Failure to comply with audit decisions will be fined up to 100 million VND
This is a proposal in the draft Decree prepared by the State Audit Office regulating administrative sanctions for violations in the field of state auditing.
According to the draft, for each administrative violation in the field of state auditing, the violating organization or individual must suffer one of the main forms of punishment: Warning or fine.
Depending on the nature and severity of the violation, the violating individual or organization may also be subject to additional penalties such as confiscation of exhibits and means used to commit the administrative violation. The violating organization or individual may also be subject to one or more remedial measures as prescribed.
The maximum fine in the field of state audit for individuals is 100,000,000 VND. The maximum fine in the field of state audit for organizations is 200,000,000 VND.

Specifically, the draft proposes a fine of between VND 60,000,000 and VND 100,000,000 for one of the following acts: Failure to comply with the State Audit's audit decision; refusal to provide information and documents for the audit at the request of the State Audit, Audit Team, Audit Group, State Auditor; threatening a member of the Audit Team without reaching the level of criminal prosecution; illegal interference in the audit activities and audit results of the State Audit, Audit Team, Audit Group, State Auditor.
At the same time, remedial measures are also applied: Compelling compliance with the State Audit's audit decision for violations; forcing the provision of complete and accurate information and documents for violations of regulations; forcing the submission of complete financial reports, budget settlement reports, next year's budget estimates; and reports on the implementation of annual budget revenue and expenditure estimates to the State Audit for violations of regulations.

The draft also proposes a fine of between VND 60,000,000 and VND 100,000,000 for one of the following acts: Publishing news or articles reflecting inaccurate audit results; illegally intervening in audit activities and audit results of the State Audit, Audit Team, Audit Group, and State Auditor.
In addition, a fine of between VND 30,000,000 and VND 50,000,000 shall be imposed for one of the following acts: Inaccurately reporting on the results of implementing the State Audit's audit conclusions and recommendations; failing to provide information and documents on implementing the State Audit's audit conclusions and recommendations as requested by the State Audit; incompletely or untimely implementing the State Audit's audit conclusions and recommendations.
