The delegation of National Assembly representatives from Nghe An province is gathering feedback on the draft Law on Organization of Local Government (amended).
In preparation for the 9th session of the 15th National Assembly, on the morning of February 10th, the National Assembly delegation of Nghe An province held a conference to gather feedback on the draft Law on Organization of Local Government (amended); the draft Law on Issuance of Legal Normative Documents (amended); and the draft Resolution on Handling Some Issues Related to the Arrangement of State Apparatus Organization.

Attending the conference were Comrade Nguyen Nhu Khoi - Member of the Provincial Party Committee, Vice Chairman of the Provincial People's Council; National Assembly delegates from the Provincial National Assembly Delegation; representatives of the leadership of several provincial departments, agencies and district-level People's Councils.

At the conference, delegates focused on contributing opinions to the draft Law on the Organization of Local Government (amended). Many delegates commented on the regulations regarding obtaining opinions from voters in administrative units directly affected by the establishment, dissolution, division, merger, or adjustment of administrative boundaries; the need to obtain opinions from household representatives to facilitate implementation by local authorities.
Many delegates proposed studying the possibility of regulating certain positions elected by the People's Council, including the chairman and vice-chairman of the People's Council and People's Committee, heads and deputy heads of People's Council committees, members of the People's Committee, and other positions, so that when they are transferred or retire from their assigned areas by competent authorities, they would no longer need to go through the formal dismissal procedure currently carried out by the People's Council.

Regarding the organizational structure of the People's Council, many delegates also expressed concern related to the proposal to clearly stipulate in the draft Law on Organization of Local Government (amended) that the head or deputy head of the People's Council committee should work full-time.
Some opinions also suggest that both the head and deputy head of the People's Council committees should work full-time to properly fulfill their functions and authority and improve the quality and effectiveness of the elected body's operations. On the other hand, it is necessary to regulate the groups of People's Council representatives at all levels according to electoral units, ensuring close monitoring of the representatives' activities within their respective electoral units.

Concerns have been raised regarding the provision in the draft Law on Organization of Local Government (amended) that eliminates People's Councils at the ward and commune levels within cities, while People's Councils in rural areas remain; therefore, how the activities of wards and communes should be carried out needs to be specifically regulated.
Some opinions also suggested reviewing the regulations on the duties and powers of the Provincial/City People's Councils in approving and deciding on the total number of employees and staffing for public non-business units…

Regarding the draft Law on the Promulgation of Legal Normative Documents (amended), delegates participating in the conference affirmed that, under the conditions of vigorously implementing the policy of reorganizing and streamlining the organizational structure and reducing the number of employees, but with the requirement for high-quality work, it is necessary to pay attention to reforming and improving the quality of promulgating legal normative documents; otherwise, the administrative system will become stagnant. Therefore, it is necessary to enhance the responsibility of agencies advising on the drafting and submission of legal regulations; and at the same time, there should be regulations to handle agencies and organizations that are slow in providing advice.

In addition, some opinions also offered suggestions and additions to specific content. For example, it was proposed to add regulations stipulating that the competent authority shall prescribe the procedures for drafting and promulgating legal documents of local governments in special economic administrative units; and to add regulations on the spatial scope of legal documents of local governments in special economic administrative units.
Some opinions suggest that the drafting agency should consider expanding the authority of district-level local governments to issue legal regulations in specific cases according to prescribed procedures, in order to ensure the proactive role of districts in formulating local economic and social development policies. Some opinions also express concern about the draft omitting the authority of the Provincial People's Council in issuing special mechanisms…
Regarding the draft Resolution stipulating the handling of certain issues related to the reorganization of the state apparatus; in addition to generally agreeing with the draft, some opinions also offered specific suggestions on certain contents.

Speaking at the conference, Comrade Thai Thi An Chung - Member of the Provincial Party Committee, Deputy Head of the Provincial National Assembly Delegation - thanked the delegates for their responsible research and insightful contributions based on practical experience.
The Deputy Head of the Provincial National Assembly Delegation affirmed: The suggestions from the delegates will be compiled by the Provincial National Assembly Delegation and used as documentation to contribute to the 9th session of the 15th National Assembly, scheduled to open on the morning of February 12th.
