In the Draft Law on Road Traffic Order and Safety, the Ministry of Public Security continues to add a proposal to deduct driving license points for serious violations that cause high traffic insecurity.

The above proposal has just been raised by the Ministry of Public Security in the Draft Law on Road Traffic Order and Safety.

Previously, the draft was submitted by the Ministry of Public Security to the 6th session of the 15th National Assembly but did not stipulate points or deductions for driving licenses. However, some delegates proposed to add regulations on points or deductions for driving licenses to the draft Law.

The Ministry of Public Security stated that through research, analysis and evaluation, the Government found that it is necessary to stipulate points and deductions for driving licenses in the draft Law on Road Traffic Order and Safety.

The Ministry of Public Security believes that deducting points from a driver's license is a State management measure, not a form of administrative penalty.

To implement the regulation on deducting points from driving licenses, the Government will issue specific regulations on the authority, basis, order and procedures for deducting points and restoring driving licenses.

Accordingly, serious violations that pose a high risk of causing traffic insecurity will be specifically regulated, and violators will have their driving license points deducted. The specific point deduction level for a single violation will be specifically researched and regulated to ensure that it does not overlap with other forms of administrative sanctions.

Point deduction and point restoration procedures will be simple, reasonable, and avoid inconvenience for violators, following the direction of applying information technology, digitizing the database system on testing and granting driving licenses; and the database system on handling administrative violations.

When there is a decision to impose a penalty (for violations with points deducted), the driver will receive a notification from the sanctioning agency about the deduction of points from the driver's license. The database system will automatically deduct points (there is no intervention or contact between the person with the sanctioning authority and the violator, so there will be no negativity, and no overlap with other forms of administrative sanctions).

After one year from the last point deduction, if there are any remaining points, the system will automatically restore points to the driver.

Previously, the Traffic Police Department, Ministry of Public Security said that the 12 points are not shown on the driver's license but are stored in the driver's license data system, and the points deducted from the violator will be updated immediately after the penalty is imposed. When handling the case, the traffic police only need to look it up on the computer to know how many points the driver has left.
