Through discussion, the majority of members of the National Assembly Delegation of Nghe An province agreed with the necessity of promulgating the Law on Foreign Trade Management to contribute to perfecting the synchronous legal framework regulating foreign trade activities; strengthening state management tools on foreign trade, ensuring transparency, efficiency, and conformity with international commitments.

Delegate Nguyen Dac Vinh agreed that the scope of the draft law only regulates state management in the field of foreign trade of goods.

Regarding the ban on the export and import of goods, delegate Nguyen Van Chi said that the Government should unify and detail the list of goods banned from import and export to ensure proactive flexibility in management and administration, suitable for each period, while ensuring the people's right to freedom of business as stipulated in the Constitution.

Considering that import and export activities in the past have had many overlaps, the promulgation of the Law on Foreign Trade Management will limit the recent shortcomings in the field of foreign trade, many delegates expressed concerns about the list of goods prohibited from export and import as stipulated in Article 10 of the draft law.

Therefore, delegates suggested that it is necessary to specify the list of goods prohibited from export and import in the draft law to ensure a high and transparent legal basis.

Previously, the draft Law on Foreign Trade Management presented by Minister of Industry and Trade Tran Tuan Anh to the National Assembly stated that it is necessary to develop a law on foreign trade management with clear orientation, consistent with the viewpoints of the Party and State, stable, transparent, unified, and meeting the requirements of international economic integration. At the same time, it is necessary to ensure that state management activities on foreign trade are smooth and effective, meeting the requirements of international integration.

The Draft Law consists of 8 Chapters and 115 Articles regulating measures for managing and operating foreign trade activities related to international trade in goods; does not interfere with specific activities of traders or between traders; only regulates goods, not services.

Regarding import and export of services, according to the provisions of Decision No. 28 of the Prime Minister, the Minister said that 12 groups of import and export service sectors have been specifically regulated such as tourism, transportation, post and telecommunications, construction, insurance, finance, computers and information... all of which are regulated by specialized legal systems.

Due to the specific nature of services, the Minister affirmed that combining the diversity of service types, setting out general rules and common management measures for service import and export in one law is not feasible. Therefore, like all other countries, Vietnam uses post-border measures for management, which are specified in specialized laws, avoiding overlap in the current legal system.

Examining the draft Law, the National Assembly's Economic Committee agreed with the Government's Submission on the necessity of promulgating the Law on Foreign Trade Management to contribute to perfecting the synchronous legal framework regulating foreign trade activities. The Economic Committee proposed to continue reviewing the draft Law's conformity with the Constitution, other relevant legal documents, and international treaties to which Vietnam is a member. This afternoon (October 27), National Assembly deputies continued to work in groups on the draft Law on Legal Aid (amended) and the draft Law on State Compensation Liability (amended).
