The Communist Party of Vietnam, founded and trained by comrade Ho Chi Minh, led the people to successfully carry out the August Revolution, establish the Democratic Republic of Vietnam (now the Socialist Republic of Vietnam), defeat the wars of aggression, abolish the colonial and feudal regimes, complete the cause of national liberation, unify the country, carry out the renovation, build socialism and firmly protect the independence of the Fatherland.

The Party and basic issues of Party building
The Communist Party of Vietnam, founded and trained by comrade Ho Chi Minh, led the people to successfully carry out the August Revolution, establish the Democratic Republic of Vietnam (now the Socialist Republic of Vietnam), defeat the wars of aggression, abolish the colonial and feudal regimes, complete the cause of national liberation, unify the country, carry out the renovation, build socialism and firmly protect the independence of the Fatherland.
The Communist Party of Vietnam is the vanguard of the working class, at the same time the vanguard of the working people and of the Vietnamese nation; faithfully representing the interests of the working class, the working people and the nation.
The Party's goal is to build an independent, democratic, prosperous Vietnam with a just and civilized society, where no one exploits another, to successfully implement socialism and ultimately communism.
The Party takes Marxism-Leninism and Ho Chi Minh Thought as its ideological foundation and guideline for action, promotes the nation's fine traditions, absorbs the quintessence of human wisdom, grasps objective laws, trends of the times and the country's reality to set out a correct political platform and revolutionary line in accordance with the people's aspirations.
The Party is a tight-knit organization, unified in will and action, taking democratic centralism as the basic organizational principle, implementing collective leadership, individual responsibility, loving comrades, strict discipline, and at the same time implementing the principles of self-criticism and criticism, solidarity on the basis of the Political Platform and Party Charter, closely attached to the people, the Party operates within the framework of the Constitution and the law.
The Communist Party of Vietnam is the ruling party, respects and promotes the people's right to mastery, is supervised by the people; relies on the people to build the Party; unites and leads the people to carry out the revolutionary cause. The Party leads the political system and is at the same time a part of that system. The Party leads, respects and promotes the role of the State, the Vietnam Fatherland Front and socio-political organizations.
The Party combines true patriotism with the pure internationalism of the working class, actively contributing to the cause of peace, national independence, democracy and social progress of the people of the world.
The Communist Party of Vietnam is built strong in politics, ideology and organization, constantly renews and rectify itself, constantly improves the quality of its cadres and party members, and the Party's fighting strength and revolutionary leadership capacity.
Chapter I
Party member
Article 1.
1. A member of the Communist Party of Vietnam is a revolutionary soldier in the vanguard of the working class, working people and Vietnamese nation, striving all his life for the Party's goals and ideals, putting the interests of the Fatherland, the working class and working people above personal interests; strictly abiding by the Political Platform, the Party's Statutes, the Party's resolutions and the State's laws; working hard, fulfilling assigned tasks well; having good ethics and lifestyle; being closely attached to the people; obeying the Party's organization and discipline, and maintaining solidarity and unity within the Party.
2. Vietnamese citizens aged eighteen and above who acknowledge and voluntarily: implement the Political Platform, Party Statutes, Party member standards and tasks, operate in a grassroots Party organization; through practice prove to be outstanding, trusted by the people, can all be considered for admission to the Party.
Article 2.
Party members have the following duties:
1. Be absolutely loyal to the Party's revolutionary ideals and goals, strictly abide by the Party's Political Platform, Party Statutes, resolutions and directives, and State laws; successfully complete assigned tasks; absolutely obey the Party's assignment and mobilization.
2. Continuously study, practice, improve knowledge, working capacity, political qualities, revolutionary ethics, have a healthy lifestyle; fight against individualism, opportunism, localism, bureaucracy, corruption, waste and other negative manifestations. Comply with the regulations of the Central Executive Committee on what Party members are not allowed to do.
3. Closely connect with the people, respect and promote the people's right to mastery; care for the material and spiritual life and protect the legitimate rights of the people; actively participate in mass work and social work at work and residence; propagate and mobilize families and people to implement the Party's guidelines and policies and the State's laws.
4. Participate in building and protecting the Party's guidelines, policies and organization; obey discipline, maintain solidarity and unity within the Party; regularly self-criticize and criticize, be honest with the Party; do work to develop Party members; participate in Party activities and pay Party dues according to regulations.
Article 3.
Party members have the right to:
1. Be informed and discuss issues regarding the Political Platform, Party Charter, Party guidelines, policies and strategies; vote on Party work.
2. Nominate, nominate and elect Party leadership bodies at all levels according to regulations of the Central Executive Committee.
3. Criticize and question the activities of party organizations and party members at all levels within the organization; report and make recommendations to responsible agencies and request responses.
4. Present your opinion when the Party organization comments, decides on work or takes disciplinary action against you.
Probationary Party members have the above rights, except the right to vote, run for election and elect the Party's leadership bodies.
Article 4.
Procedures for admitting party members (including re-admission):
1. Party members must:
- Have a voluntary application to join the Party;
- Honestly report your background to the Party cell;
- Introduced by two official party members.
Where the Ho Chi Minh Communist Youth Union is organized, people joining the Party at a young age must be members of the Youth Union and be introduced by the executive committee of the grassroots Youth Union and an official Party member.
In agencies and enterprises where there is no Ho Chi Minh Communist Youth Union, people joining the Party must be union members and be introduced by the executive committee of the grassroots union and an official party member.
2. The referrer must:
- Be an official party member and work with the person joining the Party for at least one year;
- Report to the Party cell about the background, qualities, and abilities of the person joining the Party and be responsible for his/her own recommendation. If there is anything unclear, report it to the Party cell and superiors for consideration.
3. Responsibilities of Party cells and Party committees:
- Before the Party cell considers and recommends admission, the Party cell committee will re-examine the conditions of the person joining the Party and seek comments from the mass organization where that person is active.
The issue of political history of people joining the Party must be carried out according to the regulations of the Central Executive Committee.
- The Party cell considers and proposes to admit each person one by one. When at least two-thirds of the official Party members in the Party cell agree, the proposal is submitted to the higher-level Party Committee; when there is a decision from the higher-level Party Committee, the Party cell organizes a ceremony to admit each person one by one.
- The grassroots Party Committee considers and, if at least two-thirds of the Party Committee members agree to the admission, proposes to the immediate superior Party Committee.
- The Standing Committee of the immediate superior Party Committee of the grassroots Party organization or the authorized grassroots Party Committee shall consider and decide on the admission of each person.
4. Where there are no Party members or there are Party members but they do not meet the requirements for introduction, the higher-level Party Committee will directly send Party members to do propaganda work, consider and introduce them for admission to the Party. Special cases are determined by the Central Executive Committee.
Article 5.
1. A person admitted to the Party must undergo a probationary period of twelve months, calculated from the date the Party cell organizes the admission ceremony. During the probationary period, the Party cell continues to educate, train and assign official Party members to help that Party member progress.
2. When the probationary period ends, the Party cell will consider and recognize each person as an official Party member and vote as when considering admission; if they are not qualified to be Party members, a proposal will be made to the competent Party Committee to decide to remove their name from the list of probationary Party members.
3. The resolution of the Party cell on the proposal to recognize official Party members must be decided by the competent Party Committee.
4. For officially recognized party members, the party age of the party member is calculated from the date stated in the admission decision.
Article 6.
The issuance and management of party membership cards, management of party membership records and procedures for transferring party activities are prescribed by the Central Executive Committee.
Article 7.
Party members who are old and weak and voluntarily request reduction or exemption from work and party activities will be considered and decided by the Party cell.
Article 8.
1. Party members who miss Party cell activities or do not pay Party dues for three months in a year without a valid reason; Party members whose will to strive is reduced, who do not perform Party member duties, and who have been educated by the Party cell but do not make progress, the Party cell shall consider and propose to the competent authority to remove their names from the Party member list.
2. In the above cases, if a party member has a complaint, the party cell shall report to the competent party committee for consideration.
3. Party members who request to leave the Party will be considered by the Party cell and recommended to the competent authority for approval and admission decision.
Chapter II
Organizational principles and organizational structure of the Party
Article 9.
The Communist Party of Vietnam is organized according to the principle of democratic centralism. The basic content of that principle is:
1. The Party's leadership bodies at all levels are established by election, carry out collective leadership, and are individually responsible.
2. The highest leadership body of the Party is the National Congress. The leadership body at each level is the congress of delegates or the congress of party members. Between two congresses, the leadership body of the Party is the Central Executive Committee, at each level is the executive committee of the party committee or branch (abbreviated as the Party Committee).
3. Party committees at all levels report and are responsible for their activities to the congresses at the same level, to the upper and lower Party committees; periodically inform the subordinate Party organizations about their activities, and conduct self-criticism and criticism.
4. Party organizations and Party members must comply with Party resolutions. The minority is subject to the majority, lower levels are subject to higher levels, individuals are subject to the organization, and organizations within the entire Party are subject to the National Congress of Delegates and the Central Executive Committee.
5. Resolutions of the Party's leading bodies are only valid when more than half of the members of that body agree. Before voting, each member is allowed to express his/her opinion. Party members with minority opinions have the right to reserve and report to the higher-level Party Committee up to the National Congress, but must strictly comply with the resolution and must not disseminate opinions contrary to the Party's resolution. The competent Party Committee shall study and consider such opinions; there shall be no discrimination against Party members with minority opinions.
6. Party organizations decide on issues within their authority, but must not be contrary to the principles, guidelines, and policies of the Party, the laws of the State, and resolutions of higher levels.
Article 10.
1. The Party's organizational system is established in accordance with the State's administrative organizational system.
2. Grassroots party organizations are established at administrative, career, economic or work units, under the leadership of district, county, town or provincial city Party Committees. Party organizations in the Vietnam People's Army and the Vietnam People's Public Security are regulated in Chapter VI. The establishment of party organizations in places with special characteristics is regulated by the Central Executive Committee.
3. The immediate superior Party Committee decides to establish or dissolve the Party Committee and subordinate Party cells.
Article 11.
1. The Party Committee convenes a congress at the end of its term, notifying the lower levels in advance of the time and content of the congress.
2. The Party Committee convening the congress decides on the number of delegates and allocates them to the subordinate Party Committees based on the number of Party members, the number of subordinate Party Committees, and the important position of each Party Committee, according to the instructions of the Central Executive Committee.
3. Delegates attending the congress include members of the executive committee at the level that convened the congress and delegates elected by the lower-level congress.
4. The appointment of delegates is only carried out for party organizations operating under special conditions where it is not possible to hold a congress for election, according to regulations of the Central Executive Committee.
5. Delegates attending the congress must have their qualifications examined by the congress and voted to be recognized. The Party Committee convening the congress cannot reject the qualifications of delegates elected by lower-level congresses, except in cases where the delegates are suspended from Party activities, suspended from Party Committee activities, prosecuted, indicted, or detained.
6. The Congress is only valid when at least two-thirds of the delegates or party members summoned attend and at least two-thirds of the affiliated party organizations have delegates attending.
7. The congress elects a presidium (chairman) to run the work of the congress.
Article 12.
1. Party committee members must meet the standards of political qualities, revolutionary ethics, and healthy lifestyle; strictly comply with the principles of Party organization and activities, Party discipline, and State laws; have the knowledge and capacity to participate in collective leadership, successfully complete assigned tasks; unite cadres and party members, and gain the trust of the masses.
2. The number of members of the Central Executive Committee is decided by the National Congress of Delegates; the number of members of each level is decided by the congress of that level, according to the guidance of the Central Executive Committee. Party committees at all levels need to be renewed, ensuring continuity and development through each congress.
3. The Presidium (chairman) guides the election:
- Delegates have the right to comment and question candidates and nominees.
- The election list is discussed and approved by the congress.
- Secret ballot.
- The elected person must receive more than half of the votes of the total number of delegates summoned or the total number of official party members of the summoned party committee or cell.
In case the number of people with more than half of the votes is greater than the number of people needed to be elected, the person with the higher number of votes will be elected; if at the end of the list of elected people there are many people with equal votes and more than the number needed to be elected, the number of people with equal votes will be re-elected to choose the person with the higher number of votes, not necessarily more than half. In case the number of votes is still equal, whether to vote again or not will be decided by the congress.
If one election does not reach the required number, whether to hold another election or not is decided by the congress.
Article 13.
1. The new Party Committee receives the handover from the previous Party Committee, operates the work immediately after being elected and is officially recognized when there is an approval decision from the immediate superior Party Committee.
2. The addition of missing committee members is proposed by the committee and decided directly by the higher-level committee; the number of committee members after addition shall not exceed the total number of committee members decided by the congress. When absolutely necessary, the higher-level committee shall directly appoint a number of additional committee members at lower levels.
3. When absolutely necessary, the superior Party Committee has the right to mobilize a number of subordinate Party Committee members, but not more than one-third of the total number of Party Committee members elected by the congress.
4. A Party Committee member who requests to withdraw from the Party Committee shall be considered by the Party Committee and proposed to the immediate superior Party Committee for decision; for Central Committee members, it shall be decided by the Central Executive Committee. A current Party Committee member in a Party Committee from the provincial level down, when there is a decision to retire or transfer to another unit outside the Party Committee, shall cease to participate in the current Party Committee in that Party Committee.
For Central Committee members, when there is a decision to stop holding positions in party, state, and mass organizations to retire, they will stop participating in the current Central Executive Committee.
5. From the grassroots party organization to the party committee directly under the Central Committee, if newly established, split, merged or consolidated during the term, the immediate superior party committee shall directly appoint the official party committee; direct the development or addition of appropriate tasks; the first term of these party committees does not necessarily have to be 5 years so that the congress term is consistent with the congress term of the superior party organization.
6. For party organizations that cannot hold congresses, the immediate superior party committee shall directly appoint the party committee of that party organization.
Article 14.
1. Party committees at each level establish advisory and support agencies under the guidance of the Central Executive Committee.
2. When necessary, the Party Committee establishes subcommittees, councils, and working groups and dissolves them when their tasks are completed.
Chapter III
The Party's leadership body at the central level
Article 15.
1. The National Congress of Delegates is convened by the Central Executive Committee every five years; it may be convened earlier or later, but not more than one year.
2. The Congress evaluates the results of the implementation of the resolutions of the previous term; decides on the Party's guidelines and policies for the next term; supplements and amends the Political Platform and the Party's Statutes when necessary; elects the Central Executive Committee. The number of official Central Committee members and alternate Central Committee members is decided by the Congress.
The Central Executive Committee considers transferring qualified alternate Central Committee members to replace official Central Committee members when vacancies arise.
3. When the Central Executive Committee deems it necessary or when more than half of the subordinate Party Committees request it, the Central Executive Committee shall convene an extraordinary National Congress of Delegates. Delegates attending the extraordinary Congress shall be incumbent Central Committee members and qualified delegates who attended the National Congress of Delegates at the beginning of the term.
Article 16.
1. The Central Executive Committee organizes and directs the implementation of the Political Platform, the Party Charter, and the Congress's resolutions; decides on domestic and foreign policies, mass work, and Party building; prepares for the next National Congress of the Party and the extraordinary National Congress (if any).
2. The Central Executive Committee, based on the actual situation, decided to pilot a number of new policies.
3. The Central Executive Committee holds regular meetings every six months and extraordinary meetings when necessary.
Article 17.
1. The Central Executive Committee elects the Politburo; elects the General Secretary from among the Politburo members; establishes the Secretariat consisting of the General Secretary, a number of Politburo members assigned by the Politburo and a number of Secretariat members elected by the Central Executive Committee from among the Central Executive Committee members; elects the Central Inspection Committee; elects the Chairman of the Central Inspection Committee from among the Central Inspection Committee members.
The number of Politburo members, Secretariat members and Central Inspection Commission members is decided by the Central Executive Committee.
The General Secretary shall hold the position of General Secretary for no more than two consecutive terms.
2. The Politburo leads, inspects and supervises the implementation of the resolutions of the National Congress of Delegates and the resolutions of the Central Executive Committee; decides on issues related to guidelines, policies, organization and personnel; decides to convene and prepare the content of the meetings of the Central Executive Committee; reports on the work done before the Central Executive Committee meetings or at the request of the Central Executive Committee.
3. The Secretariat leads the daily work of the Party: directs Party building and mass work; inspects and supervises the implementation of Party resolutions and directives on economy, society, national defense, security, and foreign affairs; directs the coordination of activities between organizations in the political system; decides on a number of issues on organization, personnel, and a number of other issues as assigned by the Central Executive Committee; directs or inspects the preparation of issues to be presented to the Politburo for discussion and decision.
Chapter IV
Party leadership at local levels
Article 18.
1. The congresses of the Party Committees of provinces, centrally-run cities, districts, towns, and provincial cities are convened by the Party Committees of the same level every five years; they may be convened earlier or later, but not more than one year.
2. The congress discusses documents of the higher-level Party Committee; evaluates the results of implementing the resolutions of the previous term; decides on tasks for the next term; elects the Party Committee; and elects delegates to attend the higher-level congress.
3. When the Party Committee deems it necessary or when more than half of the subordinate Party Committees request and the immediate superior Party Committee agrees, an extraordinary congress of delegates shall be convened.
Delegates attending the extraordinary congress are incumbent Party Committee members, delegates who attended the first-term Party Congress, are active in the Party Committee, and are qualified.
Article 19.
1. The Party Committees of provinces and centrally-run cities (hereinafter referred to as provincial Party Committees and municipal Party Committees), the Party Committees of districts, towns, and provincial cities (hereinafter referred to as district Party Committees, district Party Committees, town Party Committees, and municipal Party Committees) lead the implementation of the resolutions of the congresses of delegates; and resolutions and directives of higher levels.
2. Provincial, municipal, district, county and town Party Committee conferences are convened by the Standing Committee every three months; extraordinary meetings are held when necessary.
Article 20.
1. The provincial, municipal, district, county and town Party Committee conferences elect the standing committee; elect the secretary and deputy secretary from among the standing committee members; elect the inspection committee; and elect the chairman of the inspection committee from among the inspection committee members.
2. The number of standing committee members and inspection committee members is decided by the Party Committee according to the guidance of the Central Executive Committee.
3. The Standing Committee leads, inspects and supervises the implementation of resolutions of the congress of delegates, resolutions and directives of the Party Committee at the same level and higher levels; decides on issues related to policies, organization and personnel; decides to convene and prepare the content of meetings of the Party Committee.
4. The Standing Committee of the Party Committee, including the Secretary and Deputy Secretaries, directs and inspects the implementation of resolutions and directives of the Party Committee, the Standing Committee and the higher-level Party Committee; handles the daily work of the Party Committee; decides to convene and prepare the content of meetings of the Standing Committee.
Chapter V
Party grassroots organization
Article 21.
1. Grassroots party organizations (grassroots party cells, grassroot party committees) are the foundation of the Party and the political nucleus at the grassroots level.
2. In communes, wards and towns with three or more official party members, a grassroots party organization is established (under the district-level Party Committee). In agencies, enterprises, cooperatives, public service units, military units, police and other units with three or more official party members, a party organization is established (a grassroots party organization or a party cell under the grassroots Party Committee); the immediate superior Party Committee shall consider and decide which appropriate higher Party Committee the party organization is under; if there are not yet three official party members, the immediate superior Party Committee shall introduce party members to participate in activities at an appropriate grassroots party organization.
3. Grassroots party organizations with less than thirty party members establish grassroots party cells and have affiliated party cells.
4. Grassroots party organizations with thirty or more party members establish grassroots party committees and have party cells directly under the party committee.
5. In the following cases, the lower-level Party Committee must report to and receive approval from the immediate higher-level Party Committee before implementation:
- Establishing a grassroots party committee in a grassroots unit with less than thirty party members.
- Establish a party cell directly under the grassroots party committee with more than thirty party members.
- Establish a party cell directly under the grassroots party committee.
Article 22.
1. The congress of delegates or congress of party members of a grassroots party organization is convened by the grassroots party committee once every five years; it may be convened earlier or later but not more than one year.
2. The congress discusses documents of higher levels; evaluates the results of implementing resolutions of the previous term; decides on tasks for the next term; elects the Party Committee; and elects delegates to attend the Party Congress of higher levels.
3. When the Party Committee deems it necessary or when more than half of the subordinate Party organizations request it and the immediate superior Party Committee agrees, it shall convene an extraordinary congress of delegates or Party members.
Delegates attending the extraordinary congress are incumbent Party Committee members, delegates who attended the first-term Party Congress, are active in the Party Committee, and are qualified. Delegates attending the extraordinary Party Congress are Party members of that Party Committee.
4. The Party Committee and grassroots Party cell meet regularly once a month and hold extraordinary meetings when necessary.
5. A grassroots Party Committee with nine or more members elects a standing committee; elects a secretary and deputy secretary from among the standing committee members; with less than nine members, only the secretary and deputy secretary are elected.
6. The grassroots Party Committee holds regular meetings twice a year; holds extraordinary meetings when necessary. The grassroots Party cell holds regular meetings once a month; holds extraordinary meetings when necessary.
Article 23.
Grassroots party organizations have the following tasks:
1. Comply with the Party's guidelines and policies and the State's laws; set out the Party Committee's and Party cell's political policies and tasks and effectively lead their implementation.
2. Building a clean and strong Party Committee and Party Cell in terms of politics, ideology and organization; correctly implementing the principle of democratic centralism; improving the quality of Party activities, practicing self-criticism and criticism, maintaining discipline and strengthening solidarity and unity within the Party; regularly educating, training and managing cadres and Party members, improving revolutionary ethics, fighting spirit, knowledge level and working capacity; doing work to develop Party members.
3. Lead the building of a clean and strong government, economic, administrative, career, defense, security organizations and socio-political organizations; comply with the law and promote the people's mastery.
4. Closely connect with the people, care for their material and spiritual life and protect their legitimate interests; lead the people to participate in building and implementing the Party's guidelines and policies and the State's laws.
5. Inspect and supervise the implementation, ensure that resolutions, directives of the Party and laws of the State are strictly followed; inspect and supervise Party organizations and Party members in complying with the Party Charter.
If authorized directly by the superior Party Committee, the grassroots Party Committee is authorized to decide on the admission and expulsion of Party members.
Article 24.
1. Party cells directly under the grassroots party committee are organized according to the workplace or residence of party members; each party cell has at least 3 official party members. Party cells with many party members can be divided into many party groups; party groups elect group leaders, and if necessary, deputy group leaders; party groups operate under the direction of the party cell committee.
2. The Party cell leads the implementation of the unit's political tasks; educates, manages and assigns work to Party members; conducts mass mobilization and Party member development work; inspects and supervises the implementation of Party member discipline; collects and pays Party dues. The Party cell and Party cell committee hold regular meetings once a month.
3. The Party cell congress is convened by the Party cell committee twice every five years; in cases where there is no Party cell committee, it is convened by the Party cell secretary. With the consent of the grassroots Party committee, it can be convened earlier or later, but not more than six months.
4. A Party cell with less than nine official Party members shall elect a Party cell secretary; if necessary, a deputy secretary. A Party cell with nine or more official Party members shall elect a Party cell executive committee, Secretary, and Deputy Secretary from among the Party cell executive committee members.
Chapter VI
Party Organization in the Vietnam People's Army and the Vietnam People's Public Security
Article 25.
1. The Party absolutely and directly leads the Vietnam People's Army and the Vietnam People's Public Security in all aspects; the Party's leadership is concentrated and unified in the Central Executive Committee, directly and regularly by the Politburo and the Secretariat; the Party decides on fundamental issues to build a People's Army and the People's Public Security that are clean and strong in politics, ideology and organization, absolutely loyal to the Party and the Fatherland, wholeheartedly serving the people, being the core force together with the entire people to firmly protect the socialist Vietnam Fatherland, maintain political security and social order and safety, and participate in national construction. The State unifies management of the Army, the Public Security and the cause of national defense and security according to the provisions of the Constitution and laws.
2. Party organizations in the Vietnam People's Army and the Vietnam People's Public Security operate according to the Political Platform, Party Statutes, resolutions and directives of the Party and the laws of the State.
3. The committees of the Party Committee, according to their functions, assist the Party Committee in guiding, inspecting and supervising the Party building work and mass work in the Vietnam People's Army and the Vietnam People's Public Security.
Article 26.
1. The Central Military Commission is appointed by the Politburo, consisting of a number of Central Executive Committee members working in the Army and a number of Central Executive Committee members working outside the Army, under the leadership of the Central Executive Committee, which is usually the Politburo and the Secretariat. The General Secretary is the Secretary of the Central Military Commission.
2. The Central Military Commission studies and makes proposals for the Central Executive Committee to decide on issues regarding military and defense policies and tasks; and leads all aspects of the Army.
3. The General Department of Politics is responsible for Party and political work in the entire army, operating under the leadership of the Secretariat and directly and regularly under the Central Military Commission. At each level, there are political agencies and political cadres responsible for Party and political work under the leadership of the Party Committee at the same level and the direction of the higher-level political agency.
Article 27.
1. Party committees in the main force and border guards at each level are elected by the congress at that level and lead subordinate units in all aspects; in special cases, they are appointed by the higher-level Party committee.
2. The military region Party Committee consists of comrades working in the military region Party Committee elected by the congress at the same level and comrades who are assigned to participate as secretaries of provincial and municipal Party Committees in the military region; leads the implementation of resolutions of higher levels, the tasks of building all-people national defense, building the people's armed forces; coordinates with local Party Committees to implement the Party's guidelines and policies in the military region.
3. The local military party organization at any level is under the leadership of the local Party Committee at that level in all aspects, and at the same time implements the resolutions of the higher-level military party committee on the task of national defense and local military work. The higher-level political agency coordinates with the local Party Committee to direct party work, political work and mass work in the local armed forces.
4. The military party committee of a province, city, district, county, or town consists of comrades working in the local military party committee elected by the congress at the same level, the local party committee secretary, and a number of comrades outside the local military party committee appointed by the local party committee to participate. The local party committee secretary directly serves as the military party committee secretary at the same level.
Article 28.
1. The Central Public Security Party Committee appointed by the Politburo includes a number of Central Executive Committee members working in the People's Public Security and a number of Central Executive Committee members working outside the People's Public Security, a number of comrades working in the Central Public Security Party Committee, under the leadership of the Central Executive Committee, often the Politburo and the Secretariat. The Central Public Security Party Committee studies and proposes for the Central Executive Committee to decide on issues of guidelines and policies, ensuring political security, social order and safety; and leads all aspects of public security work.
2. The police committee at each level is elected by the congress at that level; in cases of real necessity, it is appointed by the higher-level committee. The committee leads the units under its level in all aspects.
3. The General Department of People's Public Security Force Building undertakes party work, political work and mass work in units under the public security party committee, operating under the leadership of the Central Public Security Party Committee; coordinates with local party committees to direct party work, political work and mass work in local public security forces.
4. The police force building agency at each level undertakes party work, political work, and mass work within the party organization, operating under the leadership of the party committee at the same level and the direction of the force building agency at a higher level.
Article 29.
1. The local People's Public Security Party organization at any level is under the direct leadership in all aspects of the Party Committee at that level, and at the same time implements the resolutions of the higher-level Public Security Party Committee on maintaining political security and social order and safety; leads the building of the local People's Public Security force and builds a clean and strong Party organization.
2. The Party Committee of the provincial, municipal, district, and town public security is elected by the Party Congress of the same level.
Chapter VII
Inspection and supervision work of the Party and Inspection Committees at all levels
Article 30.
1. Inspection and supervision are leadership functions of the Party. Party organizations must conduct inspection and supervision work. Party organizations and Party members are subject to inspection and supervision by the Party.
2. Party committees at all levels lead the inspection and supervision work and organize the implementation of inspection and supervision tasks of party organizations and party members in implementing the Political Platform, Party Statutes, resolutions and directives of the Party.
Article 31.
1. Inspection committees at all levels are elected by the Party Committee of the same level, including a number of comrades in the Party Committee and a number of comrades outside the Party Committee.
2. Members of the inspection committee and the chairman and vice chairman of the lower-level inspection committee must be approved by the immediate superior Party Committee. If the chairman of the inspection committee is transferred to another job, it must be approved by the immediate superior Party Committee.
3. The inspection committee works collectively, under the leadership of the Party Committee at the same level and the direction and inspection of the inspection committee at a higher level.
Article 32.
Inspection committees at all levels have the following duties:
1. Inspect party members, including committee members at the same level, when there are signs of violating party member standards, committee member standards, and in performing party member duties.
2. Inspect lower-level party organizations when there are signs of violations in implementing the Political Platform, Party Statutes, resolutions, directives of the Party, and organizational principles of the Party; inspect the implementation of inspection, supervision and disciplinary tasks within the Party.
3. Supervise Party committee members at the same level, cadres under the management of the Party committee at the same level, and lower-level Party organizations in implementing the Party's guidelines, policies, resolutions of the Party committee, and ethics and lifestyle according to regulations of the Central Executive Committee.
4. Review and conclude cases of disciplinary violations, decide or propose to the Party Committee to enforce disciplinary action.
5. Resolve denunciations against party organizations and party members; resolve complaints about party discipline.
6. Financial inspection of lower-level Party committees and of financial agencies of Party committees at the same level.
Article 33.
The inspection committee has the right to request lower-level party organizations and party members to report and provide documents on issues related to the inspection content.
Chapter VIII
Reward and discipline
Article 34.
Party organizations and party members with achievements are rewarded according to regulations of the Central Executive Committee.
Article 35.
1. Party organizations and party members who violate discipline must be handled fairly, accurately and promptly.
2. Disciplinary measures:
- For party organizations: reprimand, warning, dissolution;
- For official party members: reprimand, warning, dismissal, expulsion;
- For probationary party members: reprimand, warning.
Article 36.
Authority to discipline party members who violate:
1. The Party cell decides to reprimand or warn Party members in the Party cell (including Party committee members at all levels and Party members under the management of higher-level Party committees) who violate political qualities, ideology, ethics, lifestyle, Party activities, and perform Party member duties (except for duties assigned by higher levels).
The grassroots Party Committee decides to reprimand, warn Party members in the Party Committee, and remove lower-level Party Committee members from office.
The grassroots Party Committee authorized to decide on admitting Party members has the right to decide on expelling Party members, but not Party Committee members of the same level and Party members who are cadres under the management of the higher-level Party Committee.
2. Provincial, municipal, district, and equivalent Party Committees decide on forms of Party discipline for Party members; decide on reprimands and warnings for Party Committee members at all levels, Party members under the management of higher-level Party Committees who violate political qualities, ideology, ethics, lifestyle, Party activities, and performance of Party member duties; decide on reprimands and warnings for Party Committee members at the same level who violate duties assigned by the Party Committee.
The Standing Committee of the Party Committee decides on forms of discipline for Party members; decides on reprimands and warnings for Party members at all levels, Party members under the management of higher-level Party Committees who violate political qualities, ideology, ethics, lifestyle, Party activities, and the performance of Party member duties, and cadres under the management of higher-level Party Committees who violate assigned professional duties.
3. The Central Executive Committee decides on disciplinary measures for Party members, including Central Executive Committee members, Secretariat members, and Politburo members.
The Politburo and the Secretariat decide on forms of discipline for party members, including party members who are cadres under the management of the Politburo and the Secretariat; reprimand and warn members of the Central Executive Committee who violate political qualities, ideology, ethics, lifestyle, party activities, and performance of party member duties.
4. The inspection committee at the district, county and equivalent levels and above decides on disciplinary measures for party members, but not for party committee members at the same level; decides on reprimands and warnings for party members who are cadres under the management of the same-level party committee and directly subordinate party committee members.
5. The superior Party Committee and Inspection Committee have the right to approve, change or abolish disciplinary measures decided by the subordinate level.
6. Party members holding multiple positions who are disciplined by removal from office will be removed from one or more positions depending on the level and nature of the violation.
Article 37.
Authority to enforce party discipline violations:
1. The immediate superior Party Committee decides to reprimand or warn the subordinate Party organization.
2. Disciplinary action to dissolve a Party organization is proposed by the immediate superior Party Committee and decided by the Party Committee one level above. This decision must be reported to the immediate superior Party Committee and the Central Inspection Committee.
3. A party organization shall only be dissolved when it commits one of the following acts: acts against the Party's guidelines and policies; commits particularly serious violations of the Party's organizational and operational principles or the State's laws.
Article 38.
1. Party organizations and party members who commit violations that are not within the disciplinary authority of their level shall request the competent level to decide.
2. In case a lower-level party organization fails to handle or improperly handles a party organization or party member who violates the law, the higher-level party committee or inspection committee shall decide on disciplinary measures according to its authority and at the same time consider the responsibility of that party organization.
3. Disciplinary measures to dissolve a party organization and expel party members must be proposed by at least two-thirds of the members of the lower-level party organization and decided by the competent party organization.
Article 39.
1. Party members who violate the law must self-criticize before the Party cell and accept the disciplinary action; if they refuse to self-criticize or are detained, the Party organization will still consider disciplinary action. If necessary, the Party Committee and the Inspection Committee of the competent level will directly consider disciplinary action.
2. Party organizations that violate the law must review, accept disciplinary action, and report to higher-level Party committees for decision.
3. Before deciding on disciplinary action, the representative of the competent party organization shall listen to the opinion of the violating party member or the representative of the violating party organization.
4. Decisions of lower levels on disciplining party organizations and party members who violate the rules must be reported to the immediate superior party committee or inspection committee; if the violating party member participates in many Party leadership bodies, it must be reported to the superior leadership bodies of which the party member is a member.
5. Decisions of superiors on disciplining party organizations and party members who violate the rules must be notified to lower levels where the party organizations and party members who violate the rules are located; in cases where a wider notification is needed, the decision shall be made by the competent Party Committee.
6. Disciplinary action against party organizations and party members who violate the law shall take effect immediately after the decision is announced.
7. Party organizations and party members who do not agree with the disciplinary decision have the right to appeal to the higher-level Party Committee or Inspection Committee up to the Central Executive Committee within one month from the date of receipt of the decision. Disciplinary complaints shall be resolved in accordance with the regulations of the Central Executive Committee.
8. Upon receiving a disciplinary complaint, the Party Committee or Inspection Committee shall notify the Party organization or the complaining Party member; no later than three months for provincial, city, district, county and equivalent levels, and six months for the Central level, from the date of receipt of the complaint, it must consider, resolve, and respond to the complaining Party organization and the complaining Party member.
9. While waiting for the complaint to be resolved, the party organization and disciplined party members must strictly comply with the disciplinary decision.
Article 40.
1. Party members sentenced to non-custodial reform or higher must be expelled from the Party.
2. When a disciplined party organization is dissolved, the immediate superior party committee shall establish a new party organization or introduce party activities to the remaining party members.
3. Party members who are disciplined by dismissal from office, within one year from the date of the decision, shall not be elected to the Party Committee or appointed to equivalent or higher positions.
4. The suspension of party activities of party members, the suspension of committee activities of committee members, and the suspension of party organization activities must be decided by the competent committee or inspection committee according to the regulations of the Central Executive Committee.
Chapter IX
The Party leads the State, the Fatherland Front and socio-political organizations.
Article 41.
1. The Party leads the State, the Fatherland Front and socio-political organizations through political platforms, strategies, policies and guidelines; through ideological work, organization, personnel and inspection and supervision of implementation.
2. The Party unifies leadership in personnel work and management of the staff, along with promoting the responsibility of organizations and heads of organizations in the political system regarding personnel work.
3. The Party recommends qualified cadres to run for election or appointment to state agencies, the Fatherland Front and socio-political organizations.
4. Party organizations and party members working in state agencies, the Fatherland Front and socio-political organizations must strictly comply with the Party's resolutions and directives; Party organizations lead the concretization into legal documents of the State and policies of organizations; and lead effective implementation.
Article 42.
1. In the leading agencies of the State, the Fatherland Front and socio-political organizations at the central and provincial levels, and centrally-run cities, established by election, the Party Committee at the same level shall establish a Party delegation consisting of a number of Party members working in that organization. Where a Party delegation is not established, the grassroots Party organization in that agency shall perform leadership functions according to the regulations of the Central Executive Committee.
2. The Party delegation is appointed by the Party Committee at the same level; it has a secretary and, if necessary, a deputy secretary. The Party delegation works collectively and is responsible to the Party Committee.
3. The Party delegation leads and persuades members of the organization to implement the Party's guidelines and policies; maintains close contact with the people; makes proposals to the Party Committee on directions, tasks, organization, personnel and makes decisions within its authority; leads the work of inspecting the implementation of the Party's guidelines and policies.
4. When necessary, the Party delegation convenes Party members in the organization to discuss the Party Committee's policies and discuss implementation measures.
Article 43.
1. In the executive and judicial agencies at the central and provincial levels, the Party Committee at the same level shall establish a Party Executive Committee consisting of a number of Party members working in that organization. Where no Party Executive Committee is established, the grassroots Party organization in that agency shall perform leadership functions according to the regulations of the Central Executive Committee.
2. The Party Executive Committee is appointed by the Party Committee at the same level; it has a Secretary and, if necessary, a Deputy Secretary. The Party Executive Committee works collectively and is responsible to the Party Committee.
3. The Party Executive Committee leads the dissemination and implementation of the Party's guidelines and policies; proposes to the Party Committee on directions, tasks, organization, personnel and makes decisions within its authority; leads the inspection of the implementation of the Party's guidelines and policies.
Chapter X
Party leadership Ho Chi Minh Communist Youth Union
Article 44.
1. The Ho Chi Minh Communist Youth Union is the Party's reliable reserve force, regularly supplying young people to the Party, continuing the glorious revolutionary cause of the Party and President Ho Chi Minh; is the core force in the youth movement; is a socialist school; represents the interests of the youth; and is in charge of the Ho Chi Minh Young Pioneers.
2. The Party Committee directly leads the same-level Youth Union in terms of direction, tasks, ideology, organization, and staff.
Article 45.
Party members who are still of youth union age must participate in and work in the youth union organization.
Chapter XI
Party Finance
Article 46.
1. The Party's finances include party dues paid by party members, from the state budget and other revenues.
2. The Central Executive Committee shall prescribe unified principles and regimes for the management of Party finances and assets and the level of Party dues paid by Party members.
3. Every year, the Party Committee listens to reports and decides on the financial tasks of its level.
Chapter XII
Comply with the Party Charter
Article 47.
Party organizations and party members must strictly comply with the Party Charter.
Article 48.
Only the National Congress has the right to amend the Party Charter.
