superior Party Committee, they may convene earlier or later and the reasons shall be clearly announced to the entire Party Committee; the delay in convening shall not exceed one year.

Article 21:

The Party Congress has the task of discussing issues raised by the higher-level Party Committee; reviewing and approving reports of the Executive Committee; deciding on important tasks and policies within the locality; electing the Party Executive Committee and electing delegates to attend the higher-level Congress.

Article 22:

The Party Executive Committee of a province, city, or special zone directly under the Central Government (hereinafter referred to as the Provincial Party Committee, City Party Committee, or Special Zone Party Committee), the Party Executive Committee of a district, county, town, or city under a province (hereinafter referred to as the District Party Committee, District Party Committee, Town Party Committee, or City Party Committee) has the task of leading the activities of the Party Committee between two congresses of delegates; implementing the Party's guidelines and policies, resolutions of congresses of delegates, conferences of delegates, and resolutions and directives of higher-level Party Committees; participating in the development and concretization of the Party's guidelines and policies; deciding on important issues regarding the Party Committee's policies and tasks; establishing Party committees and delegations and directing their activities; managing cadres; and managing the Party Committee's finances.

Provincial Party Committee, City Party Committee, Special Zone Party Committee, District Party Committee, County Party Committee... conferences are convened by the Standing Committee every three months; when necessary, extraordinary meetings can be convened.

Party executive committees at all levels report their activities to higher levels according to regulations, and every three months report the general situation and work done to lower-level party organizations; when necessary, raise issues for lower-level organizations to contribute opinions.

Article 23:

Provincial Party Committee, City Party Committee, Special Zone Party Committee, District Party Committee, County Party Committee... conferences elect the Standing Committee, elect the Secretary and Deputy Secretary from among the Standing Committee members, and elect the Inspection Committee.

The number of standing committee members and inspection committee members is decided by the executive committee conference according to the guidance of the Central Executive Committee.

The Standing Committee leads the activities of the Party Committee between two sessions of the Executive Committee on the basis of resolutions of the congresses of delegates, conferences of delegates, conferences of the Executive Committee and resolutions and directives of higher levels; reports on the general situation and work done at regular meetings of the Executive Committee or at the request of the Executive Committee; prepares issues to be brought to the Executive Committee meetings for discussion and decision.

The Secretary and Deputy Secretary, based on the resolutions of the Executive Committee, the Standing Committee and the resolutions and directives of higher levels, direct and inspect the implementation; handle the daily work of the Party Committee; prepare issues to be presented to the Standing Committee for discussion and decision.

Chapter V

Party grassroots organization

Article 24:

Grassroots Party cells and grassroots Party committees (collectively referred to as grassroots Party organizations) form the foundation of the Party. Grassroots units (communes, wards, towns, agencies, cooperatives, enterprises, companies, schools, hospitals, scientific research institutes, grassroots units in the armed forces, and other grassroots units) with three or more official Party members can establish a Party cell; if there are not enough three official Party members, the immediate superior Party Committee will introduce Party members to participate in activities at a nearby grassroots Party organization.

In basic units or a part of a basic unit (workshop in an enterprise, hamlet in a commune, department in a school, etc.) with thirty or more party members, many party cells can be established, placed directly under the basic party committee.

In the following cases, the grassroots Party Committee must report and receive approval from the immediate superior Party Committee before implementation:

- Organizing many party cells in a grassroots unit or a department in a grassroots unit with less than thirty party members.

- Only establish one Party cell in a grassroots unit or a department in a grassroots unit with more than fifty Party members.

- Establishing party cells within the grassroots party committee.

The Party Committee of a commune, ward or town includes Party cells in villages, hamlets, streets and socio-economic units of the commune, ward or town.

Party organizations in units operating far from the base unit are directly under the local Party Committee where the unit operates.

Article 25:

The congress of delegates or congress of party members of a grassroots party organization is convened by the grassroots party committee twice a year. The congress discusses issues brought down by higher levels; considers and approves reports of the party committee; decides on tasks and work policies; elects the party committee; and elects delegates to attend the congress at higher levels.

The grassroots Party Committee holds regular meetings once a month and extraordinary meetings when necessary.

A grassroots Party Committee with nine or more members elects a standing committee; elects a secretary and deputy secretary from among the standing committee members.

Article 26:

Tasks of grassroots party organizations:

1. Thoroughly grasp the Party's guidelines and policies and, based on the unit's situation, propose the Party Committee's policies and tasks; inspect the implementation and ensure that Party resolutions and State laws are strictly followed.

2. Lead the masses to fulfill the unit's tasks, care for the material and spiritual life of the masses, build close ties with the masses; build the government, management apparatus, militia and self-defense forces, people's security and people's organizations.

3. Building the Party Committee and cadres in the unit: taking care of political and ideological education, training revolutionary ethics, improving the knowledge level and working capacity of Party members; propagating and developing the Party's influence among the masses and recruiting new Party members; improving the quality of Party activities, conducting self-criticism and criticism, inspecting Party members' compliance with the Party Charter, maintaining discipline and strengthening the Party's solidarity and unity; building and managing the cadres and Party members; collecting and paying Party fees.

4. Participate and lead the masses in building the Party's guidelines and policies and the State's laws; grasp the opinions and aspirations of the masses to promptly resolve and honestly report the situation and activities of the Party Committee to superiors.

The Party Committee of a grassroots Party organization with one hundred or more Party members, if decided by the immediate superior Party Committee of the grassroots Party organization, shall have the same rights as the immediate superior Party Committee of the grassroots Party organization in approving the admission of people into the Party and enforcing disciplinary action to expel Party members.

Article 27:

The Party cell is the place that directly connects the Party with the masses, organized according to the workplace or residence of the Party member. The Party cell has the task of educating, training, managing, assigning and inspecting the work of Party members, admitting new Party members and enforcing Party member discipline, and leading the implementation of tasks within the unit.

The Party cell congress is convened by the Party cell executive committee once a year. The congress discusses issues brought down by higher levels and reports from the Party cell executive committee, decides on the Party cell's tasks, elects the Party cell executive committee and elects delegates to attend the higher-level congress.

A Party cell with less than nine official Party members shall elect a Party cell secretary; if necessary, a deputy secretary. A Party cell with nine or more official Party members shall elect a Party cell executive committee (abbreviated as the Party cell committee); and elect a Party cell secretary and deputy secretary from among the Party cell committee members.

The Party cell secretary and Party cell executive committee must be approved by the grassroots Party committee; if it is the Party cell executive committee of a grassroots Party cell, it must be approved by the immediate superior Party committee of the grassroots Party organization.

The Party Committee meets regularly once a month.

The Party cell meets regularly once a month to discuss and implement resolutions and directives from higher levels; review and propose tasks for the Party cell; and assign work to Party members.

A party cell with many party members can be divided into many party cells; the party cells elect a cell leader; the cell leader works under the direction of the party cell committee.

Chapter VI

Party organization in the Vietnam People's Army and the Vietnam People's Public Security

Article 28:

The Party absolutely and directly leads the Vietnam People's Army and the Vietnam People's Public Security in all aspects according to the regulations prescribed by the Central Executive Committee.

The Party leads the building of the Vietnam People's Army and the Vietnam People's Public Security to be strong in politics, ideology and organization, absolutely loyal to the Fatherland, wholeheartedly serving the people, being the core force together with the entire people to firmly protect the socialist Vietnam Fatherland, maintain political security and social order and safety, and participate in national construction.

The committees of the Party Committee, according to their functions, assist the Party Committee in guiding and inspecting the Party building work and mass work in the Vietnam People's Army and the Vietnam People's Public Security.

Article 29:

The Party organization in the Vietnam People's Army is organized vertically, operating according to the Party Platform, Statutes and resolutions of the Central Executive Committee.

The Central Military Party Committee (CMC) is appointed by the Central Executive Committee, consisting of a number of Central Executive Committee members working in the military and a number of Central Executive Committee members working outside the military, under the leadership of the Central Executive Committee, usually the Politburo and the Secretariat. The Central Military Commission is responsible for researching and proposing to the Central Executive Committee to decide on issues related to military and defense policies and tasks, and at the same time leading all aspects of work in the military.

The Party Executive Committee at each level is elected by the congress at that level and is responsible for leading its subordinate units in all aspects; in special cases, it is appointed by the higher-level Party Committee according to regulations of the Central Executive Committee.

The General Political Department undertakes Party and political work for the entire army, operating under the leadership of the Secretariat and under the direct and regular direction of the Central Military Commission. At each level, there are political agencies and political cadres undertaking ideological and organizational work under the direct leadership of the Party Committee at their level and the direction of the political agency at a higher level.

Article 30:

Party organizations in local military agencies and local army units are under the leadership of local Party Committees in all aspects, and at the same time have the task of implementing resolutions of higher-level military Party Committees on national defense tasks and local military work. Higher-level political agencies coordinate with local Party Committees in directing Party building work and mass work in local armed forces.

Article 31:

Party organizations in the Vietnam People's Public Security force are prescribed by the Central Executive Committee.

Chapter VII

Inspection committees at all levels

Article 32:

Inspection committees at all levels are elected by the Party Executive Committee at the same level, including a number of comrades in the Party Committee and a number of comrades outside the Party Committee.

The head of the lower-level inspection committee must be approved by the immediate superior Party Committee. If transferred to another job, he/she must be approved by the immediate superior Party Committee.

Inspection committees at all levels work on a collective basis under the leadership of the Party Committee at the same level, report to regular conferences of the Party Committee and operate according to the tasks and powers prescribed by the Party Charter.

Article 33:

Duties of inspection committees at all levels:

1. Inspect party members (including members of the same-level committee) and lower-level party organizations to comply with party organization and activity principles and preserve the revolutionary moral qualities of party members; consider and conclude cases of disciplinary violations and, based on the authority specified in Article 36, decide or propose to the party committee to decide on disciplinary action.

2. Check the compliance with working regulations of lower-level Party committees.

3. Inspect the implementation of discipline of lower-level party organizations.

4. Inspect the finances of lower-level Party committees and of the financial agencies of Party committees at the same level.

5. Resolve denunciations regarding the contents specified in Point 1, Article 33 regarding Party members and lower-level Party organizations.

6. Resolve complaints about disciplinary action within the Party according to the authority prescribed in Article 36.

Article 34:

Inspection committees at all levels have the right to request lower-level party organizations and party members to report on issues related to the inspection content.

The superior inspection committee has the right to inspect the activities of the subordinate inspection committee.

Chapter VIII

Party discipline enforcement

Article 35:

The enforcement of discipline within the Party must be fair, accurate, and timely in order to maintain unity of will and action, strengthen the Party's fighting strength, and educate Party members.

Depending on the level and nature of the mistakes of the party member and the party organization, the following disciplinary measures will be applied:

For party members: reprimand, warning, dismissal, expulsion.

For party organizations: reprimand, warning, dissolution.

Article 36:

On disciplinary authority:

a) For party members:

1. The implementation of party discipline must be proactively considered by the Party cell. The Party cell has the right to decide to reprimand or warn a Party member; the disciplinary action of expelling a Party member must be voted on by the Party cell conference with the consent of at least two-thirds of the official Party members of the Party cell and must be approved by the grassroots Party Committee (if any), the immediate superior inspection committee of the grassroots Party organization or the authorized grassroots Party Committee.

2. For party members who are cadres managed by higher-level Party Committees but are not members of Party Committees at all levels, and who violate discipline in performing the tasks of the Party cell or in their lifestyle, the Party cell has the right to enforce discipline as prescribed in Point 1, Article 36, but must report to the inspection committee at the level managing that cadre for re-examination.

3. For party members who are cadres managed by a higher-level Party Committee but are not members of the same-level Party Committee or members of the directly lower-level Party Committee, and who commit disciplinary violations in performing tasks assigned by a higher-level Party Committee, the Party cell and the grassroots Party Committee have the right to propose disciplinary measures; the inspection committee at the level managing such cadres shall decide on disciplinary measures of reprimand and warning; the Party Committee at the level managing such cadres shall decide on disciplinary measures of dismissal from office and expulsion.

4. For party members who are members of executive committees at all levels (including members of the Central Executive Committee):

- In case of disciplinary violations in performing the Party cell's tasks or in terms of lifestyle, the Party cell shall decide on reprimands and warnings; if a higher disciplinary measure is needed, the Party cell shall propose to the higher Party Committee.

- Disciplinary violations in the performance of tasks assigned by the Party Committee, the Party Committee that assigns the tasks shall decide on the forms of discipline; the disciplinary measure of expulsion from the Party or removal from office of an Executive Committee member shall be decided by the Executive Committee with the consent of at least two-thirds of the Executive Committee members, approved by the immediate superior Party Committee and reported to the Party Congress at the nearest session; if a Party member participates in many Party Committees, the Party Committee that decides on the discipline shall report to the highest Party Committee that the Party member participates in for approval.

Disciplinary measures of reprimand and warning decided by the Party cell or lower-level Party Committee must be reported to the immediate superior Party Committee and the highest Party Committee in which the Party member participates for re-examination.

Disciplinary action against a branch committee member is decided by the Party cell; the disciplinary action against the removal of a branch committee member from office must be approved by the immediate superior Party Committee.

5. In case a party member violates discipline, although he/she has been reminded by a superior, but the lower-level party organization does not take disciplinary action or takes it improperly, the superior party committee or inspection committee has the authority to directly decide to take disciplinary action or amend the disciplinary level for that party member.

6. When resolving complaints about discipline decided by a lower-level party organization against a party member (including a lower-level committee member) and when inspecting the implementation of discipline by a lower-level party organization, the higher-level inspection committee is authorized to decide to approve, amend or abolish the form of discipline decided by a lower-level party organization, except for the form of expulsion from the Party and removal from office of a member of the executive committee of the directly lower-level party organization.

7. The decision of the superior to discipline the Party Committee member and cadre under the management of the superior shall be notified to the Party cell and the grassroots Party Committee where the Party member is active.

b) For party organizations:

Disciplinary reprimand and warning of a party organization is decided directly by the superior party committee.

The disciplinary measure to dissolve a party organization is decided by the immediate superior party committee with the consent of at least two-thirds of the executive committee members and must be approved by the superior party committee one level higher.

That decision must be reported to the Central Executive Committee and the Central Inspection Commission.

A Party cell, Party committee or Executive Committee shall only be dissolved if it violates one of the following three cases: at least two-thirds of Party members (for Party cells or Party committees) or at least two-thirds of Executive Committee members (for Executive Committees) commit mistakes to the extent of being expelled; the organization has consciously acted against the Party's guidelines and policies; there is sufficient evidence that the organization is not politically trustworthy.

In a dissolved party cell or party committee, a party member who has no shortcomings, or has shortcomings but not to the extent of being expelled, is directly decided by the superior party committee to transfer party activities to a newly established party cell or to another party cell.

Article 37:

Before deciding on disciplinary action, the Party organization is responsible for listening to the opinion of the Party member or representative of the Party organization under consideration for disciplinary action.

After the disciplinary decision has been announced, if the party member or organization subject to disciplinary action disagrees, within three months, the disciplined party member or organization has the right to request the organization that made the disciplinary decision to reconsider and to appeal to the higher-level Party Committee or Inspection Committee up to the Central Executive Committee.

Upon receiving a disciplinary complaint, the Party Committee or the Inspection Committee at a higher level shall notify the complainant; within one month, it shall organize a review. Every three months, the Inspection Committee at a lower level shall report to the Inspection Committee at a higher level on the status of the handling of the disciplinary complaint. The Party Committee and the Inspection Committee at a higher level shall regularly inspect the handling of the complaint by the lower level.

Article 38:

While the resolution on expelling a party member or dissolving a party organization has not been approved by the competent Party Committee or Inspection Committee, that party member is still allowed to participate in party activities and that organization is still active. The temporary suspension of party activities of a party member, of committee activities of a committee member, and of party organization activities is only applied in special cases and must be approved by the competent Party Committee or Inspection Committee according to the regulations of the Central Executive Committee.

Party members sentenced to non-custodial reform or higher must be expelled from the Party.

Article 39:

From six months to one year, after a party member is disciplined with reprimand, warning, or dismissal, the party cell will listen to that party member's report for consideration; if that party member has truly corrected his/her shortcomings, the party cell will acknowledge it and report to the higher-level Party Committee or Inspection Committee; whichever level decides to apply discipline, that level will approve and acknowledge that the party member has corrected his/her shortcomings.

Chapter IX

Party towards state organizations and people's organizations

Article 40:

The Party leads the State and people's organizations through platforms, strategies, policy orientations and working guidelines; through ideological work, organization, personnel and inspection and supervision of implementation.

The Party introduces qualified cadres for state agencies and people's organizations to select and use.

Party organizations and party members working in state agencies and people's organizations must strictly comply with resolutions and directives of Party committees; respect the functions of those organizations; support mass initiatives; set an example in fulfilling civic duties and assigned tasks; and actively contribute to the building of the State and people's organizations.

Article 41:

In the leading agencies of the State and elected people's organizations, the Party Committee at the same level establishes a Party delegation consisting of a number of Party members working in that organization. Where a Party delegation is not established, the Party Committee assigns Party members working in that organization to perform the Party delegation's tasks.

The Party delegation has a secretary; if necessary, a deputy secretary appointed by the Party Committee at the same level. The Party delegation is subject to the leadership of the Party Committee, works collectively and is responsible to the Party Committee.

The Party delegation has the task of mobilizing and persuading members of the leadership and the masses in its organization to implement the Party's guidelines and policies; strengthening the Party's influence and close ties between Party members and non-Party members; researching and presenting to the Party committee the direction, tasks, organization and staff of that organization.

When necessary, the Party delegation convenes Party members in that organization to discuss the Party Committee's policies and discuss implementation measures.

Chapter X

Party to Ho Chi Minh Communist Youth Union

Article 42:

The Ho Chi Minh Communist Youth Union is a reliable reserve force that regularly supplies young people to the Party, continuing the glorious revolutionary cause of the Party and President Ho Chi Minh; is the core force in the youth movement; is a socialist school and represents the interests of the youth.

Party executive committees at all levels directly lead the executive committees of the same level.

Article 43:

Party members who are still in the Youth Union must participate in and work in the Youth Union organization, actively contributing to building a strong Youth Union.

Chapter XI

Party Finance

Article 44:

The Party's finances include party dues paid by party members, revenue from the Party's production and business enterprises, and other revenues.

Article 45:

The Central Executive Committee regulates the principles, revenue and expenditure regimes, financial management of the Party, the level of Party dues paid by Party members, and the regime of collection, payment and use of Party dues.

Every year, executive committees at all levels listen to reports and decide on financial tasks at their level.

Chapter XII

Comply with the Party's regulations

Article 46:

All Party members and Party organizations have the responsibility to strictly comply with and promptly combat all violations of the Party Charter.

Article 47:

Only the National Congress has the right to amend the Party Charter.
