The family of the victim whose mouth was stuffed with garlic by Chau Viet Cuong while high on drugs has just sent a petition asking the police to consider prosecuting him for murder.
Ms. Luu Thi Ha (in Chuong My district, Hanoi), the legal representative of the girl whose mouth was stuffed with garlic by singer Chau Viet Cuong, causing her death, said: The family has just sent a petition requesting the authorities to consider prosecuting the accused for murder against singer Chau Viet Cuong.

The petition states: According to the family, after the incident, the Ba Dinh District Police (Hanoi) prosecuted Nguyen Viet Cuong (aka singer Chau Viet Cuong, born in 1978) for involuntary manslaughter. The victim was Truong My H. (20 years old, in Chuong My district, Ha's niece).
However, according to Ms. Ha, when Chau Viet Cuong used drugs, he used force to stuff garlic into H's mouth, blocking her airway and causing her death.
Article 13 of the 2015 Penal Code, amended and supplemented in 2017, stipulates: “A person who commits a crime in a state of loss of cognitive ability or ability to control his/her behavior due to the use of alcohol, beer or other strong stimulants, shall still bear criminal responsibility.”
According to this regulation, even in the case of losing the ability to perceive and control behavior due to self-administering strong stimulants, Chau Viet Cuong must still bear criminal responsibility for the consequences caused.
The law requires anyone who intentionally takes drugs into their body to be aware of its harmful effects and consequences.
The petition also stated: "Chau Viet Cuong used drugs that led to hallucinations and caused serious consequences, so he must be held responsible for intentional mistakes. The investigation agency determined that unintentional mistakes in this case are not in accordance with the law."
And "Chau Viet Cuong used force to stuff garlic into the victim's mouth, causing death, an act that endangers the lives of others. This is not a normal act of feeding garlic in everyday life.The way Chau Viet Cuong repeatedly stuffed garlic down the victim's throat, no one could survive without resistance. Such behavior cannot be considered an unintentional mistake in this case.
Based on the above grounds, the legal representative of the victim requests that the law enforcement agencies consider prosecuting Chau Viet Cuong for murder./.
