Disciplinary action against many senior officials involved in Trinh Xuan Thanh case

From November 28 to 30, 2016, in Hanoi, the Central Inspection Commission held its 8th session. Comrade Tran Quoc Vuong, Politburo member, Party Central Committee Secretary, and Chairman of the Central Inspection Commission chaired the session.

At this session, the Central Inspection Commission (CIC) reviewed, handled and proposed disciplinary action against a number of party members and party organizations as follows:

1- For comrade Huynh Minh Chac, former member of the Party Central Committee, former Secretary of Hau Giang Provincial Party Committee for the 2010-2015 term

In his capacity as Secretary of the Provincial Party Committee, comrade Huynh Minh Chac violated the principle of democratic centralism, procedures and regulations on personnel work and the Working Regulations of the Provincial Party Committee in proposing and accepting Trinh Xuan Thanh from the Ministry of Industry and Trade to Hau Giang province to hold the position of Vice Chairman of the Provincial People's Committee and participate in the Provincial Party Committee.

2- For comrade Tran Cong Chanh, Secretary of Hau Giang Provincial Party Committee for the 2015-2020 term

As Deputy Secretary of the Provincial Party Committee and Chairman of the People's Committee of Hau Giang province for the 2010-2015 term, he was partly responsible for the shortcomings and violations in the proposal to accept Trinh Xuan Thanh from the Ministry of Industry and Trade to become Vice Chairman of the People's Committee of Hau Giang province and participate in the Provincial Party Executive Committee; and violations in directing the Provincial Police to issue public license plates for private vehicles so that Trinh Xuan Thanh could circulate in violation of regulations.

As Secretary of the Provincial Party Committee for the 2015-2020 term, with the responsibility of being the leader, he loosened his leadership and did not strictly implement the principle of democratic centralism in the activities of the Provincial Party Executive Committee.

3- For comrade Tran Luu Hai, former member of the Party Central Committee, former Deputy Head of the Standing Committee of the Central Organization Committee

Comrade Tran Luu Hai was irresponsible when signing the document of the Central Organizing Committee on allowing Hau Giang province to have one more Vice Chairman of the Provincial People's Committee for the 2011-2016 term, contrary to the conclusion of the Politburo and the Secretariat; there were shortcomings in signing the document responding to the Hau Giang Provincial Party Committee on the implementation of the personnel process to increase one more Party Committee member for the 2015-2020 term for Trinh Xuan Thanh.

4- For comrade Bui Cao Tinh, former Department Head, former Assistant to the Head of the Central Organizing Committee

Comrade Bui Cao Tinh is primarily responsible for advising on the content of the Central Organizing Committee's dispatch on allowing Hau Giang province to have one more Vice Chairman of the Provincial People's Committee for the 2011-2016 term, contrary to the conclusion of the Politburo and the Secretariat.

5- For comrade Tran Thi Ha, Member of the Party Executive Committee, Deputy Minister of Home Affairs, Head of the Central Emulation and Reward Committee

Comrade Tran Thi Ha committed violations and shortcomings in leading and directing the implementation of the appraisal of processes, procedures, conditions and standards to submit to the competent authority to award the Medal and the title of Labor Hero to the Vietnam Oil and Gas Construction Joint Stock Corporation (PVC); award the Prime Minister's Certificate of Merit and Medal to Trinh Xuan Thanh.

6- For comrade Tran Anh Tuan, member of the Party Executive Committee, Deputy Minister of Home Affairs

Comrade Tran Anh Tuan committed violations and shortcomings in assessing and giving opinions on the reception, recruitment, appointment of ranks and salary arrangement for civil servants for Trinh Xuan Thanh; lacked determination and did not propose or recommend to the Ministry of Industry and Trade to revoke and cancel the wrong decisions in the reception and appointment of Trinh Xuan Thanh.

7- For comrade Nguyen Duy Thang, member of the Party Executive Committee, Deputy Minister of Home Affairs

Comrade Nguyen Duy Thang committed violations and shortcomings in leading, directing, and implementing the appraisal and proposing to competent authorities to approve the position of Vice Chairman of Hau Giang Provincial People's Committee for the 2011-2016 term for Trinh Xuan Thanh.

The violations and shortcomings of the above comrades have affected the reputation of the Party and State, creating bad public opinion in society.

Considering the content, nature and level of the violation; based on Regulation No. 181-QD/TW of the Politburo on disciplinary action against violating Party members, the Central Inspection Commission has decided to take disciplinary action:

-WarningComrade Bui Cao Tinh, former Department Head, former Assistant to the Head of the Central Organizing Committee.

-ReprimandComrade Tran Cong Chanh, Secretary of Hau Giang Provincial Party Committee for the 2015-2020 term.

-ReprimandComrade Tran Thi Ha, Member of the Party Executive Committee, Deputy Minister of Home Affairs, Head of the Central Emulation and Reward Committee.

- The violations and shortcomings of comrade Tran Anh Tuan, member of the Party Executive Committee, Deputy Minister of the Ministry of Home Affairs are not serious enough to warrant disciplinary action. The Party Executive Committee of the Ministry of Home Affairs is requested to conduct a serious and in-depth review and take remedial measures.

The Central Inspection Commission recommends that the Secretariat:

- Disciplinary action in the form of warning against 02 comrades: Comrade Huynh Minh Chac, former member of the Party Central Committee, former Secretary of Hau Giang Provincial Party Committee for the 2010-2015 term and Comrade Tran Luu Hai, former member of the Party Central Committee, former Deputy Head of the Standing Committee of the Central Organization Committee.

- Consider handling comrade Nguyen Duy Thang, member of the Party Executive Committee, Deputy Minister of Home Affairs according to Regulation No. 30-QD/TW, dated July 26, 2016 of the Central Executive Committee on inspection, supervision and discipline work of the Party.

8- The Party Executive Committee of the Ministry of Home Affairs for the 2011-2016 term had the following violations and shortcomings:

- Failure to promptly amend and supplement the Working Regulations of the Party Executive Committee according to the regulations of the Politburo; lack of responsibility in leadership, direction, inspection and supervision, leading to violations and shortcomings in the appraisal and giving opinions on recruitment, appointment of ranks, salary arrangement for civil servants and the proposal to approve the position of Vice Chairman of Hau Giang Provincial People's Committee for Trinh Xuan Thanh; appraisal and proposal for competent authorities to reward the Vietnam Oil and Gas Construction Joint Stock Corporation (PVC) and Trinh Xuan Thanh.

- Not promptly directing and urging units in the Ministry to advise and propose competent authorities to review, amend, supplement and promulgate a number of regulations on personnel work and emulation and reward work.

The above shortcomings and violations have affected the leadership and direction role of the Party Executive Committee and the Ministry of Home Affairs. The Central Inspection Commission requested the Party Executive Committee of the Ministry of Home Affairs to conduct a serious and in-depth review and take timely remedial measures.
