Thousands of prisoners could be released early

According to the project approved by the Prime Minister, every year about 20,000 prisoners will be conditionally released from prison early, which will save the budget about 200 billion VND.

Prime Minister Nguyen Xuan Phuc encouraged prisoners to reform well and return to normal life in August 2015.

The Prime Minister has just signed Decision 1461 approving the Project on implementing conditional early release from prison. The Ministry of Public Security is assigned to coordinate with the Supreme People's Court and relevant agencies to implement conditional early release from prison on a quarterly basis.

According to the project, people who are released from prison early are in the following cases: people sentenced to prison (not yet in a detention facility to serve their sentence) but are seriously ill; or women who are pregnant or raising children under 36 months old; or the sole laborer in the family; or convicted of less serious crimes due to official duties.

For those who have served a prison sentence for a certain period of time (one-third of the prison term or one-quarter of the prison term for minors and cases with preferential circumstances) and have made much progress, the Court may, upon the request of the criminal enforcement agency, decide to reduce part or all of the remaining prison sentence.

Conditional early release from prison applies to people who are serving a prison sentence in a detention facility, commit a crime for the first time, have served half of their prison term for a fixed-term prison sentence, at least 15 years for a life sentence that has been reduced to a fixed-term prison sentence...

In terms of legal nature, a person who is conditionally released from prison is still a person serving a sentence, only the form of serving the sentence changes from serving the sentence in a detention facility to serving the sentence in the community. A person who is conditionally released from prison must fulfill obligations during the probation period. The authority to decide on conditional early release is decided by the People's Court of the province where the prisoner is serving the sentence.

A person released from prison before his/her term must immediately present himself/herself to the People's Committee, police of the commune, ward or town where he/she resides and register for temporary or permanent residence according to the provisions of the Law on Residence; commit to comply with the law and regulations on conditional early release from prison; have his/her right to freedom of residence restricted; be prohibited from participating in political organizations; be prohibited from holding positions or powers...

Conditional early release is considered to have a high social deterrent effect, promote the strictness of the law, create motivation for prisoners to reform, and on the other hand, create conditions for those serving prison sentences to reform and have the opportunity to reintegrate into the community sooner, have the conditions to participate in studying, work and produce to support themselves and help their families.

Conditional early release will reduce the state budget for investment in building facilities; reduce costs for management, implementation of food, accommodation, clothing, medical examination and treatment, living, studying and other regimes and policies for prisoners; and reduce the need for staff in detention facilities.

According to estimates, the average cost for a prisoner per year is about 9,950,000 VND (including only investment costs for repairing detention facilities, re-education, and implementing regimes and policies for prisoners). If the number of people released from prison early with conditions is about 20,000, it will save the state budget about 200 billion VND/year and reduce the need for about 3,000 officers and soldiers of detention facilities (calculated at the ratio of one officer/6 prisoners).

The budget to implement the Project's tasks from 2016 to 2020 is estimated at 180 billion VND, divided into 2 phases.

From 2008 to present, 82,398 people have been granted amnesty, most of whom have stabilized their lives, have not violated the law, and have not re-offended.

From 2008 to 2015, the number of people sentenced to prison increased by an average of 10-12% per year. In September 2015, the President decided to grant amnesty and early release to 18,298 people, but as of December 2015, prisons under the Ministry of Public Security were still managing and detaining 129,180 prisoners (115,299 men, 13,881 women); temporary detention camps and temporary detention centers managed and detained 4,803 prisoners; the number of sentenced people completing procedures to serve their sentences was 16,359.
