Forging auditor certificates is punishable by up to 20 million VND

This is the proposal of the Ministry of Finance in the draft Decree regulating administrative sanctions for violations in the fields of accounting and independent auditing.

The draft specifically proposes penalties for violations of regulations on management and use of auditor certificates. Accordingly, a fine of VND 10,000,000 to VND 20,000,000 shall be imposed for one of the following acts: Forging, erasing, or correcting auditor certificates; leasing, lending, or using one's auditor certificate to register for auditing practice to an organization or individual other than the unit one is working for.

A fine of VND 20,000,000 to VND 30,000,000 shall be imposed on an organization that rents, borrows or uses an auditor's certificate of a person who does not work at its unit to register to practice auditing.

The additional penalty is the revocation of the right to use the Certificate of Registration to Practice Auditing for a period of 03 to 06 months from the effective date of the penalty decision. Forced to return the illegal profits obtained from committing acts in violation of regulations.

For violations of regulations on auditors' registration dossiers for auditing practice, a fine of VND 5,000,000 to VND 10,000,000 shall be imposed for dishonestly confirming information and documents in the dossier to qualify for a Certificate of registration for auditing practice.

A fine of VND 10,000,000 to VND 20,000,000 shall be imposed for one of the following acts: Making false declarations in the application for a Certificate of Registration to Practice Auditing; forging or falsifying documents in the application for a Certificate of Registration to Practice Auditing.

Regarding penalties for violations of regulations on management and use of the Certificate of Registration for Audit Practice, the draft clearly states that a warning penalty will be imposed for submitting the Certificate of Registration for Audit Practice to the Ministry of Finance no later than 15 days after the prescribed deadline.

A fine of VND 10,000,000 to VND 20,000,000 shall be imposed for one of the following acts: Submitting the Certificate of Registration for Audit Practice to the Ministry of Finance more than 15 days later than the prescribed deadline; using an expired or no longer valid Certificate of Registration for Audit Practice to perform independent accounting and auditing activities.

A fine of VND 15,000,000 to VND 20,000,000 shall be imposed on an auditing enterprise that commits acts of forging, erasing, or altering the Certificate of Registration for Audit Practice.

A fine of VND 20,000,000 to VND 40,000,000 shall be imposed on an auditing enterprise that registers an auditor to practice auditing at its unit but in reality the auditor does not work under a full-time labor contract at its unit.
